detective Heather Monas with the Fall River Police Department 685 Pleasant Street Madam clerk was there a letter from the chief on this or no Council Valley yeah this uh uh uh are you open now yet um no not yet I mean I can't open today yeah okay so um when did you try to take it over I just purchased it uh the building itself two months ago roughly two months

ago yeah the other guy who put the black Tire on no that wasn't before that's done before yeah all right uh we had a few complaints down there I don't know if these detectives got some paperwork on there if you got something let us know what it is please so we did have an issue 2022 I think it obviously was what the previous um at one point we had received an application for an auto sales

the applicant was denied several times and at one point we began an investigation we were under the impression that they were still operating without a license we later found that there was a license for the auto repair portion of the building but not the auto sales they were running as two separate entities at the time the auto repair portion of it did still have an active license which I had

reached out to the licensee and he informed me that they hadn't been in operation since 2020 and no one had permission to use their license we've since rectified that situation the owner was made aware of the situation and they were ultimately forced to evict anyone that was utilizing the building without permission prior to that we really don't have very many complaints the only complaints that we

did have for parking I know there was some some concerns that there was they were utilizing the street for parking of customers Vehicles we actually don't have any reports for that the reports that we do have were that the business was complaining that people were parking in front of their garage doors and they weren't able to remove vehicles but other than that we don't really don't have anything else

you know if I may uh all you want is an auto repair shop yes no sound cards I already have the sales portion of it ready uh you already have a license yeah to soak us yes do we know that so I can actually speak on that so I'm on the licensing board as well um so he did apply for a separate license for auto sales that has gone in front of the licensing board and has

been approved okay has it been approved yes uh the biggest complaint down there you know they keep changing hands you end up buying it right yeah I bought it so I guess you're going to hang on to a little bit yeah I did and I did hear about you know I spoke with uh somebody from building department and had mentioned that problem in the past yeah I mean I was aware of it I know it's a

small place so and I don't plan on you know having a ton of cars there to begin with anyway um and you know I think I think I'm pretty respectful of the Neighbors in the neighborhood you know once I get up and running I want to you know invite a rainbows over for you know cookout just to kind of get familiar with everybody and I'm not trying to step in everybody's toes there yeah

uh yeah the only problem we had there they were little parking cars in the street that was going to be repent how many cars can you take in that building at one time I I only plan on selling like maybe two cars I'm not gonna have a majority of stuff all right all the selling the car is not going to be in the street right they're being a lot right so now we're talking Auto Repair

uh so if you got two jobs to do it's probably gonna be two cars at a time in there and not going to utilize the street too much although we can I mean there's there's people that live there so they usually like you know I've been going there so I know people that are parking there at all times like I'm familiar with the cars yeah um but obviously you know it's

not my place to take that parking spot I mean it's for everyone you get next to the pizza shop they went by there today and they're really wide open yeah but I mean how many cars can you do yeah right so I'm not going to be you know it's not going to be like tons of content out of that place it's going to be me so there's so much I can do so

yeah all right well that's the only problem I had um and I guess uh I mean I'm not going to stop you just do what you got to do keep the neighbors happy yeah and you'll be on set yeah then I mean obviously you know that goes like a good guy so you followed the rules we would have no problem yeah like I said I'm not looking to ruffle anybody feathers I

just want to go in there you know yeah and befriend with everybody because you know how that goes if it goes the other way yeah I've been on it a couple times I couldn't you got the big black truck yes yes that's you all right I missed you a couple of times all right with that uh wish you luck if you get all the votes in I don't see no problem but

good luck item four is an uh order for for an auto repair shop license renewal for Mario Guerrero DBA Mario's Auto Repair and sales 830 Globe Street this was also referred at the May 16th meeting is there anybody from this repair shop here come on down

he's got a renewal of auto repair now the sales if you get a sales I talked to him today you go to sales are you gonna license the sell cars no that's why I was asking you uh you had told me that he was going to have an issue having it but before we start the conversation I apologize can you both just give your name and address for the record 319 Ocean Grove Avenue in Swansea

Massachusetts Roger macedo 35 Shannon Ave Tiverton Rhode Island and the address of the business is 830 Globe Street Fall River thank you Council Pelletier so Auto Repair license is one to be renewed right so you don't have well it says Auto Repair in sales what is it that you get you're getting uh Auto Sales that's what the plan was yeah who's who's getting the license look Mario's could you speak into the

microphone both of you thank you you put in for a license to soak us yes which we had put into fertilizers for the repair before my license for repair comes here correct and a license for sales goes to um licensing board licensing boy is that where you applied yes and when is it coming up not here not for this I mean what repairs Us sales is is less important I think the detective might have some information

so um this was actually scheduled for the last licensing board meeting but it was tabled um due to no one showing so it's still under review hasn't been voted on so will it be at the next meeting we'll be at the next meeting yes and what was the problem um so the issue with both licenses are that um I don't know how to pronounce your last name I apologize yes um doesn't have an active driver's license

so we've actually the police department has referred that it not be approved given that Mr larrero is running in an auto repair shop and I would imagine would need to drive the vehicles that he's repairing to make sure that they are operable um that has been the hang up for the police department at this Point let me get this straight the auto repair license is in your name your name

the top-notch detailing is mine it's so many the same yeah so he's the guy who's getting the boat licenses yes yes that's why I asked you today if he couldn't do the auto sales if I could do it seeing how I have the left side of the building if I could do uh I don't drive the cars for Mechanicals if I could have done an auto sales uh underneath my business well I mean

the license is going to be in his name I guess again I can apply for one separately from I mean it's two separate businesses I don't I don't know I mean you're gonna have two Auto Sales in one building well I think counselor what they're saying the issue was is that he applied but he doesn't have a license so that's why they're hesitant to give it so if he doesn't get it you would be applying for

it and it would be the same correct okay okay no this hasn't gone in front of the license board yet it's been tabled twice so this isn't a conversation that's been had yet I don't know what the practices nobody should for the last meeting which was I think last Wednesday

well I mean we'll see what comes out of it and we can you know vote for the the license for the renewal the sales we really don't have nothing to do with it so I don't think it should read the Mary's auto repairs entails that's just the name of his business doing business that's the name of his business we're just dealing with his repair shop license all right I have no problem I was there

today the place is nice and clean uh you got plenty of parking for five or six cars to sell and still have enough room to put maybe another four or five cars there on the other side not only that is is base it could take at least four cars and then you could put two more cars in front of the doors without hurting anything without going in the street uh so I think it's an ideal

situation if you're gonna have the license for both of them and uh I don't see any problem there whatsoever put that out of you just a question for you detective so this is a renewal so he already had the license for the auto repair shop and with no issues no so I think what happened was I think he actually purchased the business from someone else it was still an active license and then it was transferred to

him so he's never actually had the license and okay but you're saying you have somebody else that you don't drive so somebody else drives the car the mechanic yes yes okay thank you Council proposal nothing is there a motion motion renewal license second motion or renew made by Council of Pelletier seconded by counselor postal all those in favor all right so loaded thank you thank you

item five is a communication from an anonymous president regarding the taxi companies this was referred April 25th um I'm just going to read this for the record there are a few important matters that should be handled with the cab companies in Fall River sorry yeah it's uh I read it earlier but it's it's uh in yeah it's very cursive they are rude when they answer the phones tell them that

tell them to take that ridiculous answering is that ridiculous yes tell them to take that ridiculous answering system off and answer their phone stop telling people they need others to pick them up they're too busy for them answers their phones and act like adults stop telling the customers they have more important people to pick up stop telling them they only pick up doctors appointments

these are not just for 65 and older they stay in the cab and don't help with packages while the customers are being mugged this is rude and the city is going to be sued if it keeps up concerned citizen who votes so this was referred to the committee on regulations at the April meeting as a communication unfortunately there's no way to contact this person and this is just kind of a general complaint on

taxi companies it doesn't say anything specific to a specific company counselors you have anything on this well you know I deal with Freddie for a long time maybe 35 years when you first come in the city Fall River he's always done a good job but now you got these guys Uber picking up and this private guy picking up this guy private picking up we try to get the medallions for him uh to the city

council 2500 values per taxi company and they didn't want to hear it so they're in a bind they're up against it all the time sure he probably is gonna they have an attitude because they lost a lot of business and it's coming to the point where uh that it just may close up the business because what's going on so it must be a little agitated and whatever I'm sure they do what they have to do to

try to take care of their customers but you can't keep them all happy uh and then he's got trouble like everybody else can't get no help you can't get no hope and that's it so where can dictate what he's going to do you can be rude you can't do it you get the business you do what you have to do I ran many businesses I was I was always a nice guy

we've done all right but you got people uh that's a little strong people working for you and they get sick of hearing this thing and they tell them off so what can we do actually nothing we can refer to the cab company and let it look at it and uh let them do what they have to do it's part of our jurisdiction to be honest with you how many cab

companies are in the city just two so this doesn't identify either one one's got a contract with Katra and he's busy all the time this poor guy here is in left field and he just can't make it wit you know all right so you know if we uh send them the letter and let them know that we could complain whatever you can do about it we can't do nothing else

city council but we just take this and finally put it on files on without you thank you thank you counselor yeah I guess my only thing is you know to the person who wrote this if you want to reach out to us and give us more details exactly um you know what some of these issues are and if we can be of more help we can surely do that but it's like you said it

leaves some details out as far as who and what some rationale so I mean if you're watching feel free to give us a call and we'll help out but uh I think we can forward the complaint my colleague said forward to the cap companies and and go from there yeah this seems more like a human resources issue for the for the cab company so is there a motion to accept and place on

file accepting places on file and send a letter to uh to the cab company the guy's name is Freddie Holmes to both yeah yeah that's a good idea foreign thank you item six is a communication from Mark dinardo 31 Beatty Street regarding neighborhood noise from businesses this was preferred April 11th 2023 and if the detective wants to join us and uh if Mr dinardo is here I'm just going to read it for the record

to whom it may concern my name is Mark dinardo I live at 31 Beatty Street Fall River me and my neighborhood residents are very disgruntled with century pavering and Allen Auto Sales both on North Quarry Street a center Paving starts their trucks no later than 6 a.m constant noise throughout the day beeps and thumps dirt dust from loading and unloading trucks more noise dump trucks pulling up in

front of my house and backing all the way back into the law of North Quarry and Beatty Street this presents a safety hazard for the neighborhood and for Allen Auto Sales more noise auto body paint mechanical detailing with power washers Allen has permission from Sentry to store a few cars it has turned into a towing company they also perform mechanical work which they are not licensed according to the licensing

board and more noise because of missing Mufflers or and or catalytic converters I know that the detective has some information on this but I also spoke to Madam clerk today because Sentry Paving and alinado as I'm told were not notified that this was in front of us and the reason being is because the city council and regulations does not have control or any authority over these specific licenses that they

hold is that am I saying that accurately Madam clerk um so while we could have everyone at the table there's really not anything that we can do I did hear from the for the attorney for Century Paving because he was concerned they didn't know anything about this I I believe the owner heard about it through Word of Mouth somehow I did follow up with him and let him know you know it's not

something that regulations has control over we would certainly hear from you and the detective but I also gave him your email address and a copy of your letter so they might be reaching out to you to see what what can be worked out um can you just give your name and address for the record sir my name is 31 BD Street in Fall River thank you and detective do you have an update on this um

so this is actually something that I'm very familiar with um this was first brought to my attention when I came into Licensing in the beginning of 21.

um we've I've actually gone through the call history for that particular location we have 41 calls for service regarding this incident dating back as early as November of 2016.

the calls came in many of times um refuse parties so it wasn't something that we'd be able to address with the caller but pretty much the notes for every single one of the calls were very repetitive it was that Alan Otto was operating um well in the operating they were doing mechanical work to vehicles in the lot of Sentry Paving so this is something that's been investigated many times from

the uniform division from 2016. we have confirmed that Allen Auto does have permission from Century Paving to utilize some of their parking spots in that lot to store vehicles that they get from the auction throughout the years we've responded to calls there we've not found them doing any mechanical work in the lot what a lot of time happens is the vehicle probably is dead they're jumping it um

maybe a flat tire and they're changing the tire but I actually have documented the number of times that we go there granted a lot of times that the police department is called there probably is a lapse of time in the time that their officer responds but there have been in incidents where we responded within two minutes five minutes three minutes ten minutes six minutes and um it's been unfounded every single time

I've actually investigated this like I said back in the beginning of 21.

um I worked very closely with the building inspector Glenn Hathaway I'm not always readily available to leave the office and and drive over there so as I were receiving complaints actually um Mr Donato was given my work cell phone number so he could contact me immediately that way I could get out there as quickly as possible and in the events that I wasn't readily available um building inspector Glenn Hathaway

would go there and inspect it take pictures of what was going on um those were also unfounded a Pelletier I mean he's going to license for how many cars on a lot I believe it's 20. I apologize um I believe including their private cars that they go to work with everything was to be done on that lot they had parking all over this neighborhood the cops don't show up when I close okay they don't

show up I could I sit by the room and wait for them they can't show up all right we really would like to know she do you know it's 10 cars or 20 cars I believe it's 20. it's 20. yeah I believe they have 10 cars that they're able to sell and 10 vehicles that they're able to work on for sale that's why that parking in across the streets so it's just a point of clarification

detective but they don't have a auto repair license they don't but they do have permission to work on their own Vehicles so when they get the used cars from the auction they're able to work on their own Vehicles no other people's Vehicles the executive is speaking if we cannot interrupt out you'll have definitely have a chance to speak or if they have a vehicle that they've sold and they've had issues within the

30 days of selling it per the Lemon Law they are allowed to work on that vehicle to repair it for the person that purchased a vehicle from them so I have a question so um you said they have they are able to work on their own vehicles to me that would mean their own personal vehicles the vehicles that they purchased from the from the auction so what's the difference between being able to do that

and not needing a license and then needing a license to if you were taking into other people's vehicles and repairing them and giving them back right so a person driving by couldn't just stop in and say hey I have an issue with my vehicle would you be able to do work on it but if they purchase a vehicle from the auction obviously that needs some repair they are able to do repair to the

vehicles that they've purchased from the auction um and sell them and if they are sold to someone that they have an issue with the vehicle they are able to do work to that vehicle that they sold to the customer okay you have the floor you know any Auto Sales place you bring a car in they got to fix it up and they're going to fix it up so I think you should have Auto Repair

license you don't have that right not for this but not well I think it's wrong you should have one and uh I'd like to get the bottom of how many cars he's allowed to put there you know I do have an aerial view I'm I'm pretty confident it's funny but I can confirm that and provide a copy of the certificate that says that but I do have an aerial view of the lot

um just so you can I get an idea of how many vehicles done every once in a while that's always really jammed up uh like it is now one you don't have 20 yet I don't know how you can put 20 cars on that lot there's no way one two three four five six seven across the street wow is that the annex I mean I mean the guy giving permission

is that right I don't know if it's right till 10 30 at night Logan cars and unloading cars it's noise up and noise up the noise when Century payment leaves work they move in and there's more noise until 10 10 30 every night now well that's not right that's a moto Club yeah four guys in that parking lot working on unloading cars and then they test drive the cars in

that lot after they fix them up well I I really think he needs Auto Repair license for sure and uh we look into that and we'll look into it and uh I don't know if he can rent spots across the street I guess he can but I don't think he should fix them in that lot as well because you're outside from them on the street they load cars on the street they unload cars

on the street yeah like in front of my house yeah now you live around the corner I live around 31 Beauty Street two houses two houses down this is his house yeah oh that's yeah one minute I mean we should uh get him in here to talk to him I think anyway and let them know how the neighbors feel and let them know that uh I think he needs another license myself I think

they need to move yeah I guess so so how long you been there 45 years 40 years it's the worst 40 years was very nice nice quiet neighborhood the very own yeah then it became Frisco construction yeah which is a father of the owners now same visit but they took off in the morning they came back at night well now it's six quite their District six o'clock every morning

and then it's well dust blooms there's there there is we've been through this before there's a nose ordinance on the books from ten to seven uh nobody's supposed to be cutting grass or starting big trucks or whatever the case may be six o'clock every morning but again what do you do you know we can ask to be nicer but I'm sure if they're gonna if they can leave at six they want to leave at six

if they're going to leave at seven well uh they'd make a big difference to them but again those are rules and regulations that should be following I agree you know they don't follow and then nestled in between two neighborhoods yeah how do they get away with that I did that's beyond me well I think you got a lot of complaints on this you can't even keep your house

yeah that's another thing I I think century should think about what holds the dust down what makes the dust fly well it's the trucks so you know they usually put a little bit of water and it holds down the dust you know well I mean that's one solution yeah yeah okay now you got the trucks coming from Century Paving across the street into that lot and back and forth all day long yeah there's a lot of

problems there but you know we have to put up with it well I mean we can try to help you know try to keep the dust down and everything else try to get them to to start at seven o'clock and that's try to get them to relocate I don't know yeah yeah I understand that but you know you 've been there for a long time you've been there for a long time but they

moved into my neighborhood I didn't move into this neighborhood I've been there out here 40 years before 40 years so when they come in how long ago about five years oh just five years or five years that's when the ownership changed from the father to the side well the father was there for a long time and he was good oh he was good okay all right okay all right I understand

all right well you know if we have to talk to him we'll talk to them bring them in or whatever you got to do uh I mean you got a lot of extent that uh yeah she did all my videos yeah you think I'm lying no no look at his phone yeah everything I sent them well I mean the only thing we can do is uh maybe tail table is tonight and try to

get him here and and talk to him with you here as well no boxing gloves or nothing just sit down and a Gentleman and all that stuff and you know they don't care about the neighborhood yeah well you know right now except that they move okay Only Solution yeah okay are you with that counselor plus do you have any so you spoke to Century Paving but not Allen no so just on the attorney

brilliant called because the the he said the owner had contacted him he had heard through Word of Mouth that there was a letter that they were mentioned in that was on the agenda when I spoke to the clerk she said that the reason that neither business was called was because the council doesn't have any authority over the licenses that they hold so you know so attorney Brilliance

Council Sentry Paving yes okay I did not hear from anyone else all right I'll yields my colleague okay uh Duty need any specific license to operate in that particular area century paintings yeah um so that I don't know I'll be honest with you um I have heard that this isn't the first time that it's been presented um the complaint and regarding that that lot that they were actually I think I

can't confirm this but I was just told that there was some language put in that they would not use that parking lot closest on Beatty Street for anything other than employee parking and then obviously whatever storage that they're storing over there the other lot I think is for their work trucks um to avoid on the other corner right on the other Corner that big pilot Target internet lot right the trucks are going

in there and dumping and then you get the back cool and the front end they'll come in to clean it up it's noise all day long and we shouldn't have to be going through this we pay taxes like everybody else understandable I'm just wondering if you can research it a little bit along with uh the city clip maybe get together and see if they need any special license uh see if they're violating

any of the ordinances because you know it is a neighborhood but like he says started five years ago I knew the older gen liberal and if you didn't have trouble no trouble for 30 years and this kid didn't learn too much off his dad that's for sure they're rude whatever simple yeah so so I I would make a motion to table this and uh have the clip along with the detective find out if he needs any

license to operate that and if there's uh what about popping in the street with their tow trucks how about unloading cards on the street we'll have to look at every issue Linda's got the videos so sorry I know that you said that before um Linda's not on this committee so if you would send those to the clerk she can send them to this committee and and the detectives that's looking into this

she'd probably want to see those as well I have actually seen some of the videos that um Mrs Donato had forwarded me they are in fact a truck with a trailer on the back and they're unloading a single vehicle um off into the lot they'll they do Park on BD Street to remove the vehicle um given that beating Quarry our Quarry is a busy street beauty is less of a busy street and that they really don't

have anywhere else to unload Vehicles so if they weren't utilizing Sentry Paving they probably would have been occupying um a portion of Quarry streets unload their vehicles anyway but they do yes they unload their vehicles that they're purchasing from the auction on the roadway and should they be yes they have a right too as well I like one load of power in the street they do wear um

where else where they would load it sir on their property that they bought you buy a piece the problem is they bought a piece of property that's too small for the business that they want to run that's the front they need a bigger property and not that you're parking all over the neighborhood detective if you would just check and do what licenses each company has absolutely and um that they are for that

address and what they're allowed to do and not allowed to do that would be helpful yes ma'am I'm all set so motion a table made by councilor Pelletier seconded by councilor kozal all those favor hi so voted thank you and um we'll get back to you when when they come back we'll have you all here okay okay
