The Fall River Licensing Board convened on March 23, 2022, addressing various licensing applications, a request to remove stipulations, and a show cause hearing. The meeting began with public input, where resident Patrick Higgins raised concerns about a locked handicap-accessible door and the lack of conspicuously displayed licenses in local restaurants. The board then approved two one-day permits for Bristol Community College (BCC): one for a beer and wine event on April 13, 2022, and another for an all-alcohol memorial service on May 31, 2022. Several license transfers and new applications were approved unanimously. These included the transfer of a beer and wine package store license to Arthov Corp. dba Sunny Hill Mini Mart, a new beer and wine package store license for Aiden LLC dba Broadway Convenience, the transfer of an all-alcohol common victualer license for LOEI Incorporated dba LePage Seafood and Grill, and a new beer and wine common victualer license for Sophia Rachel Inc. dba Harry's Restaurant. The board also voted unanimously to remove two long-standing stipulations for the Italian Progressive Club: the requirement for a police detail and the ban on having a beer keg outside during their seasonal membership functions. A significant portion of the meeting was dedicated to the application for an all-alcohol common victualer license for July Friends Lounge Inc. dba Cornerstone Lounge. After extensive discussion, including concerns from neighbors about parking and past issues, and support from Brockton officials, the board approved the license with specific operational hours (Tuesday-Thursday 9 AM-10 PM, Friday-Saturday 9 AM-11 PM, Sunday 9 AM-10 PM) and a strict stipulation requiring the constant maintenance of 24 parking spaces, with immediate temporary license revocation if not met. Iliana Dipina was also approved as the bar manager. Finally, a show cause hearing for Haboob Club Inc. dba The Selfie Lounge regarding a November 2021 disturbance resulted in a unanimous decision to issue a written warning. Despite the recent warning, the board later approved, by a 2-1 vote, the club's request to extend its operating hours until 1 AM on Fridays and Saturdays.

8:26with operating a beer and wine license here no violations whatsoever he's alcohol tip certified all of his employees would be required to be alcohol tip certified as well the lease has already been assigned there is financing in place rockland trust will be financing the transaction they are asking for a pledge of the liquor license as a result of that and there's a commitment letter from rocklin

10:59attorney porter yes so before the board uh this is technically a application for a new section 15 beer and wine license um this was an existing uh location for the beer and wine license within the city there were some issues with renewal on this license itself and so the license in turn went back to the city so this is really a re-application for an existing store um virel patel is going

13:19on-premise license for le pages seafood my client is the applicant l-o-e-i incorporated there is in the package uh purchase and sale agreement for the business and the real estate ultimately what's happening is there's one entity that's buying the business and one that's buying the real estate the real estate holding company will lease to the operating entity there's no anticipated changes to either
13:43hours or the premises um the manager is in the process of getting tip certified he is dr j.p van riggenmorter who owns dutchman dental here in fall river on pleasant street and um other than that there are no substantive changes i'm happy to take any questions the board may have so the hours are going to stay the same yes the operation at least initially mrs especially yeah it's going to be exactly the same
14:11does the doctor i do apologize i was glancing at the folder but does the doctor have uh anyone close to him or does he have someone on a managerial basis and again i may have missed it that he is familiar with i understand you could be an expert in more than one trade yeah i'm assuming he hasn't been running restaurants he has not in fact the paperwork indicates he's been a dentist since the mid 90s um
14:35so yes we're in the process of getting a manager on board and then we'll be coming back before the board for a change in manager at that point thanks attorney celino i see a note here that we have a positive report from the police department i don't see the chief's letter so i just want to confirm with detective monas no problems on your right not all favorable with the board entertain a motion yeah
15:00make a motion to approve the transfer of the old alcohol common pictures license so i'm not going to approve the manager today because we don't no no i'm sorry there is i'm asking for the approval of the manager as dr van riggenmorter but i'm disclosing to the board that we're working with someone who'll come on as a full-time manager okay so i'll make a motion to approve the manager thank you
15:25right now so the transfer and the yeah yes transfer and manage it i'll second okay so we have a motion made by mrs esposito transfer the all-alcohol common victory license and to approve uh the manager as uh dr john paul van riggenwater seconded by uh miss cadero all those in favor okay the eyes have it and motion passes thank you all appreciate it thanks for granted thank you item number six on tonight's agenda new
16:01beer and wine common victory of the license sophia uh rachel inc doing business as harry's restaurant 264 south main street we have mr donald cadaro with representation thank you mr chairman members of the board john mitchell our attorney i represent the caderos and the corporation i have offices at 105 bank street fall river i'm donald cadero one of the owners of harry's restaurant on 270 south main street
16:33forward massachusetts 02721 i'm paula cortez owner of harry's 270 southwind street nice to meet you all nice to meet you this is an application for beer and wine new license at harry's i'm sure you're all familiar with it just a few blocks from here um they're interested in it for a couple reasons mostly for mimosas breakfast particularly on sad days they said they've been getting calls and
17:05because they don't have the liquor they've lost some business over weekends and weekdays too are not um they're only open until two o'clock other than friday it's three o'clock so we don't believe it'd be any nuisance at all downtown and you know help their business bring some more people in um mrs cadero is um tip certified um they both worked at other establishments with like a four of a grill pause this
17:35and so they've had experience with it they know how to handle it and um they're just asking for the approval tonight so they can start serving it with breakfast does the board have any questions at this point nope i have no questions okay and there's no pleasure and it's elise they bought well they started leasing about three four years ago right now four years yeah four years ago already so
18:02positive feedback from the police department anything anything of no no all reports favorable um and i'm assuming it's not the clip the our clerk can provide the rules but you're aware of the hours that you can serve alcohol or when you can begin to serve within the city so if not you can get a schedule uh from our uh from our clerk ms miss ash um does the board entertain emotion can i just say one
18:31thing john that's you just three is the latest they ever want to serve alcohol yeah we that's the legacy we're working yeah i know if they stay open
18:49still working now i'll make a motion to approve the new beer and wine common victoria's license for sofia rachel inc and i'll second that motion a motion made for a new beer wine common victory license by miss cadero seconded by mrs esposito all those in favor aye aye and the eyes have it motion passes good luck to you yeah thank you very much thank you everyone thank you
19:24thank you attorney mitchell
19:38next on the uh rat item number seven which is entitled old business new business so it looks like on item an item excuse me item letter a where we're visiting some old stipulations it's a request to remove stipulations italian progressive club 310 slade street mr bosolay is identified on the agenda if your gentleman could give your address and name and address for the record paul
20:07bowser 310 slade street representative entire progressive club robert survivor 310 slave street vice president of the time progressive club gentlemen it's good to have you can you um tell the board what you're looking looking to have us do tonight okay well uh we had some restrictions put on our license like 10 years ago maybe it was i don't know it's been quite a few years uh far outside functions we have a
20:37couple of functions every year like a clam boyle steak a lobster dinner and it's a membership club we have them outside one of the biggest restrictions we had is we had to have a police officer there for our functions and it's very detrimental to us because it's for our membership and uh we never have like more than 100 people it's i think you've been there it's a pretty nice sized yacht if we sell tickets for 25
21:06our first ticket our first 10 tickets and then nothing against the police department man but after his 10 tickets i have to go to payton as police officer which honestly we don't feel we need one we have never had an issue at any of our functions and we like to be able to remove that restrictions so we can have a little more comfortable outings in our backyard for our memberships i mean
21:32we've had political functions there we've had all club oriented things that we sponsor the club sponsors it we do not have outside parties in our yard we don't rent our outside parties to anybody uh one of these when that was a restriction we have a shed outside that we have alcohol you know beer tap and and we would like to be able to do that outside without walking down 10 stairs
22:02to go get some alcohol to come back outside for our for our functions yeah and it's like i say it's a membership thing we never have issues we never have issues any function that we do have we have six offices at all times in any said function there's always two or three of us that are there sometimes all six depends on what kind of function it is but there is never a function
22:29with at least two of our officers at a club there so we control anything there's never an issue so we're just trying to remove these hardship restrictions that we have yeah yeah sure we work with our neighbors because they're very important because it's their their neighborhood too so i inform the neighbors that are on the side of us and in front of us at whatever event we have they know way
22:56ahead of time before we even have it since you know since i became president of the club even when i was joe's vice president i reached out because there were some fences that needed to be mended with them and i think we did a great job as a relationship with our neighbors so they know that they have my 100 guarantee whatever the problem is that they have becomes our problem and we take care of it together
23:18so it doesn't become you know an issue you know all right so can i get for for clarification purposes are you asking for the is it is it two stipulations you're asking removed clearly the the police officer which i understand if you guys have a shrimp dinner and a horseshoe tournament within your club it's your club's own event so you're looking for the removal of that stipulation and
23:42secondarily the shed outside that basically has a beer tap so there's a keg outside it would that also be like the removal of in other words not not a full bar but just the functioning of the tap the the keg of beer outside as opposed to having to keep going downstairs for draft beer is that accurate that's accurate for that yeah okay the other thing is the we had we could have no entertainment
24:11outside which for many years we did and then it got removed because if we had problems with our neighbors but we're not saying we want to have a band or dj or anything out there but i mean they didn't even want us to have a radio out there for a little music or something you know just i'm not saying we're going to have a 10 piece band out there and rile the neighborhood up because
24:32it's not going to happen yet well as you know i'm still we also have restrictions on the hours which we will still keep to yeah never in the doc it's never in darkness it's like i think we had till uh until till dusk seven o'clock or something yeah and yep that's fine uh it was i think the restriction was may 31st to october 30th which we still want to keep the same because
24:57no one's gonna go outside in the wintertime and have a function and uh okay so let me let me at least make a make an effort to navigate through this what i would suggest is i'm assuming if you want to put on at a reasonable volume you know whether it's a country music station or something in the backyard um you know as long as none of the neighbors complain you're okay there i would assume
25:22if you want to go forward with entertainment i mean that's enough that's a whole other application and license as well you have one correct for inside yes right yeah so so would it have to be amen if as situations present themselves if they did want to do something outside i'm assuming they would have to go in front of them yeah let's leave that as an as needed basis or an individual basis where you guys
25:48come back and say hey we want to have a little assuming that even happens but we want to have a little two-piece band outside or whatever but for this for purposes of this meeting tonight we're looking at being able to have the tapped keg outside during those hours up to seven o'clock in the summer and by 8 pm or 8 pm sunset and removal of the of the requirement for the police detail for your in-house club
26:14parties and whatnot so that's fair enough to say all right do we have anyone here else who'd like to speak either in support or in opposition to this i don't know if there's any neighbors here from the slate street area so do we have anybody who'd like to add anything all right at this point does the board have any any questions would you like to entertain a motion we they are asking again for two different
26:41things here so they're asking yeah the first motion would be to ex uh for the re removal of the police officer that you know could end and the other stipulation would be the cake the liquid outside outside so those are the two and the entertainment was wait that's going to be an enhanced
27:11yeah so i'll make the motion to remove the police officer and allow the cake of beer in the summertime but should we take those into separate yes uh yeah we have dates on the stipulation madam clerk right in the paperwork i gave you i think i think you see the variance may 1 october 31st okay so within that time frame okay one two october very first okay all right so i'll and i'll make a motion
27:50to request uh to allow the um removal of the police report no no i mean the police detail yeah thank god we don't have any police police i'll say a second so we have a motion to remove the police detail from the club um between may 1st and october 31st made by mrs esposito seconded by miss cadero all in favor aye aye motion passes and the other motion yeah would be to allow the cake of beer
28:26from may 1st to october 31st outside okay i'll second the motion so motion made by mrs esposito to remove the stipulation banning the keg of beer during daylight hours during those summer time frame are up to eight o'clock we'll say seconded by um miss cadero all in favor hi madam clerk the eyes have it so old stipulations are removed good good luck gentlemen thanks for coming thank you for all the help you guys gave
29:03us through these last couple of years with the pandemic especially kerry i mean i never got to do it never got to see see you folks but i talked on the phone and other people talk but it was a lot of help that you guys gave us to get through this i just want to say thank you guys thank you thank you appreciate it all right old business new business uh and again i always i
29:28know i always have a tough time pronouncing it july friends lounge uh inc doing business as cornerstone lounge 222-2 it's main street mr de silva is back welcome again mr chairman members of the board good evening for the record my name is arthur frank i'm a lawyer with an address of 209 bedford street florida massachusetts with me is the manager of the llc mr manuel the silva and i believe mr peanut is also in the
30:00audience the proposed bar manager when we were here in february i informed the board that we had secured uh parking uh for 24 spots we had also reduced the seating capacity down to 96.
30:1824 spots would be required for one for every four seats it was at that time that the chairman suggested that he wanted the building inspector to see the building we subsequently went out on a site visit i produced for you the parking summary showing where the 24 spots would be i also spoke with mrs petter at the request of mr hathaway and at this time mrs petter is very very involved with her husband's health
30:48she feels that the current paperwork that she submitted to mr de silva is sufficient to bind her and at this time she is not looking to sign anything else but she has committed as you know that mr mr de silva i think has pre-paid for the current year so at this time we're looking for the board for a favorable vote uh we believe we've satisfied uh the zoning requirements we believe we've satisfied the the
31:18parking requirements and we're asking for a favorable vote okay so as you both know the concern of the building inspector and i'm paraphrasing regarding the parking is that his concern also was though i believe without some sort of a time frame that that it would be in effect it could go away at any time i i don't believe the certified letter said you know from april 1 2022 to march 31st 2023
31:58i i'm sure i have it here in the file somewhere but can i get clarification on that do we have any so and i'm not doubting that you paid for the year and you have a verbal with her i know we went back and forth over the statute of frauds at the site visiting what has to be in writing what doesn't have to be in writing so for the education of everyone here tonight i mean
32:23i won't rehash that whole legal conversation but um do we have any active dates in there when this lease would be in effect
32:43he's paid and as far as i'm concerned he could use the lot right now just to park cars on for his own for his own use uh attorney frank do we have anything written on a receipt that has a d you know when you or or on a canceled check in a memo section anything showing the time frame of what you paid for it's like opening these you can't open
33:07these in any way you go you can get an open lease like like i say that that one i have in brockton's open lease it doesn't mean because the open lease you you don't have assassin because anybody can do open lease or at least for three years or a year and a half or five years i don't think so you know you understand my my warriors the parking is essential or i think it has become
33:35i don't want to speak for other board members it would appear that it's essential uh to know that we have some sort of parking relief you know within the neighborhood that was one of the first stumbling blocks and i i i understand that he's done it but again i'm worried about the owner saying a month from now well you know what you have nothing in writing that's it you have no parking anymore let me suggest this
34:02that's a zoning enforcement question and if you can put in to any decision that you would craft the requirement that he maintained at all times at least 24 parking spaces and if he doesn't he obviously is subject to losing his license he's willing to take that risk okay um i do just to change speed um i thank you for uh offering that stipulation um i believe detective monas wanted interject with some new
34:40information regarding continued background checks and contact with i believe abc board but i'll let i'll let detective monis elaborate yes thank you um so since our last meeting i was able to make contact with kyle gill who is the associate general counsel for the abcc and he was able to provide me with some paperwork that sort of filled some of the gaps from the last licensing board hearing that
35:07mrs dasilva was managing managing the property which he now owns in brockton there are some concerns that the department had regarding allegations that were made but those have since been concluded if you will so from this point forward this information has been shared with the chief and he is providing a favorable report for the police department um thank you detective so favorable
35:36what do you mean like the manager like you were the manager of a business in brockton that you now own at the same location on 250 main street in brockton it should be manager right you're the manager there and now you own that correct approach right there was a time frame in between where we had a bit of a gap where you were participating in a licensing board meeting where you were
35:56the manager of that property and you now own it he has provided me with the paperwork that has closed that gap so we have a better understanding of what the outcome of that hearing was does that make sense so they filled into information and and that was positive regarding your situation and broadcasting favorable recommendation okay so um board members do you have any any questions uh well let me again the
36:28we do have i know there are neighbors here i mean i know they've um they've spoken their piece but i want again i want to give them the opportunity since they're here again tonight if anyone would like to speak for or against this particular application i think we have a sense of the concerns that were growing uh going around the neighborhood but i want to offer that opportunity if anybody would like to speak
36:53um about well patrick had his hand up first okay okay thank you hi i'm rosemary with points president of the cards kelly neighborhood oh rosemary could you please come up so you can use the microphone attorney um could you slide over attorney friends please sir if you don't mind hi thank you my name is rosemary lapoint i'm the president of the father kelly neighborhood association my concern is
37:23if you have an open lease for parking that could be stopped the next month he has to provide 24 parking spaces for the patrons that will be at the location where is he going to get 24 parking spaces in that neighborhood as you can see by the site visit it's a very congested neighborhood that is my concern can you can you answer that where he would have to go to well i imagine if he lost
37:52those spots across the street if the stipulation could be made where he could not operate until he replaced those that is my second question okay so if and when or maybe he lost the ability to park in that location how long does it stop how long does it take to stop the establishment from running if you step if the stipulation is made on the within the approval it would be immediate is upon notice to my
38:25experience with this board and with the building inspector is that it it's immediate yeah it's it's immediate i understand that you would like to open a business i have nothing against businesses but as you know for the last three meetings that we've attended that it has never ever worked with that type of establishment in that area i have neighbors that will be adjacent to the parking lot i mean
38:53we're woken i mean my house was right around the corner we're woken up you know the cars are leaving they're they're racing down the street they're parking they're you know like there's a lot of you know cans alcohol nips things thrown out on the street i mean we just don't feel that that's the right place to have an establishment especially the hours that they want to operate that's all i have to say thank you thank
39:21you um mr higgins
39:35good evening ladies and gentlemen good evening i've been watching these hearings since before you got on the board when john celina was here this thing has been going on way too long i have been to mr de silva's restaurant in brockton as i said to mrs monas earlier tonight the restaurants in brockton have all the licenses on the wall his restaurant does too he runs a great operation you guys are making this man jump
39:59through hoops and it's crazy the guy spent a lot of money to open a restaurant in fall river the licensing board has the capability to put restrictions if you put on the license that he has to have the 24 parking places across the street and if he loses them then this board can do something i know the hours have been addressed at many meetings i don't know what the hours are that they're asking for now
40:29but i'm sure that i'm sure that attorney frank will let us know that very quickly give this guy a chance get some decent restaurants in fall river let the guy operate he spent a ton of money to operate a restaurant let him do it and if he messes up and i believe me from the operation i've seen in brockton i don't think he's going to mess up she spent a ton of money here to make a
40:52profit she's got a big hill to go he's got a hill as big as president avenue to make a profit give let the guy go if he fails he fails but don't don't set him up to fail give him a license let them operate let the residents of fall river vote with their dollars and if the neighbors are upset you know his hours he's not going to be open till
41:15two o'clock in the morning he runs a restaurant he runs you know he calls it the cornerstone lounge but it's not a bar and grill it's a decent restaurant let them open please let's stop this thing let's make a decision tonight let's get them open thank you thank you mistakens good boy yes sir
41:47brian kurt 118 east main street fall river welcome hi i have a question because i i looked something up regarding restaurants opening having liquor license and i remember seeing in mass general law that they have to have windows out front that you can look inside the the uh the establishment and i don't know if i if i read it wrong but i know you said it was checked out by the the inspector but that location
42:16the windows are about above my head are just above my eyes a little bit and since it is a restaurant selling liquor i'm just asking if the board has addressed that because you did the walkthrough and i don't know what was discussed so i just want to ask the board if they've if they're if if the gentleman is going to comply with that part of life i read it correctly well
42:39what i will say is that uh the building inspector was comfortable with all aspects of the building mr kerr we had them and we went through the entire building it has functioned in the past as a bar and whatnot and i'm not suggesting it was successful but um you know we did have him there and his issue was was uh parking uh in uh excuse me parking and parking in relation to seating capacity within the
43:11within the restaurant i understand it's just they uh for what i had read if it's a a bar they can put the high wind is like because that used to be a nightclub so that's set up for a nightclub but it is now being going to be run as a restaurant selling liquor and according to what i read on mass general law that you're supposed to be able to look inside and you can't look inside for
43:33those witnesses so that's why i asked if um if i read it right and if i did read it right is the gentleman going to do something to the to the to the windows as part of the renovation to open it as a restaurant well i will pass on your concern again to directly to the building inspector to ask him to research the pertinent stature you may uh be referring to and whether it's accurate
43:56whether it's been amended obviously i cannot i cannot speak to the veracity of it right now but he'll do the research all i can tell you is that he was comfortable with everything um he was comfortable with everything uh within the building you know that's what i wanted to bring up renovation the electrical plumbing i mean we did go all over we did go over the building but i will bring it to his attention thank you
44:21you're welcome
44:28yes name and address please my name is adelson mendes i'm not i don't live here in four river i work in brockton i'm the business assistance manager for the city of brockton at brockton redevelopment out already we are excited about uh mr the silva opportunity to grow his business my position is all about supporting business in their uh effort to really grow especially in a very difficult time
44:59that we see in a lot of business close their door and seeing uh mr de silva uh moving to a neighbor city uh i'll call a getaway heat as well that has also a lot of key viruses from bottom moving here uh it's just uh we all excited and we're looking for the opportunity to come here we have co-workers that leave you actually near the address he's going to open that
45:25works in fall river they go to mr the silver restaurant in brockton and they are excited to have the restaurant near them here in for river so we're here just to show some support to a business that is well known in brockton and we feature him in our um and monthly uh that we mentally um how i can say you know social media will put information about business that are doing well
45:50enterprise local news feature uh his restaurant as well just to let him everybody know that despite all the circumstances with him just to become a well-known business in brockton he uh went through maybe some of the things that he went through is going through here now with the license committee but he successfully opened the business and he's been running a business and i feel that he deserves an
46:15opportunity to bring also something that he's doing great here in fort river thank you thank you anyone else for or against yes
46:37debbie ferreira 100 palmer street i just want to say that i agree with mr higgins that these meetings have gone on long enough and that i hope that everything that we have repeatedly said for the last three months has not fallen on deaf ears um i am the neighbor that abuts the property where this parking will take place and i don't know how many times or how many ways that i have to say that
47:05i don't want this to happen because if it does happen and it doesn't work out it's going to take us longer to stop it and it doesn't make sense to me after all that everyone here has come here month after month and told you how much we don't want this in our neighborhood thank you yes
47:39so my name is charlize i live on 68 aetna street and i understand the concerns about the parking i i live right in front of a pub um but i don't think that should be his like held against him we should give him a chance to open here and if it's going to be used as a condition for him to stay open then he should be voted in favor of and we
48:05should give him that chance to open and the experience will let us know if it works out um that i know of i haven't really found any restaurants like pretos mr da silva's um here in fall river and the experience the food everything the culture is all part of it it's not just about parking or any of that stuff um so i think we should give him a chance to be able to bring a positive
48:36environment to the community because it's much needed in our area thank you thank you yes natalie mello bank street neighborhood social association for many many years we've supported father kelly neighborhood my concern is if this goes through what's the hours i think maybe if there was good hours because i remember uh mr dessert was saying to one o'clock in the morning maybe if it's good hours maybe
49:09like other restaurants 10 11 o'clock maybe it won't be so bad but being later it becomes an issue um and and i feel debbie i understand how debbie's feeling other members we've been through a lot in our neighborhood with uh drugs or people drinking a prostitution drive-bys or gangs guns so it's scary when and what father kelly neighbors been through they've been through hell and back so
49:35it's got nothing to do with him or anybody else that works for mr de silva it's the fear of all the things that they've been through so that's my concern and then you know if they're gonna have open hours i mean if they're gonna have a kitchen is their kitchen ready to go and the concern is hours what's the hours maybe they can work on hours where everybody can be okay you know nobody's knocking down
49:56businesses we all want business no matter where you live thank you thank you let me address the hours mr chairman yep you may recall uh when we first came here you actually you weren't here because mr smith was uh we were looking at some morning closing hours i've talked now to mr da silva and we would propose the following schedule tuesday through thursday 9 a.m to 10 p.m friday and saturday 9 00 a.m to 11 30
50:33sunday 9 a.m to 10 p.m tuesday thursday 9 to 10 friday saturday saturday 11 30 nine to 11 30 sunday 9 to 10. you can't serve alcohol till 10 though he can be open but he just can't surf out on sunday what's the cutoff time 10 is when you can start a.m oh are you sorry i left that pot out yeah no i i understood that i think that that's my error
51:0910 on sunday obviously no alcohol until 10 a.m um i'd like to make one quick comment by the way in defense of the of the board not only have we had a change in i'm just going to make my statement and leave it that way as that uh but if at this particular moment i will speak on behalf of the other board members um if this would have been a snap decision in a meeting people would
51:43have said one way or another that either he wasn't giving due process or applicants or the neighbors you know we held history against him or you know we just buckled with the neighbors or whatever i'd like to say that i think the licensing board has tried to do due diligence here and balance the weight of everyone's feelings emotions strengths weaknesses the ability to conduct a business
52:11uh things of that nature so if i can say in defense of the board i understand that it's been you know it's taken some time to get here tonight i do expect some sort of a decision here tonight but if i may you know if we would have made this decision in five minutes at the first meeting with the prior chairman before i was here and whatnot everybody buddy would have said we're shirking our
52:33responsibilities in one way or another so i at least would like to at least get that out there and get that on the record now um back to the matter at hand assuming we don't have any additional questions is there a motion or i i generally generally i would like to say that i still think um which regardless of um regardless of attorney frank's offer i think the board was was going to
53:10stipulate the presence of parking spaces anyway so again um i'd like to i if i could put in my two cents and thinking out loud here that any motion that we decide to make tonight assuming uh that there is a favorable one that it is tied to the presence the constant presence of the 24 parking spaces and if that lease does go then there's an immediate immediate temporary revocation of license however
53:42it's going to be termed but that business is shut down until those parking spaces are replaced so to speak but um the board want to entertain a motion here i'll make a motion that we can change the hours to 11 pm for the friday and saturday yes okay so so your motion mrs esposito if i may would be to approve i believe we have an all-alcohol common victual application here correct is it all yeah
54:25all the alcohol common victual um with the operational hours if i could repeat tuesday to thursday 9 a.m to 10 friday saturday 9 a.m to 11 and sunday 9 a.m to 10.
54:45yes and with the further stipulation of the presence of the 24.
54:52spaces yeah how about the situation with the windows though would that have to go in well again that would be up to we'd have we'd have that vetted by yeah by mr hathaway building inspector yeah yes so we have to wait for that well again also i mean they're not going to open without a sign off of the lens so we can have them research that prior to mr chairman whatever the building
55:18inspector tells him to do he's going to do he's going to do yeah because he doesn't get a co if he doesn't do what the billing inspector tells him correct correct correct so do you think we could have that the motion restated clearly because i just want to make sure your intent is on the record okay miss cadero okay um i'll make a motion to approve the all-alcohol common victoryless license
55:46for julie julian friends and lounge pending the change of hours from friday and saturday closing at 11 p.m and the parking spaces across the street in our second at motion okay so motion made by um miss cadero and seconded by mrs esposito approving the application uh with the hours stipulated as tuesday to thursday 9 a.m to 10 p.m friday saturday 9 to 11 and sunday from 9 to 10.
56:22obviously applicant observing all alcohol serving licenses and whatnot and with the provision of constantly maintaining 24 parking spaces so can i ask for a vote all those in favor hi i uh the eyes have it the motion passes the application is granted with those stipulations we need you to approve mr pena now as the bar manager can i get a second motion please
57:07i'll make a motion to approve iliana dipina as the uh manager of judy i'm in friends and i'll second that motion so motion made and seconded all those in favor aye aye the eyes have it mr peener is the bomb manager thank you mr chairman thank you that matter closes and now we're going to get to item c thank you for the boy thank you sir good luck showcase hearing for a boob club inc dba
57:42the selfie lounge 144 guild street
57:58once uh everybody gets settled in here i just want to set up a little this is my first show cause hearing so um i do want to just try to set up a little process some ground rules here um so at least we know how the order how the meeting's going to flow what order we're going to take this so i don't have to mention that your folks are entitled to representation because they could be
58:22anything from no action to revocation i see that you have attorney assad here so what we're going to do is we're going to we're going to open up with the um uh the police report from defect detective monas clearly we've have uh we've had an incident um i will ask attorney assad if he wants to waive a full reading of the police report and then we'll get detective monis's testimony the board may ask questions attorney
58:53assad may ask questions and then we'll turn to attorney assad's presentation of the case on behalf of the licensee and then any police department rebuttal obviously the questions uh from the board to attorney assad after his presentation what um since we have a documented instance here and testimony is going to come from fall river pd i'm not going to take um uh uh or solicit comments in opposition
59:22you know or opposed or for uh the licensee here and whatnot the police report of the uh police department will essentially be the moving party on behalf of the citizens of full river so uh with that uh with that explanation if we could uh please have the report i'm sorry yes attorney david assad i'm an attorney licensed to practice on the commonwealth of massachusetts i maintain offices at
59:51326 pine street in the city of fall river member commissioners there was in fact an incident that occurred on the 7th of november 2021 i think it's documented well documented by detective monas's report the necessity of reading the entire report i don't think is required i think it's the report as it was presented to me by miss ash substantially uh dictates uh what happened on that evening after
1:00:22from midnight until everyone left i think that it's well documented within the report that there was a disturbance the police responded the participants and the members of the club left peacefully without incident the building was shut down and from that point forward there's been no further incidents at that location uh some of the con so that's i it happened we're sorry that it happened and i on
1:00:54behalf of i think it's officer goslin we extend on behalf of my client the apology for his disturbance his disturbance his wife's disturbance and his child's disturbance he only lives about 250 feet away mr l corey freddie alcory the man to my left was not present he was in the middle east at the time uh the manager uh it's the manager of we talk about it freddie el corey is the manager of the
1:01:24club he's the manager of the liquor license his brother was there in his absence and that was the gentleman that was referred to in the report that cooperated and made everything that night had the patrons leave the patrons left in an orderly fashion i think i was smiling a little bit in the report that some of the people that were leaving were thanking the police for coming and doing their job
1:01:50and that's from that point forward there's been no further incidents uh okay so it turns out if i may if i interrupt then so you're waving the reading of the food before and it sounds like you're stipulating to the facts those are the facts for itself that's correct all right so is it detective monas unless you would like to interject at this point then if not we can go right to attorney assad's rebuttal if
1:02:13you wish or your presentation is there something you would like to add at least at this point obviously we reserve the right to ask your questions attorney aside please continue no so that's that was the incident that's what happened after that we had a discussion as to the management of the club and the things that needed to happen holding the alcohol beverage license the the hours of operation end at 12. we
1:02:38understand that why it continued beyond that i don't have a good explanation other than the party that was going on and i'm not saying that this is an excuse for the party the individual that was hosting the party uh recently had a child he was having friends and family over the party he became a u.s citizen and he also uh completed a business deal that was successful so he invited friends and
1:03:05family over they were having a good time i can't verify this i thought i could and maybe some of the offices that were there but at the end as they were leaving um they were playing the star spangled banner so i don't know whether or not because there was some singing that was going on but my conversation with the dj that was there or doing the music that's what they were playing
1:03:29everyone was very happy to be in the united states but after that incident we've also talked about from now on having a detail to make sure that incidents like this don't occur that the doors are closed that there is mr l corey on the premises when this is happening because he's ultimately responsible for the behavior of the patrons in the running of the club and that's where we are this evening i
1:03:54the rebuttal i have he wasn't there i believe the police report i would ask that if the board considers this incident as a one-off the also the period of time this was the first time that people could gather after the covert restriction was lifted so you've had mr ocor he got his license and he was essentially shut down this was the first activity that was taking place on the premises
1:04:19uh prior to that he had the license paid for the license and the club wasn't being used and i think those are mitigating circumstances and the behavior of the patrons may be something that the board should consider or i would ask them to consider and maybe uh ultimate disposition may be a warning i have nothing else to add attorney attorney yeah do we have a detective detective yeah
1:04:50do we have other incidences that you know of at that club no it's the only one that's been documented um that was reported to me i don't believe there's been anything since then that's been documented or reported not even prior um prior i can't speak confidently on i don't recall there having been nicely prior like i think he said this was their first time opening um since they've been in ownership of the
1:05:15business if there were any reports for that address it was probably understanding sprout the so um this is what i believe was their first time opening since they purchased it and renovated it all right i believe this was a sunday night in november that's um correct any further questions for either attorney assad on behalf of the licensees or for detective monas no questions um so it looks like this was the first
1:05:52incident yeah and since it's the first incident i mean clearly we have to um we have to act out with at least um a for whatever discipline uh the board would like to entertain i would make a motion to give a written warning and place it in the file as this is their first offense okay i'll second the motion okay so we have a motion to place a written warning on file uh made by mrs esposito
1:06:30seconded by um miss cadero um i just would remember in place on fire i just do want to again and i understand that i've heard all the mitigating factors obviously in the future we just we've got to make sure that we're managing better here you know so we don't have this extent of of disruption within the neighborhood you know when i understand that those property owners do live near a club and
1:07:05it was a club for many years and whatnot but again it is a sunday night and i doubt the residents who were awoken last that night or prevented from sleeping you know joined in into the national anthem and what uh like i i'm sure that they were not pleased so i understand i understand the mitigating circumstances and and um and lord knows nobody on the board is afraid to have a a good time and whatnot
1:07:33but we have to we have to stay uh you know a good neighbor so um we'll hold the military no no i just wha you were talking about neighbors i they were there was a few neighbors that came out this evening in support uh but i really didn't think that it added anything because they're enjoying a good relationship with the uh with the club yeah sure but there are but there are neighbors surely
1:08:01absolutely i i wasn't there but the reports were so well written well documented uh listening yeah this is awesome that's what happened and it was a one-time officer so they did a good job that's correct um okay motions on the on the table to issue a written warning uh to be placed on on file and it is was seconded by uh ms gudero all those in favor aye the eyes have it um
1:08:31so madame clerk you will in your normal course of business please issue a warning to the licensees uh second item member commissioner uh you're welcome sir uh 70 extension of hours uh for the haboob club dba selby lounge 144 guild street uh on behalf of mr el corey again attorney assad yes so we had this incident where it was over 12 o'clock and people were there the un my understanding is the operation
1:09:08of the club as it exists right now uh they've been shutting down for 12 o'clock meeting that mandate the license has a 12 o'clock limit the request is to expand it to one o'clock so we don't run a follow of any further incidents going beyond 12 o'clock so last call clean up get out by 12 by 1 o'clock place is shut down questions from the board members extension of bowers no questions
1:09:46no i have no questions well i i just have a suggestion if yes if they know that they're going to have a party with a lot of people they should have the police i would say that's what we talked about we said from now on when we have parties like that they need to have at least one detail maybe two yes that's going to be that's going to be a prerequisite for a member
1:10:08requesting the wall yeah so now on the back of the written warning for the noise violation that we pass 12 we're now being asked to consider an extension of the hours till one o'clock guys can you give me the what are the hours for the week as they stand now as if i know it's still 12 o'clock every night when we open 12 to 12 i believe it's 12 years
1:10:3012th it was a 12 to 12 license sunday to sunday to saturday on monday to sunday and should you say seven days a week 12 to 12 seven days a week so now you want to go to 12 to 1 a.m just on friday friday saturday um does the board wow so he went entertain a motion here so it's to extend by an hour on friday and saturday okay
1:11:07okay i'll make the motion to extend the hour until 12 o'clock that's friday friday saturday yes thank you for having permission to one night no 12 bucks exact 12. one it's the current license is 12. well terry i'm just saying i think it's mississippi i thought she said one she said twelve right right right right right right right right right right right right right right right right right right
1:11:27right right right right right right right right right right right right right right right right right right right right right right right right right right right right right right right right oh i'm sorry i thought it was changing from twelve to one yeah okay you can change it if you want to i'm not telling you how to do it it's just oh i said oh i know what you're saying i
1:11:38can extend it to the one one a.m if you'd like to yeah for friday and saturday friday on saturday so yes i'll make a new motion okay so we draw the prior motion new motion uh go ahead 12 times 12 to 1 a.m friday and saturday okay so we have a motion made yeah to extend by an hour friday and saturday made by mrs esposito do i have a second i'll second
1:12:09okay so motion made by mrs esposito seconded uh by miss cadero um i'm gonna ask for a roll call vote on this motion uh to extend the hours from midnight to one on friday and saturday so um mrs esposito yes yes this cadet is um the chair will be voting no on this so motion passes um and uh operation of i was extended for an hour both on friday saturday thank you mr chairman thank you member
1:12:52and uh unless we have any sort of business there's nothing else on the agenda can i get a emotional journey i'll make a motion to adjourn the second motion motion made by miss cadero seconded by mrs esposito all those in favor aye aye mom meeting adjourned
