All right. I'd like to welcome everybody to the Wednesday, December 10th, 2025 meeting of the Fall River Planning Board. Pursuant to the open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any media.

Attendees are therefore advised as such recordings or transmissions are being made, whether perceived or unprecedent, and are deemed acknowledged and permissible. The city charter section 9-18 mandates that all municipal body member bodies develop and adopt rules or policy for public uh comment. We have adopted such a policy which in short provides for citizen input on planning

board specific matters at the end of the meeting. There's a signup sheet that's located in the back of the room.

On old business, number one, roadway reconstruction, Bronson Street, section 66-185, city ordinance concerning the roadway reconstruction plan and profile of Bronson Street. This petition was tabled at the October 8th uh 2025 and November

17, 2025 meeting at the request of the board.

You uh Dan, you got So you should have a letter that um report from my office as well as Paul B's office at all the work has been in compliance with the approved plans giving dates of when you approve the roadway reconstruction. Uh and then there is also a release there for you to sign. So uh if they do have a clean bill of health and this is just for the construction activity within the right

of way of Bronson uh to the intersection of August Street and other all completed gentlemen.

All right. This is uh dated December 10th 2025 for planning board John for chairman, planning board department, one center uh regarding Bronson Street roadway reconstruction board members. We are in receipt of a final asbuilt plan illustrating the construction of a private way named Bronson from Frederick Street Wesley to August Street. At a public hearing on December 11, 2024, the

planning board unanimously voted 5 to approve the proposed uh construction plan and granting some of specific waiverss. Upon reviewing the submitted asbuilt plan for subsequent site visit, I can offer that the roadway was constructed in substantial compliance with the approved plans. We are being requested to issue a certificate of completion with regards to the conveyance of the roadway. Thank you for

your consideration. Uh Daniel Agar, director of engineering and planning. So we do have that there.

What is the uh ports?

This the one that we had some lighting.

So they had um the lighting at the intersection was resolved and then also the little hammerhead that the fire department had asked to be constructed.

So at the last meeting we voted to release the shity and the roadway was complete. So there's a form there for you to sign and then this was for the recommendation to the planning board whether or not to accept.

So we have talked about two conditions that we were putting on the applicant those conditions satisfied. One of them being the conveyance of easements which was required. That's the convenience of easements. I got here.

Do you have the conveyance of easements?

Yep. Right on top of the court and four iterations going back and forth with attorney Celino to get it correct.

But so how do you want them? They've satisfied the conditions. You can just make a recommendation to to the planning board, I mean to the um city council to accept. That's it.

existing three family dwelling on parcel 2. This plan received a special permit on September 18th, 2025 pursuant to section 423b of the fall river zoning ordinance and it is recommended that this plan be awarded endorsement.

So we have another 423P. The purpose of this plan is to divide the property into two lots leaving the existing three family dwelling 860 President A on parcel one and the existing three family dwelling 868 President A on parcel 2.

This received a special permit on October 16th, 2025. And it is recommended that this plan be awarded endorsement.

Just had uh one question uh on your minimum areas here. It says uh 5,000 plus,500 additional unit.

Where's the fif five?

That's the underlying zoning district.

They were allowed a special permit. So, okay.

The zoning information is just to let people know this is the zoning district that falls into that was the need for the special permit was to allow the subdivision of two structures in existence prior to 1954. Okay. Thank you. Okay. Any questions?

So, the purpose of this plan is to divide the property into two lots, leaving the existing fourth family dwelling on lot one and to create a new lot labeled lot 2. This property was subject to a variance granted on October 21st, 2025, allowing relief from section 8634 C and 8635 to divide the property as shown in the plan here. It is recommended this plan also be awarded endorsement.

Do you do you know what those variances are that they that were awarded for?

It was basically um sideback setback to um that existing garage.

So the purpose of this plan is to divide the property into two conforming lots leaving the existing single family dwelling on lot one with frontage on New Boston Road. It is recommended that this plan be awarded endorsement.

This is a little white um bold color that sits right in that corner. Yeah.

Nice little house.

And so just so the board understands because I know everybody thinks we just grant every zoning variance there was.

There was actually a zoning variance proposed for this to build a triplex and they were denied. So this is what they were afforded by right two conforming lots.

I was going to say I go by here a lot when I dropped my granddaughter off.

Nice property.

Yeah, it is a nice property. A lot of land to it, too.

Yeah, it was interesting before I saw this. I I thought I was trying to figure out how they were going to subdivide this. I think this is a pretty good um solution.

I I was I was a little worried that they were going to try to keep the existing single family in the garage as one unit and go right down the middle and you'd have both access for But they went for a triplex.
