It's not It's not what you think it is.

Okay. Yeah, it's nice. That's why my daughter lives there. I grew up in Arizona. Four of a licensed board call the meeting ordered uh Tuesday, June 17, 2025. Uh to my right, board members Michael Carreran and Melanie Cado. My name is Attorney Greg Brilliant. Um we'll get started by uh stating that pursuing to the open meeting, person may make an audio or video recording of this public meeting and may transmit the

meeting through any media. Attendees are therefore advised that such to transmission being made whether perceived excuse me whether perceived thank you are unpersceived by those present are deemed acknowledged and permissible.

Wow.

City chart section 9-18 mandates that all multiple member bodies develop and adopt rules a policy for public comment.

We have adopted such a policy which in short provides for citizens input and license board specific matters. At the beginning of the meeting, there was a signup sheet that is located at the back of the room. Item one is public input.

Richard is our COO and our president.

Okay. All right. And what's your affiliation with the with this? I'm the property development manager for the Northeast region of Canes. So, I helped open all the new restaurants up here.

Okay. Um Okay. So, who who's the manager? His name is Gregory. Uh, I don't have his last name off the top of my head, but he is in training and I believe that his information's been passed for. If it hasn't already, we can certainly get that information.

I don't see a Gregory on here. Not. No.

Listen, I know it's obviously a national change, so it's not like I have I think anything's going to be wrong, but you have you have the manager, listen, is this Ferguson.

She's our project uh our property development coordinator. She's the one that filled out the application for us.

She works at our Dallas uh or our Plano office.

Yeah, I don't think she should have filled that out, but then I have been in touch with her and I got the gentleman's name, Andrews, uh, Richard Andrews. I got all his information and he got a clean police report. He's our president uh, and COO, but as far as, and I apologize. Give me just one moment if I can access this.

There's no liquor. No.

Okay. You have your health certificate already, am I correct? Yes, ma'am. Yeah, we actually just got that uh revised to show the appropriate name. Uh there was a mistake on the uh the permit holder name that we just got revised. I'm not thinking there's no liquor. I'm okay with that. All right. Um anybody in favor of this petition?

Anybody to oppose? Questions from the board? What type of food is it? So we serve a focus menu. We only have five menu items. It's chicken fingers, crinkle cut fries, coleslaw, buttered bread, and our cane sauce. That's it.

That's it. So, we know what you're getting when you pull into our drivethru. We just don't know how. Is the inside open. You can go in and sit down as well. We also have an outdoor seating area and we do have a dual drive-thru with the bypass lane as well.

Are you going to have like kids out there like they have at the other place taking the orders and stuff? And we have two people outside every half hour just to make sure that cleanliness and safety is top priority.

Could it could I have your hours operation? Sure. We typically our standard hours of operation are 9:30 a.m. to 3:30 a.m. Uh we do like to remain open for third shifters and first responders.

Well 3:00 a.m. That's that's kind of late for Full River. Yeah, quite honest with you. The Taco Bell right uh a few blocks I think it's even like a block away. They're open until 3 and on Friday and Saturday they're also open until 4.

And there's there's issues there's police issues there. There's kids hanging out. is I don't know if you're going to have the same thing. Yours is the parking lot's much smaller, so you probably won't have the kids hanging there, but they're in the summer like not this type of time of year. Tons of kids in that parking lot. They're spinning tires. They're drinking. Well, I'm saying drinking, but there's there's

problems there some on occasion, you know what I mean? So, just keep in mind that, you know, and we will try to work with the local municipalities if there are any issues, but we do typically like to stay open late just to have the option. We have an option if if there it does get a little hairy over there, you could have a police detail possibly if you have to. If we have to. That's Yeah.

I'm not saying we we're not going to tell you you have to, but if if you make that decision on your own. Understood.

Any other questions? Would that strictly be the drive-thru that's open that late?

No, it so it depends on the volume.

Typically, we would would keep the drive-thru lanes open as late as possible. If interior dining seems to be an issue, if there's, you know, people hanging around too long, um they would make a business decision on whether or not just to keep it, uh fully drive-thru only for 3:30, uh and to shut the interior of the store. But most of the time, both remain open. So, it's 3:30, Greg, or 3.

I thought she said at 3:30 to 3:30. Okay. You said 3. I was just wondering the outside seating and dining till 3:30. That's going to be a little hairy.

For other locations, we've also put up signage that says after a certain period of time, you can only eat on the in the interior of the restaurant, and we would uh shut off the outdoor dining area and just kind of sanction it off with um ropes or, you know, something to I don't know how anybody feels about that, but I'm just hanging their side if you don't mind. So, just so I'm just trying to

help you because we want you, this board wants you to be successful there, too.

So, you take McDonald's down on the avenue, down at the bottom of the avenue. Are you familiar at all? Fall River, like when you get on 195, there's a McDonald's there. And there are issues with homeless people because they have outside um seating as well. There's people homeless people sleeping there at night sometimes. And I mean, that's an issue. So, you might and and and uh um

you might get that involved, too. So, you have to prepare prepare yourself for that. If that does start occurring, you got to come up with a plan to curve it or stop it or whatever. You know what I mean? We we wouldn't want that. We wouldn't want that at No, certainly you wouldn't want that, but you could get it. I'm telling you. Understood. I have no problem with you being open till 3:30

in terms of the drive-thru and maybe even inside and just 3:30 outside over there in the summertime. You just might get people just hanging around.

That's the only thing that we all grew up here in Fall River. We know what's going to happen up there. Understood.

Right. That's I have no If there's an issue with the outdoor seating, we can certainly curve that back. Uh, just as long What what what time would you be comfortable with the outsource seating?

You think the later the better? It is preferred. So, if we're able to keep it open till at least midnight or 11 o'clock, depending on I could do later than that, but Okay. One one say one works for us. Okay. Okay. So, do we want to entertain a motion to to grant the common bicks license for raising canes 9:30 to 9:30 a.m. to 3:30 a.m. for uh drive-thru and interior dining? Um, but

the outside dining will uh stop at 1:00 a.m.

Is this seven days a week? Yes, ma'am.

It's going to be handled through the the bar. Okay. Um, same thing. What's your hours operation? Um, so the dining's going to be from uh 11:00 a.m. uh to uh 10 uh 900 p.m. weekdays, 1000 p.m. uh Friday, Saturday. Uh on Door Dash, we still cannot do um till probably 1:00 a.m. Friday and Saturday. A door dash over for takeout. For takeout only, no diamond on Friday and Saturday. Takeouts to 1:00

a.m. Correct. Only only door. Yeah. Door Dash, take out. We kind of close the door. Like no one could go into the dining area. Just there's like a rule of reception. We'll take their order and they wait. Okay.

I think everything's been approved, right?

It's been approved by the police department. Um any anybody in favor? Anybody opposed?

Questions from the board? Question. Um so is it Portuguese food like it's always been? It's gonna be Italian, Portuguese food. So, the menu is definitely changing. It's changing a lot. Yes. Yeah. Yeah. I don't think traditionally just Portuguese food there, right? No, not really. But, but it's going to be Italian. It is changing the menu. Yeah. We have about four famous Portuguese meal, but the rest of

them is Italian. Okay, great. And so, so St. John's is going to run the bar still, correct? And if someone sits in eats in your establishment, they can order beer. It's going to But how do they get it? Um there's a window between I'm familiar with it. Um so we just ring in our order and they'll put the drink at the window and and your waitress brings it over. Server will server will

bring it over. Correct. And how do they pay? Um so at the end of the day uh we do separate. So at each server um so we have a POS system. It's going to tell us what's the liquor sale is. Yep. So we'll take the liquor sale and give it to them at the end of the shift. So if I went in there and I I ate I'd get two bills. No.

Not in our dining area. Ard our doniger you got one bill because we we cannot get in our pos systems y and we'll kind of show it to you. Yeah. Yeah. And so so the liquor will be on that bill as well.

Correct. On dining area. Correct. All right. So there's one bill. Correct.

Okay.

But we already inform our accounting um how it's going to be. So we we don't pay any taxes on the liquor. They pay the taxes on the liquor. Yeah. Like like a like a like at the liberal like two separate people. Yeah. Every club, you pay cash. Yeah. For for the liquor and soda and stuff, whatever. And then you pay for the food. So, you actually pay two different things. At the bar, you do

that. If you sit if you sit at their bar, they'll show you two separate slips. So, if you're at the bar, you can order us food, obviously. Correct. And then you you're sitting at the bar. So, you're going to pay them for the liquor and soda, whatever. You How about soda?

Same thing. Everything from them.

Everything's from them. Just all drinks.

You're just food. Just food. Correct.

Okay. That's interesting. I was just curious. I don't mind how you're going to do it. I'm just curious. I'm not This isn't about you. I don't think that's right. I don't think you can do that.

So, here I started trouble now. Well, no. No, you didn't start trouble. But I don't think you can do that because when if his if his people are serving the liquor, they're subject to that liquor license and safe serve tips and all those things. We we are we all our servers. So, we own a hookah launch and on Federal Hill. So, all my servers are uh safe tips and certified. So, they

have to go through the training. We pay for the classes. No, I know. But but again, what I'm saying is the liquor license is in St. John's. Correct. I hope this never happens. But if you serve someone that's intoxicated, who's getting sued? It's not your liquor license. We're not our No, they've been doing this for over 20 years with different different rentals. I think we're the third rental. Oh, you might

be. This isn't you, sir. Don't take this personally. I'm not saying you. I was never I'm new to the board in the last year and a half. I don't think that that's legal. Uh we do have insurance.

Uh we're covered for $2 million just in case we get any suit. No, I think it's more on St. John's. St. John's Clubs has the problem. They they're getting the money like like when we talk about the Liberal Club, the Liberal Club has its own waitresses. Yeah. Serving their liquor. The restaurant has nothing to do at all with liquor. Doesn't touch it.

I I don't think St. John's is doing it right. That's what it's not. has nothing to do with it. Okay, fair enough. Yeah, I I I don't Well, Gre Greg could can maybe Carrie can call St. John's and ask them what the story is, you know. I don't have to call them. That's exactly the story. We got to find out whether it's legal or not. No, no, that's what I'm saying. I mean, yeah. Well, first

confirm with them. I have I've been on the phone with them. All right. Because we kind of had to go. We went kind of back and forth. What would you find out?

ABC or corporate? They might need like some sort of agreement, you know. I don't know what that's called. Yeah.

It's just it's not right because they're because they're selling for for St.

John's product. It's it's that's I don't think it's right. It's unusual. But you know, but he's right. They've been doing that forever. You know that. No, I know.

I have I I eat there years ago. I haven't eaten there in a long time. But they've been doing I thought it was just unusual. Yeah, I know. Yeah. It's not you, sir. Yeah. It's part It's part of our agreement. We have to serve their liquor if we mean like Oh, no. No. I'm not saying for you to have a different liquor license. I'm talking about segregating it. Separating it completely. Separating it. I I don't

know if it's if it's if it's legal cuz it's technically not legal to to lease a liquor license. I know that. So, you'd feel more comfortable if it was like the liberal like let let him get two bills.

That's what I thought it would do. I I thought that's what I thought he was going to say. I think don't think it's safe for him. No. Because if something should happen, who's going to get responsible for serving that liquor? You don't got liquor liability insurance. We're a restaurant. It's not going to No one's going to get drunk there. It's going to they're going to eat. Somebody comes in drunks.

So, I'm not I'm not telling you that's ever anybody wants that to happen. But years ago, I'm probably Mike might be the Bowling Green.

They had a damn softball banquet. Okay.

Homeless thing. Someone left there, killed someone on the way to the the beach, lost everything. Both they they lost the whole They didn't have liquor liability insurance. Everything gone.

Real estate, everything. Yeah. I'm just trying to see who's going to protect it here because you're you're mixing two businesses. You're collecting the money for them. You're giving them the money tax-wise, the whole nine yards. I just think that they should be responsible for their own liquor. Period. They should be serving it. They should have their own waiters and waitresses. That

should be done. I'm not trying to burst your bubble. I don't I'll look into it tomorrow. Yeah, for sure. Yeah. I don't want to hold them up, though. I mean, they can still be approved. Just at this point, no alcohol till we get a Well, we're not serving alcohol. Yeah. Yeah.

Somebody is. I could I could send them to the bar, get their Can they go get their drink and come to my dining area?

Yeah. But people aren't going to want to do that either. Think about if you're with your family. You're not going to want to get up and walk into a barber.

I'm just trying to make it so your business is okay. People aren't going to want to do Yeah, I understand. I think you should get two checks. I could do that. I could do that, too. You know what I mean? But when when do you plan on opening? This Sunday, we already we already we already went to Restaurant Depot. We spent $6,000 on groceries. So, I don't want them to go.

But I thought No, no, no. I thought we were all set.

No, I think you are all set. I'm just very I I don't I don't like the way that operation is taking place. I like the way it's done over at the Liberal Club.

Greg, can we approve the whole thing the way he's doing it now and then uh come back and say and figure after Carrie does her investigation and and find out, look, you can't do it like that anymore.

You got to you got to, you know, we're not going to stop you from opening Sunday. I'm not trying to do that. I'm not trying to do that at all. Thank you.

with his with these people's restaurant that that's I'd like some clarification if that can be done that we'll call the ABCC tomorrow and what information we get we'll kind see what makes the most give me a call and we'll let you know.

Uh three old business canteen 52 F Street. Christopher Martin modify approval from May 21st, 2025 meeting.

His letter reads, "We are current we currently have a one-day permit for 717 to pour samples and sell four packs of beer at the Viva For event. We are looking to move this to a setup where we can pour beers to serve and consume on site."

No one asked us for the state to offer a more traditional beer garden setup that we do for other events throughout the year with Viva, Fall River, and Standard Company.

That's what we had an issue with last time. Well, that's just that small area, right? He's just asking for one time.

Yeah, I guess they requested it.

He's not here. I The thing is is that Did they have police detail for this?

Purchase and take with them. They weren't going to be any consumption, right? Yeah. Yeah.

I just have a question. I don't It's not without him being here and he's fully explaining where people are going to go.

That's only a small place. If they're drinking a beer, where are they going?

for St. John and I asked her about the insurance. So, that their insurance it covers the whole building. I guess they have a hole in the back like for weddings. Um so, she said anything happened in this entire building, it's covered. So even though I have my own insurance, she said your showroom is covered through my insurance as well.

It's not true. I'm an attorney. If you're responsible for serving that liquor, they're going after you. And I told And I was like, we may have to show them separate B. That's fine with me. I was like, if we have if they have to go get their liquor from the bar, I mean, it's my Well, she's going to check with the ABCC what has to be done. ABC.

What's ABC? Alcohol Beverage Control Commission. Okay. I just wanna I just want to let you know what Well, I'm sure she I'm sure they do have insurance, but my that's not my issue about the insured premises. My issue is that you're technically serving the alcohol. They're not.

So, if you So, if you serve an intoxic your waitress or waiter or your server serves an intoxicated person and they leave, 100% you're going to be on the hook. That's what he's trying to say.

You're not forget about St. John's.

You're going to be on the hook. I'm an attorney. I'd sue you. Just tell me was it the right way to do it? I don't we don't know young man. We're trying to We're calling the ABC. They may say it is okay the way they're doing it. As long as we get clearance that that's the way it's okay. Then we're I just I want to cover myself too. I don't want

someone to come after my like my stuff.

So I want to make sure I'm doing it right. So I just want to make sure you just got to give me a little bit of time. I know I know you're worked up and nervous about this. But I'm going to do my best tomorrow morning. I'll call them straight in the morning and I'll give you a call. Okay. We'll make it work one way or another. It just might not be the

Yeah, I was there today. Well, not there. And what drove by is looks so looks nice, but it's only little. Where are we talking about exactly? I didn't mean it.

Where's it going to be held? Isn't it the back where that mural it's I think that's where 10 purchase Street is right that little little area. That little It's very little car. I mean, it's not as big as this room. If you're at the steakhouse, you turn around, you look you look west, it's right there. It used to be a bank. It's really really nice, but it's it's it's not as big as this

room. It really is. It's not as big as this room. I don't think it's squares.

It looks like turf. I don't think it's grass that's coming through. And it's a very small area.

And it was going to be inside. The inside's even small. I never been in it.

Is that anybody ever been inside the building? So small.

That's why when he first came here, I said, "Where are you going to serve this alcohol?" Because you got you got Donovan's parking lot across the street.

You got that little outside dining for what is that? Blossoms. Time blossom. I mean, is he going to go over there?

So, but I again you can tell Mr.

Martin's car that I we'll schedule something specifically for him if if that one day is not enough. You got it.
