In
Out
4:07
Mr. Chairman, I move that we delay or postpone the items 01 and 02 and that we convene an executive session.
In

4:25

4:49
I move that we return to regular session.
In

In

4:53

We have a motion.
In

4:55
Do we have a second?
In

In

5:00

In

5:00

5:05

In

5:06
Okay, back to old business.
In
Out
5:10
Item number 01, the applicant owner is— Excuse me, before you move on to old business, can I just ask one question on your previous business?
In
Out
5:18
On which previous business?
In
Out
5:20
The session that you just went in.
In
Out
5:22
No, we cannot discuss it.
In
Out
5:25
At the end of the meeting, if you want to speak during public input, you can.
In
Out
5:28
You can give input, but it's not going to be a discussion.
In
Out
5:31
We cannot get into a discussion about it.
In
Out
5:35
Okay.
In
Out
5:35
Alrighty.
In
Out
5:36
Thank you.
In
Out
5:38
Item number 01.
In
Out
5:41
Applicant owner is Luis Gonzalez.
In
Out
5:44
This is care of Jeffrey Tallman, Northeast Engineers and Consultants, Inc. Subject property, 333 Durfee Street.
In
Out
5:50
Map 08— I'm sorry, 011.
In
Out
5:54
Lot 0013, the original— the applicant is requesting a variance to allow the following: 1, to convert an existing automotive repair shop into 3-family dwelling, thereby expanding the existing nonconforming 5-family dwelling to a total of 8 dwelling units.
In
Out
6:14
The applicant is requesting a special permit to allow the following: 1, relief to reduce the number required parking spaces pursuant to Section 86-444 of the zoning ordinances.
In
Out
6:25
The property is located in a BN neighborhood shopping zoning district.
In
Out
6:30
This was tabled from our June 16th or June 18th meeting.
In
Out
6:37
Mr. Tallman.
In
Out
6:38
Good evening.
In
Out
6:39
For the record, Jeff Tallman, Northeast Engineers and Consultants.
In
Out
6:42
I did submit a request today to have that tabled.
In
Out
6:46
Until the August meeting.
In
Out
6:48
Because when we started looking at making revisions to the plan to address the board's concerns, one of the, one of the issues and items we looked at is possibly using the lower level of that building for parking, which makes a ton of sense, considering it's an existing garage now, which would in turn mean that we would have to go higher with the structure, which means we have to ask for an expansion of a preexisting nonconforming structure, which would require additional— well, it would require that the petition be readvertised.
In
Out
7:22
So that's why I submitted the request today.
In
Out
7:26
So with that, I, you know, hope the board sees fit to grant continuation on that one.
In
Out
7:32
Okay, before we act on that, one question to the planning director.
In
Out
7:37
Would this require— it will have to be readvertised?
In
Out
7:41
Yes.
In
Out
7:41
It does not have to be a new application?
In
Out
7:43
They don't have to withdraw and resubmit?
In
Out
7:45
No, it will be— we will renotify.
In
Out
7:48
Okay.
In
Out
7:49
And we will readvertise.
In
Out
7:51
Okay.
In
Out
7:52
All right.
In
Out
7:53
That being the case, I'll accept a motion on the request.
In
Out
7:58
Mr. Chairman, I move that we grant the request to— continue our table hearing until our August meeting.
In
Out
8:09
Second.
In
Out
8:13
All right, motion and second.
In
Out
8:15
On the motion, Eric?
In
Out
8:16
Yes.
In
Out
8:17
Ricky?
In
Out
8:17
Yes.
In
Out
8:18
Dan?
In
Out
8:18
Yes.
In
Out
8:18
Jim?
In
Out
8:19
Yes.
In
Out
8:20
Jim Prairie?
In
Out
8:22
Yes.
In
Out
8:22
On to item number— I'm sorry, what is the date of that August meeting?
In
Out
8:26
20th.
In
Out
8:27
20th.
In
Out
8:28
August 20th.
In
Out
8:33
Okay.
In
Out
8:34
Item number 02, old business.
In
Out
8:39
Applicant owner is June Perry, care of Jeffrey Tallman, Northeast Engineers and Consultants, Inc. Subject property is 311 Crescent Street, Map T-07, Lot 0001.
In
Out
8:54
The applicant is requesting a variance to allow the following: one, to divide the property into 2 lots, leaving the existing 3-family dwelling on Lot 1, a conforming 11,700-square-foot lot with 116.45 feet of frontage on Crescent Street, and creating a new 5,480-square-foot nonconforming lot for a single-family dwelling.
In
Out
9:19
House with 50 feet of frontage on Valentine Street with relief from frontage use and area requirements.
In
Out
9:27
Property is located in the BN neighborhood shopping zoning district.
In
Out
9:31
This was tabled at our June meeting.
In
Out
9:35
Mr. Tallman.
In
Out
9:36
Good evening.
In
Out
9:37
For the record, Jeff Tallman, Northeast Engineers and Consultants.
In
Out
9:40
So in this particular application, we were kind of asked to go back and take a look to see if we because we were making the case that the lot itself being adjacent to the G District and with a small portion at the rear being in the G District, we were hoping to use the sidestep X for G. During the conversation, it was brought up, well, to see if we could comply with all the requirements, which included lot coverage within the G District, because there is no lot coverage requirement in the neighborhood shopping district.
In
Out
10:11
We did take a look at that.
In
Out
10:12
We did change the configuration of the house.
In
Out
10:15
This configuration actually is probably very close to, if this ultimately gets approved, what will be built there, if not exactly what would be built.
In
Out
10:24
There would be a 1-stall garage, same general footprint, only with the addition of the garage.
In
Out
10:31
The only issue, a couple of issues that we ran into when we looked at this, the In terms of the lot coverage requirement of meeting the 25%, just because of the nature of the existing structures and the retaining wall on Lot 1, there is kind of that pinch point between like Valentine Street and where the house would be located, which causes this house to be pushed back a little bit further.
In
Out
10:55
So therefore, the driveway is probably a little bit longer than what we would like.
In
Out
11:00
So if we were to have to comply to the 25%, we certainly could.
In
Out
11:05
We could put an asphalt driveway for a certain portion until you get back close to the garage.
In
Out
11:10
And then what I'm showing on this particular plan is a paver walkway that transitions into the remainder of the driveway that enters the garage.
In
Out
11:19
So with that type of configuration, we would be able to keep the lot coverage to where it needs to be at the 25%.
In
Out
11:27
So if need be, this is something that we could do.
In
Out
11:30
If the board sees fit, and is willing to give us— we didn't ask for it only because it's not required in this particular zone.
In
Out
11:38
If we could bump that lot coverage up a little bit, we could continue the asphalt all the way to the garage, and eliminate the need for having that paver driveway, that small portion.
In
Out
11:50
I'm thinking if we were allowed to go up to somewhere around 28%, in that range that would cover that additional area.
In
Out
12:00
But, if need be, if we have to meet the 25%, this plan does accomplish that.
In
Out
12:06
The other issue that was discussed at the previous meeting was the existing retaining wall, the stone retaining wall, which we're kind of holding the lot line adjacent to that.
In
Out
12:16
We were asked to take a look to see if we could move that line to the bottom of the wall.
In
Out
12:22
But, as I started getting into that, what became apparent is the retaining wall was constructed originally to level off the parking area for 311 Crescent Street.
In
Out
12:35
So, it's basically, it cuts into the slope that comes down on Valentine Street.
In
Out
12:39
And, we do have these 2 wing walls that do project down onto Lot 1.
In
Out
12:45
So, if we were to actually move that lot line to the bottom of that wall, that wall would then be in, you know, 2 different ownerships.
In
Out
12:56
Yeah, you would have the owner on Lot 1 would own the wing walls, and then the owner of Lot 2 would own the primary section, which to me would just make issues a little complicated.
In
Out
13:07
The wall is there to service Lot 1.
In
Out
13:10
It's basically for the purpose of Lot 1.
In
Out
13:12
So the more I looked at it, the more it made sense to me to keep it on Lot 1 and have it be their responsibility to maintain it.
In
Out
13:19
It is in good shape.
In
Out
13:20
It's in very good shape.
In
Out
13:23
It was well constructed when it was built.
In
Out
13:26
I don't anticipate there being, with the construction on Lot 2, any particular issues.
In
Out
13:31
I mean, we are proposing to eliminate the stairs that do go up onto Lot 2, and to close off that wall, that little opening that's there to go up those stairs, repurpose some of that stone for the wing walls on the stairs to close that off, and just call it a day and leave that wall on Lot 1.
In
Out
13:51
Again, it made a ton of sense to me, but, you know, that's your call.
In
Out
13:55
So with that, I'd be happy to answer any questions.
In
Out
13:58
I think that's sound reasoning.
In
Out
14:00
I appreciate the change.
In
Out
14:02
Mr. Chairman, this design— yes, a question.
In
Out
14:05
On the suggestion of potentially changing the lot coverage and adding that, it's not a listed variance.
In
Out
14:15
So it doesn't need to be.
In
Out
14:17
It doesn't have to be listed.
In
Out
14:18
No, what happened, what Jeff was explaining is the underlying zoning district has no lot coverage.
In
Out
14:23
At the last meeting, we asked him to try to conform to the adjacent G district, which would have a lot of coverage.
In
Out
14:29
So relief is not required for lot coverage either way.
In
Out
14:33
It's just whether or not you want to approve the relief to be a G and not be all of the G, which I have no opposition to.
In
Out
14:45
Questions?
In
Out
14:46
Any other questions from the board?
In
Out
14:52
I think this was very sound.
In
Out
14:54
If there are no questions from the board, let me It's still wild that this is a BN district.
In
Out
14:59
I mean, it just cracks me up.
In
Out
15:01
It's virtually entirely residential.
In
Out
15:03
That's all right.
In
Out
15:06
Going to those in attendance tonight, is there anyone wishing to speak in support of this petition?
In
Out
15:16
Anyone wishing to speak in opposition?
In
Out
15:19
Hearing none, comes back to the board.
In
Out
15:22
Mr. Chairman, I would move that the variance be granted as proposed.
In
Out
15:31
Second.
In
Out
15:33
Motion and second.
In
Out
15:34
I'm just trying to remember.
In
Out
15:35
The only thing I would ask for a little bit of clarification would be on the whole lot coverage issue, if you don't mind a slight increase.
In
Out
15:41
So whatever you have shown on the plan is what, what they'll approve.
In
Out
15:45
I don't have the plan in front of me.
In
Out
15:46
Okay, so it's the 25.
In
Out
15:48
You show the increase.
In
Out
15:49
No, no, I was showing it complying.
In
Out
15:51
Well, you don't have to comply, right?
In
Out
15:54
So no, but I was asked if we could fully comply to the G district, including a lot of coverage.
In
Out
15:58
So it was a request.
In
Out
15:59
It wasn't a mandate?
In
Out
16:01
No, no, it was just to see if we could comply with everything.
In
Out
16:04
Would you do it?
In
Out
16:05
We can, and that's what I'm showing.
In
Out
16:07
And but there's like a 10 by 10 section of that driveway.
In
Out
16:10
Yeah, I don't think it's crazy to change materials at the last minute, right?
In
Out
16:14
Yeah.
In
Out
16:15
You gave it your best shot.
In
Out
16:16
It's not practical.
In
Out
16:17
It could be— yeah, we could slide the house forward and make it work.
In
Out
16:21
We would.
In
Out
16:22
But there are like, you know, setback issues.
In
Out
16:25
You definitely— you do have the pinch point because of the angle of the wall coming across that property and changing.
In
Out
16:30
So we can get it to say 28% as opposed to 25%.
In
Out
16:37
The sense of variance isn't required.
In
Out
16:39
I don't think that's going to— is that going to be an issue when the When the plan hits Hathaway?
In
Out
16:45
No, he wanted to see it.
In
Out
16:50
Okay.
In
Out
16:51
All right.
In
Out
16:52
So we do have a motion and a second.
In
Out
16:54
So this would not be as drawn.
In
Out
16:57
So the point is, they gave it a shot, what they could do to comply to the lot coverage of the adjacent G zone.
In
Out
17:07
Could achieve.
In
Out
17:10
That's probably— I would just include in your motion that the driveway shown can be entirely impervious.
In
Out
17:15
There you go.
In
Out
17:16
As stated.
In
Out
17:17
Okay.
In
Out
17:18
Okay.
In
Out
17:18
You agree with that on the second?
In
Out
17:20
Yes.
In
Out
17:20
Yes.
In
Out
17:21
All right, then on the motion, Eric?
In
Out
17:23
Yes.
In
Out
17:25
Ricky?
In
Out
17:25
Yes.
In
Out
17:25
Dan?
In
Out
17:26
Yes.
In
Out
17:27
Jim?
In
Out
17:27
Yes.
In
Out
17:27
Jim and Prairie?
In
Out
17:28
Yes.
In
Out
17:29
Great one.
In
Out
17:30
Thank you.
In
Out
17:32
To new business.
In
Out
17:36
Item number 2 of new business is applicant owner is Stephen T. Gomes Living Trust, care of attorney Mark Levin.
In
Out
17:47
Subject property 70 and 80 Warburton Street, map P021, lot 0028.
In
Out
17:57
The applicant is seeking a special permit to allow the following: 1, pursuant to 86-423B of the Fall River Zoning Ordinance, to subdivide the property into 2 separate lots, each containing 1 existing 3-family dwelling.
In
Out
18:14
The property is located within an S single-family zoning district.
In
Out
18:17
Council.
In
Out
18:18
Mr. Chairman, member of the board, you pronounced it the way I did the first time I heard it.
In
Out
18:23
Attorney Mark L. Levin.
In
Out
18:25
138 Rock Street, Fort Massachusetts.
In
Out
18:28
I'm here representing the petitioner of the Stephen T. Gomes Living Trust.
In
Out
18:34
I will be asking you tonight to do a 2-vote bifurcation with a special permit, one being the fact that I will profess that this is not more substantially detrimental to the neighborhood as it would be had stayed on 2 buildings on one lot.
In
Out
18:53
The second, to allow lease separation based on the Section 86-423.
In
Out
19:01
The property itself contains 2 3-family dwellings on the property.
In
Out
19:07
There's a good-sized lot for each size of the buildings.
In
Out
19:11
They both have frontage.
In
Out
19:13
The advantage to this is bringing more affordability to possible owners, that you could have a residential owner own a 3-family, be able to finance it, than other people that would be able to not afford to have 2 buildings and financing 6 families.
In
Out
19:32
The other advantage by subdividing it gives the city the tax basis that will be increased by separating them so it's not just on one lot.
In
Out
19:41
It's more more in conformity to the neighborhood, that they— that most of the lots have separate houses on them itself.
In
Out
19:49
And, that's about it.
In
Out
19:50
Thank you.
In
Out
19:53
What is the current parking situation, and what's the parking situation going to end up being?
In
Out
19:57
I am told there's only parking on parcel 2 now, and there hasn't been anything in the back.
In
Out
20:04
Because it's been one owner.
In
Out
20:06
They just share the front parking area.
In
Out
20:09
They haven't told me how they want to describe it.
In
Out
20:12
They told me they were only going to do an easement for the utilities because they run through the lots, even though they're separate, they run through the lots.
In
Out
20:21
But they haven't told me if they're going to accommodate any other parking for Parcel 1.
In
Out
20:27
Parcel 2 will have its existing parking.
In
Out
20:30
And the only easement that— there'll be the utility easement, And then an access, which is pedestrian only.
In
Out
20:37
Yeah, there's, there's a walkway right now, and they want to allow the back house to still continue to use the same location.
In
Out
20:51
So where is this parking currently?
In
Out
20:55
On parcel 2, I'm told.
In
Out
20:57
It's just in the frontage.
In
Out
21:00
Yeah.
In
Out
21:00
Okay.
In
Out
21:03
They draw it in, unfortunately, but I was told that they just park.
In
Out
21:09
All right.
In
Out
21:12
Comment from planning?
In
Out
21:14
I would recommend no additional ADUs.
In
Out
21:17
Absolutely.
In
Out
21:18
As we normally do, separation of utilities affidavit filed and recorded.
In
Out
21:23
And if you remember, as Paul Paul Furlan has requested that that separation and the affidavit get recorded before the submission of an ANR, so that it can be referenced as being complete on the ANR plan.
In
Out
21:36
Site plan review for the separation of utilities itself.
In
Out
21:40
Staking of lot corners for the new interior line.
In
Out
21:43
I don't think there's an issue with fencing.
In
Out
21:45
They're far enough off of the buildings.
In
Out
21:48
That would be all that I would have.
In
Out
21:53
Questions from the board?
In
Out
21:54
Thank you, Dan.
In
Out
21:57
No questions?
In
Out
22:01
To the general public, anyone wishing to speak in favor of this petition?
In
Out
22:07
Anyone wishing to oppose this petition?
In
Out
22:11
Hearing none, it comes to the board.
In
Out
22:18
And this would be a bifurcated vote.
In
Out
22:22
We can take them both at once, though.
In
Out
22:24
We can, yes, absolutely.
In
Out
22:26
So, Mr. Chairman, I would make a motion that number one, this proposal is not substantially more detrimental to the neighborhood, and number two, the special permit be granted with the provisions on no parking ADUs.
In
Out
22:44
And, go ahead, Dan, what else?
In
Out
22:46
No ADUs, separation of utilities, affidavit filed at the Registry of Deeds stating such to be recorded and referenced on the ANR plan.
In
Out
22:56
So, the ANR plan cannot be submitted until the separation is done and the affidavit filed.
In
Out
23:01
Staking of lot corners with permanent monuments for the new line and site plan review.
In
Out
23:08
To deal with the separation of utilities.
In
Out
23:10
And that's acceptable to anyone?
In
Out
23:12
Yes, it is.
In
Out
23:15
The fencing shouldn't be a problem with fencing if they wanted to do it.
In
Out
23:20
All right, so that would be my motion then.
In
Out
23:22
Okay, very good.
In
Out
23:23
Do we have a second?
In
Out
23:24
Motion and second.
In
Out
23:25
Discussion on the motion?
In
Out
23:28
Hearing none on the motion.
In
Out
23:29
Jim?
In
Out
23:29
Yes.
In
Out
23:30
Dan?
In
Out
23:30
Yes.
In
Out
23:31
Ricky?
In
Out
23:31
Yes.
In
Out
23:32
Eric?
In
Out
23:32
Yes.
In
Out
23:33
Jeremy Pereira?
In
Out
23:34
Yes.
In
Out
23:34
Thank you very much.
In
Out
23:35
Have a great dinner.
In
Out
23:37
Yes, thank you.
In
Out
23:37
And have a great rest of the summer.
In
Out
23:40
I won't be back in August.
In
Out
23:42
Don't threaten me.
In
Out
23:43
September.
In
Out
23:44
See you in September.
In
Out
23:48
Let's see, where are we?
In
Out
23:49
Item number 3.
In
Out
23:53
Owner applicant is 422 County Street LLC.
In
Out
23:57
This is care of Jeffrey Tallman, Northeast Engineers and Consultants, Inc. Subject property, 422 County Street, Lot L-06— I'm sorry, Map L-06, Lot 0098.
In
Out
24:10
The applicant is seeking a special permit to allow the following.
In
Out
24:14
First, pursuant to Section 86-445 of the Fall River Zoning Ordinance, to waive the requirement for one off-street parking space in connection with the proposed accessory dwelling unit, ADU.
In
Out
24:28
The petitioner proposes to convert a former storefront located at grade level on the subject property into an ADU.
In
Out
24:37
The subject property is located within a G General Residence zoning district.
In
Out
24:43
Jeff.
In
Out
24:44
Good evening.
In
Out
24:44
For the record, Jeff Fahlman from Northeast Engineers and Consultants here tonight on behalf of 422 County Street, LLC.
In
Out
24:51
Uh, the petitioner, uh, for this application.
In
Out
24:55
So quite simply, what we're looking to do is, um, and I do have, uh, I'm not sure if they included this in the issue packet, but just so you can see what's going on here, there is an existing old storefront that does not look like it has been used for quite some time.
In
Out
25:13
But I do, um, remember there being there when I was— yeah, do you want one of these?
In
Out
25:20
Uh, when I was a kid, I don't know if it was a convenience store or Buzzy's Barbershop.
In
Out
25:24
Yeah, is that what— oh, it was Buzzy's.
In
Out
25:26
That's okay, I knew there was something there.
In
Out
25:28
All right, so, um, you have this old, uh, storefront associated with this building.
In
Out
25:35
Um, now this building, um, was part of a, uh, a subdivision, um, that was done in 2020.
In
Out
25:45
It was all, I mean, you look at the shape of the lot, you had this particular dwelling, you had 430 County Street, 438, and then 436.
In
Out
25:54
And they were all part of one big lot, and they were all separated out at that time.
In
Out
25:59
When they did that particular division of land, you can see where the existing staircase is coming up to the concrete walkway on this property.
In
Out
26:08
There's no vehicular access whatsoever to this property.
In
Out
26:13
I mean, there would technically be room, if, you know, on this property to get a parking spot in if need be.
In
Out
26:19
But, just with the grades and the walkway and the stairs and everything, we just don't have that ability with the way things are constructed now.
In
Out
26:29
So, the petitioner's been, you know, since buying the property, they've been trying to figure out what to do with this area in the lower level.
In
Out
26:40
So then when the ADU regulations came into effect, they thought it might be a good use of it.
In
Out
26:47
So what we're here tonight is basically to, to ask that the requirement that, you know, one parking spot be required be waived in order to convert that, the old barbershop into an accessory dwelling unit.
In
Out
27:05
And that would be a first, because every one of the ADUs that we've needed to approve, we've made sure they have the parking space.
In
Out
27:13
So we do have an unusual piece of land here.
In
Out
27:15
I agree.
In
Out
27:17
Do I think a residential unit is probably a really good use for, for Buzzy's?
In
Out
27:24
I do.
In
Out
27:28
I just get— I get real queasy with precedent sometimes.
In
Out
27:39
What says planning upon this?
In
Out
27:41
I mean, our past practice has been when there's no parking on the lot even existing.
In
Out
27:46
So, for the 6-family, currently, there is no parking, which would normally require 12 parking spaces.
In
Out
27:52
Spaces.
In
Out
27:53
If there was some off-street parking to even already be providing it for the 6, then you could potentially contemplate it.
In
Out
28:01
But on petitions where there's absolutely zero off-street parking even to accommodate the current use, we have not waived the need for the additional singular parking space.
In
Out
28:12
So now we would have 7 units with zero parking, technically needing 13 parking spaces.
In
Out
28:21
Yeah, 13, because it's in a pretty tight area.
In
Out
28:25
And where this was, I mean, there's no hardship to this building where it sits and how it doesn't provide parking.
In
Out
28:31
It received a variance to sit on its own lot.
In
Out
28:34
So it's created the fact that this lot is this small around this building with no parking, self-imposed.
In
Out
28:44
That's all.
In
Out
28:45
Questions from the board?
In
Out
28:46
Comments from the board?
In
Out
28:51
From an engineering perspective, is it possible to grade and remove those stairs?
In
Out
28:57
It's expensive.
In
Out
28:57
It'd be crazy expensive.
In
Out
28:59
I mean, it's retaining walls.
In
Out
29:00
I mean, other applicants have done it.
In
Out
29:02
Yeah, we actually— we had just— I mean, if there's a potential solution.
In
Out
29:07
So it is possible to provide one space, but we're talking retaining walls, grading.
In
Out
29:16
It would be a substantial investment to provide one garden space.
In
Out
29:19
One of my engineers once said, you can build anything, you just might not like the price.
In
Out
29:27
So, questions?
In
Out
29:28
It would just seem to me, Mr. Chairman, that rather than leave it vacant, parking aside, it's a good use.
In
Out
29:37
Anyone else on the board?
In
Out
29:43
In the audience, anyone wishing to speak in favor of the petition?
In
Out
29:49
Anyone opposed to the petition?
In
Out
29:52
Hearing none, it comes down to us.
In
Out
29:55
The only other thing I would like to add too, directly across the street there is an access, a vehicular access into Lafayette Park, which is gated off.
In
Out
30:02
What it does provide— the residents in the area do use it for parking— and there's the ability to provide 10 parking spots in that area maximum.
In
Out
30:14
And there is parking in front of this particular building as well, which obviously is probably being used by the residents and stuff like that.
In
Out
30:22
So how many of the buildings that were in the 7-lot subdivision in 04 have off-street parking?
In
Out
30:28
Using Lafayette Park?
In
Out
30:30
No, there's a driveway.
In
Out
30:31
There's actually a driveway that goes up the middle here.
In
Out
30:35
And there is parking that goes to the rear of Lot 130.
In
Out
30:40
And I believe there's some parking in front of— I'm sure I have 2 130s.
In
Out
30:46
But on 430, house number 430, I believe has parking in back and 430 8 also has some parking.
In
Out
30:55
So they are not without parking, right?
In
Out
30:58
Just not the same property.
In
Out
31:05
Yeah, that driveway's okay.
In
Out
31:14
Hearing nothing from general public.
In
Out
31:16
No more questions.
In
Out
31:18
What is our— what's our motion going to be?
In
Out
31:35
Again, Mr. Chairman, special permit bifurcated?
In
Out
31:40
Correct?
In
Out
31:40
Yeah.
In
Out
31:41
Yes.
In
Out
31:42
One thing I'll offer that Jeff didn't offer.
In
Out
31:44
Although this has not been a commercial use that's been in existence probably for 2 years, there could be an argument made that the offset of the commercial use space, although maybe a different time period, may offset the fact that we are now adding a residential use.
In
Out
32:04
But the numbers— and you may have wanted to maybe read reactivate the commercial use.
In
Out
32:10
But then even at that point, we're going to— you would still— we still have the discussion at that point for employees.
In
Out
32:18
So we'll still be looking at parking.
In
Out
32:19
Got it.
In
Out
32:20
I'll be quiet.
In
Out
32:22
But that is a very good point that given the commercial— great job.
In
Out
32:26
We end up trying the same place, the nature of a barbershop, people coming in and out.
In
Out
32:31
Yep.
In
Out
32:31
Size of the place, you could easily be 2 chairs.
In
Out
32:35
Customers to employees.
In
Out
32:38
You have any idea when the last time it was open?
In
Out
32:39
It's been a while.
In
Out
32:42
It's been a while.
In
Out
32:44
Eric, you know where it is?
In
Out
32:45
I was a kid when I was about— I've actually been there.
In
Out
32:48
Now that you say it was Buzzy's, I've been to Buzzy's.
In
Out
32:54
So, so it would be bifurcated.
In
Out
32:57
Yeah.
In
Out
32:58
So you can make it as one.
In
Out
33:00
So then I would propose that this is not substantially more detrimental to the neighborhood and that it be approved as requested.
In
Out
33:12
Second.
In
Out
33:14
Motion and second.
In
Out
33:15
On the motion then, Eric?
In
Out
33:17
Yes.
In
Out
33:18
Ricky?
In
Out
33:18
Yes.
In
Out
33:19
Dan?
In
Out
33:22
Yes.
In
Out
33:24
Jim?
In
Out
33:25
Yes.
In
Out
33:27
You're going to get it anyway, but I'm voting no.
In
Out
33:30
So thank you very much.
In
Out
33:32
Okay, thank you.
In
Out
33:36
Item number 4, applicant is Dr. Stephanie DNP LLC, DBA Biomed Spa.
In
Out
33:48
Sounds like something out of a movie.
In
Out
33:52
Pardon, come on up.
In
Out
33:54
Owner is Lykos Properties, LLC.
In
Out
33:58
Subject property is 400 Rhode Island Avenue, Lot E-08— sorry, again, Map E-08, Lot 0048.
In
Out
34:08
The applicant is requesting a special permit to allow the following.
In
Out
34:11
One, pursuant to Section 86-422 of the Fall River Zoning Ordinance, to allow tattoo services, specifically cosmetic tattooing and permanent makeup, as an accessory use within an existing medical spa.
In
Out
34:25
2, relief to reduce the number of required parking spaces pursuant to Section 86-444 of the zoning ordinance.
In
Out
34:35
The property is located in the BL local zoning business district.
In
Out
34:40
Please identify yourself.
In
Out
34:41
I'm Stephanie DeMello.
In
Out
34:42
Okay, so I own a medical spa and we are requesting to be able to add microblading services to our medical spa.
In
Out
34:55
It is technically regulated under tattooing.
In
Out
35:00
However, from a business standpoint, it is a very different procedure from tattooing.
In
Out
35:07
It is to make your eyebrows look better.
In
Out
35:14
It's something that we do by appointment only in a private treatment room, and it's not going to change how we operate our business as it stands today.
In
Out
35:25
And as far as parking, we are 400 Rhode Island Avenue, but we are located within 390 Rhode Island Avenue, which is all owned by Lykos Properties, and they have stated multiple times that no one tenant within the entire property has any assigned parking spaces, and they can all be used freely amongst everyone.
In
Out
35:52
And they have said that our clientele is allowed to use the entire parking lot, um, and I think that's kind of the gist of it.
In
Out
36:02
So you're on— your property is a separate lot?
In
Out
36:07
Yes, you have to go within.
In
Out
36:09
You have to go in through there, through theirs to get to ours.
In
Out
36:11
It's technically a separate lot.
In
Out
36:14
Yeah.
In
Out
36:14
So were they to sell this off in the future, or were they to sell the back and not, not sell this, there would have to be an easement to get to this because it'd be a separate owner?
In
Out
36:26
Correct.
In
Out
36:26
Okay.
In
Out
36:28
Okay.
In
Out
36:28
On the lot in question, how many parking spaces are there?
In
Out
36:34
I don't know the number of parking spaces in total for the 390.
In
Out
36:38
Not for the 390.
In
Out
36:39
Just, just talking about 411.
In
Out
36:41
Okay.
In
Out
36:42
And what's your required parking?
In
Out
36:44
20?
In
Out
36:47
I think it's in the top left corner.
In
Out
36:52
24, based on the calculation that Jeff provided.
In
Out
36:59
But that's based on 4 separate units, 3 employees per unit assumed, and then 1 space per employee plus 3 per customer.
In
Out
37:13
Our computer's flipping out.
In
Out
37:14
Yeah.
In
Out
37:15
I don't know.
In
Out
37:16
It's been doing it.
In
Out
37:17
One behind you is not.
In
Out
37:18
So I don't think it's this cable.
In
Out
37:20
It's like a lighted billboard.
In
Out
37:22
Oh, did I just say that?
In
Out
37:26
Can you just— yes, let's slide that up.
In
Out
37:28
So all these parking spaces that are shown around, not over here, but on 400.
In
Out
37:35
Yeah, it goes across and down.
In
Out
37:37
Yeah.
In
Out
37:40
And it extends all the way to Rhode Island Avenue and then down to Tucker Street.
In
Out
37:44
So, the only ones that you're considering as yours on this property, let's make believe you're not Lykos, that you own the building under ABC, whatever.
In
Out
37:54
You've got these, these, which actually slop over the property line, and that's it, correct?
In
Out
38:00
Yeah.
In
Out
38:00
And, even these are in question if the property is sold, because it's right on the lot line.
In
Out
38:08
So, it's kind of an oddball situation.
In
Out
38:10
Listen, this is typical of this type of plaza, etc., but usually it's all one ownership.
In
Out
38:19
Well, it still is one ownership, just now.
In
Out
38:22
Right, but it can be broken up.
In
Out
38:24
I mean, you get situations with, you know, larger plazas with a restaurant up front on a separate lot.
In
Out
38:34
If you run out of parking for the restaurant, they're back in front of Walmart or whatever else is there.
In
Out
38:46
So, I guess it's typical.
In
Out
38:48
The only risk to you is if the rest of it gets sold off and you're standing there with your little building and they say we're going to redevelop everything on this side of Ludlow Street into something else.
In
Out
39:02
Entirely, and you end up with nothing.
In
Out
39:06
That's, that's the risk to you.
In
Out
39:08
Otherwise, this is fairly typical, and it's usually most of those places are one— usually they're across easements that provide everyone access.
In
Out
39:17
You can get cut off on pad sites.
In
Out
39:20
You're not buying the property, correct?
In
Out
39:23
Me?
In
Out
39:23
Yeah.
In
Out
39:25
No, I wish they would let me.
In
Out
39:28
Well, no, I'm just going to advise that if you contemplate buying it, include it, buy it, sort of include some type of easement for the remainder, remaining part.
In
Out
39:39
Because how many employees do you have in there now?
In
Out
39:42
I have 4, but I also have a med spa in Rhode Island, and we divvy our time between the two.
In
Out
39:51
But you occupy the whole building right No, I don't.
In
Out
39:54
Unit number 2.
In
Out
39:56
So you're only number 2?
In
Out
39:58
Yeah.
In
Out
39:58
So who's in the other units?
In
Out
40:00
So unit 3— well, technically I also have unit number 1, but it's nothing.
In
Out
40:06
It's vacant right now.
In
Out
40:07
Yeah.
In
Out
40:08
And unit 3 is, is like most properties.
In
Out
40:10
They have their, uh, their plow person sleeps there during the winters.
In
Out
40:18
So this is a pretty unusual circumstance then.
In
Out
40:20
We've got a tenant of a portion of a building and we're trying to nail parking to their feet.
In
Out
40:29
It's kind of an oddball situation.
In
Out
40:32
Yeah.
In
Out
40:32
That's why I believe there was a request to waive parking as part of the application.
In
Out
40:38
No, it is now, right?
In
Out
40:39
Yeah, it is to waive, yeah.
In
Out
40:42
So really, I mean, the use is not the issue.
In
Out
40:44
Yeah, right.
In
Out
40:45
To wait parking.
In
Out
40:47
We don't.
In
Out
40:48
I don't think anybody's going to have a problem.
In
Out
40:50
It's consistent with what you're with what you're doing, but it suddenly becomes tattoo.
In
Out
40:54
So I get it.
In
Out
40:55
You have to.
In
Out
40:57
But there's no national points as far as I know that would be associated with the additional work that they're proposing.
In
Out
41:02
Is it going to change staffing?
In
Out
41:05
No.
In
Out
41:05
In fact, a microblading appointment's about three or four hours versus.
In
Out
41:10
The alternative we have now, brow waxing, is 10 minutes.
In
Out
41:13
So there'll be a lot less in and out congestion, etc.
In
Out
41:21
I mean, let's just hope that Lycos doesn't decide to put a restaurant in one of these units.
In
Out
41:27
Yeah, I mean, I mean, my gut right now, I don't have a problem with the wave just because of the situation for the use that's before you.
In
Out
41:35
I don't see an issue with the waiver of the parking.
In
Out
41:37
What potentially could happen here, depending upon— like, I had actually thought that you were in all of the units.
In
Out
41:43
Yeah.
In
Out
41:43
And all of the parking was available to you.
In
Out
41:46
So even the, like, even the 11 spaces that you have, they're not— suppose he fills unit 1, 3, and 4.
In
Out
41:53
Yeah.
In
Out
41:53
And those, whatever he puts in there requires 40 parking spaces.
In
Out
41:57
Yeah.
In
Out
41:58
That's— well, I have 1 and 2.
In
Out
42:00
And I I asked them for 3, but they said no, because they haven't.
In
Out
42:05
But they will not designate beyond that.
In
Out
42:09
That's kind of a courtesy to you as the owner of a business.
In
Out
42:14
So you don't have to park, you know, 3 stores down or something like that.
In
Out
42:19
Okay, I think this is in my— clear as mud.
In
Out
42:22
In my little brain, it's, it's easy.
In
Out
42:27
But you're going to be so successful, you're going to pick up and move someplace else and buy a building, and you won't have to worry about it, right?
In
Out
42:34
That's— we're going to live the dream with you right now.
In
Out
42:37
But we will have to worry about the results.
In
Out
42:39
Jimmy, go get your eyebrows fixed.
In
Out
42:41
Yeah, about time.
In
Out
42:43
Fixed.
In
Out
42:44
Fixed.
In
Out
42:45
Yeah, fixed.
In
Out
42:45
You're going to have to register them with the dog officer.
In
Out
42:53
While we're here, uh, anybody— any other questions from the board?
In
Out
43:01
No.
In
Out
43:01
Anybody here in the audience wishing to speak in favor of this petition?
In
Out
43:07
Anyone wishing to speak in opposition?
In
Out
43:11
None.
In
Out
43:13
I'm going to get you a free eyebrow job, Jeffrey, on this one, and a haircut.
In
Out
43:19
It's cruel.
In
Out
43:20
Anyway, then it's to us.
In
Out
43:25
So we have, we have, we have the use situation.
In
Out
43:30
And we have the parking.
In
Out
43:36
Both special permit.
In
Out
43:43
You can roll it all into one.
In
Out
43:44
We can.
In
Out
43:50
Anybody?
In
Out
43:51
Mr. Chairman, with the use as proposed, I find that it will not substantially be more detrimental to the area and that I move that we grant it.
In
Out
44:02
The addition of use?
In
Out
44:06
The waiving of the parking.
In
Out
44:08
Okay.
In
Out
44:10
As well.
In
Out
44:11
Yeah, and, and the use.
In
Out
44:15
Yes.
In
Out
44:15
Okay, second.
In
Out
44:17
Motion and second.
In
Out
44:19
Discussion?
In
Out
44:20
Hearing no discussion on the motion.
In
Out
44:22
Jim?
In
Out
44:23
Yes.
In
Out
44:24
Dan?
In
Out
44:25
Yes.
In
Out
44:25
Ricky?
In
Out
44:26
Yes.
In
Out
44:27
Eric?
In
Out
44:27
Yes.
In
Out
44:27
Sharon Crowe?
In
Out
44:28
Yes.
In
Out
44:28
Wish you the best of luck.
In
Out
44:30
Good luck.
In
Out
44:37
All right, item number 5.
In
Out
44:42
Applicant owner is Dillon Estates on the River, LLC, care of attorney Peter A. Salino.
In
Out
44:49
Subject property is 637 Durfee Street, Map 011, Lot 0006.
In
Out
44:57
The applicant is seeking a variance to allow the following pursuant to Section 86 Attachment 1 of the Fall River Zoning Ordinance to demolish the existing structure and construct a 5-story, 12-unit apartment building, waiving requirements related to front yard setback, side yard setback, rear yard setback, and lot coverage.
In
Out
45:18
The applicant is seeking a special permit to allow the following: 1, pursuant to Section 86-445 of the Fall River Zoning Ordinance, to modify the parking requirements as set forth in 86-441 through 86-444, including A, reducing the number of required off-street parking spaces from 18 to 12, B, eliminating the requirements for one loading space, C, allowing parking within 10 feet of the property line.
In
Out
45:49
The property is located in a WTOD Waterfront and Transit Oriented Development, and AOD, Arts Overlay Zoning District.
In
Out
45:59
Good evening.
In
Out
45:59
For the record, Peter Salino on behalf of the owner applicant, Dillon Estates on the River, LLC.
In
Out
46:05
Dillon Estates on the River, LLC is owned by Manny Sarmento.
In
Out
46:07
Mr. Sarmento proposes to demolish the existing 3-family structure that currently hugs Odd Street.
In
Out
46:15
It's about 3 feet from the property line as per the plan.
In
Out
46:17
Plan and to erect the proposed structure with the intention of creating the 12 units that are in the legal ad.
In
Out
46:26
The units are contemplated to be 1-bedroom, and I think that's important to the analysis of this petition.
In
Out
46:32
The structure itself is intended to be 5 stories.
In
Out
46:35
The proposed parking spaces, as indicated in the petition and the publication, is 12.
In
Out
46:42
So in terms of the waivers requested in the proposal.
In
Out
46:46
We have waivers for the side yard setback, which again, the existing structure, which contemplated to be raised, is only 3 feet from the property line.
In
Out
46:53
We're proposing to hold that, that the WTOD requires a 10-foot setback.
In
Out
46:59
And as a consequence, there's a waiver requested there.
In
Out
47:02
In the rear of the property, which is actually the easterly side of the property, there's this sort of a unique 2-foot jog in the property line.
In
Out
47:09
And, as a result, that rear or easterly property line is not straight.
In
Out
47:14
That requires a waiver as to the rear setback, which is also supposed to be 10 feet in the WTOD.
In
Out
47:20
Next, as you come to the front of the property, which would be the northwesterly corner, there's a significant inconsistency between the deeds to the property and what's actually on the ground.
In
Out
47:30
Mr. Tolman has investigated it, and we— I can't find at the registry of deeds, or he can't find here any kind of a taking.
In
Out
47:39
But you'll see a hash line that says parcel boundary by deeds.
In
Out
47:43
And so that triangular piece of property appears to have been taken sometime in the '50s, we think.
In
Out
47:49
And that creates the need for that front yard waiver, because we can't comply with the 10 feet there.
In
Out
47:56
The lot coverage requirement in the district is 80%.
In
Out
47:59
The proposal is 82%.
In
Out
48:01
Obviously, we're trying to provide as much parking as possible, and therefore, we're slightly over that requirement.
In
Out
48:08
The District requires 1.5 times parking spaces, and we're at 1:1, which, again, 12 one-bedroom units, 12 parking places.
In
Out
48:18
Additional waivers in the parking realm in the special permit part of the petition relate to having parking within 10 feet of a property line and waiving the need for a loading space.
In
Out
48:28
In my petition, I have pled to you that the hardship has to be the shape of this property.
In
Out
48:34
The northwesterly corner that appears to have been taken but is not reflected in the deed, the jog on the easterly side, the retaining wall and slope all make this site pretty tough to design.
In
Out
48:45
Nevertheless, Mr. Sarmento is hopeful that he can build a beautiful building there that's equipped with an elevator.
In
Out
48:51
Elevator, and all the modern amenities close to the train station.
In
Out
48:55
So we're happy to answer any questions the board may have relative to the proposal.
In
Out
49:01
Jeff is obviously here over my shoulder.
In
Out
49:03
He's the engineer on the project.
In
Out
49:05
Representatives of the owner are also here to answer any questions the board may have.
In
Out
49:10
I agree it is tough to design for a 12-unit building with a ton of lot coverage.
In
Out
49:18
I'm going to hold my questions right now and I'm going to turn to my board and I'm going to turn to my planning director as well.
In
Out
49:32
WTOD is already a lessened parking requirement.
In
Out
49:39
It's 1.5 as opposed to 2.
In
Out
49:42
We're now trying to chip that down.
In
Out
49:44
I understand they're all 1 bedrooms, but— So the creation of WTOD was based upon— so the housing density of a number of units is 100% dictated by the amount of parking that you can provide.
In
Out
49:59
So there is no limit to how many units you can construct as long as you can comply with the off-street parking requirement of 1.5 spaces.
In
Out
50:09
Per unit.
In
Out
50:14
And again, building setbacks.
In
Out
50:17
I mean, this is a lot.
In
Out
50:19
I mean, I don't know what you could fit on there by right.
In
Out
50:22
But let's just say if you had— what are you showing, 12 parking spaces?
In
Out
50:27
Yes.
In
Out
50:27
12 parking spaces.
In
Out
50:28
So that would allow you 8 units by right, if my math is correct?
In
Out
50:32
Yes.
In
Out
50:32
Did anybody contemplate an 8-unit building?
In
Out
50:35
And, would you need setback relief, and lot coverage relief, and all of those things?
In
Out
50:41
Because there's clearly use of the property that you can be in compliance with WTOD, and develop the piece of land.
In
Out
50:48
This isn't a vacant piece of land that's got nothing on it.
In
Out
50:51
It's got an existing 3-family dwelling on it.
In
Out
50:54
Yeah, and the only thing I would say to the setback relief, given the— and, believe me, I've done many different parking layouts on this particular property, and 12 seems to be the max number you can get here.
In
Out
51:09
In order to get those work, you're trying to position those spots so you're able to maneuver in and out of them.
In
Out
51:16
That's what kind of dictates the need for the setback relief, because just to move that building in— But that's for a 12-unit building, as the chairman Well, if it was an 8-unit building, you may be able to have just a normal parking lot to the side of the building.
In
Out
51:36
No, you wouldn't be able to get the 12.
In
Out
51:38
I mean, we're basically utilizing the whole grade level to get the 12 spots.
In
Out
51:44
With whatever scenario you want to draw up, you've got one drive aisle that has no parking off of it.
In
Out
51:49
So, that's not very efficient.
In
Out
51:51
Well, you have a drive aisle that has 3 parking spots, the other drive aisle has 9.
In
Out
51:58
Correct.
In
Out
51:58
Which, in a normal parking lot, you would have access, one singular access point, and parking off of each.
In
Out
52:03
Potentially coming in from Odd Street, where you could get a longer driveway, and come off of each one of them.
In
Out
52:08
The grade going off Odd Street dictates it.
In
Out
52:10
It's just a grade issue at that point.
In
Out
52:13
And then, you, we don't, there's not sufficient width.
In
Out
52:17
By the time you get— you go north, there's not sufficient width to provide parking spots on both sides of one main aisle.
In
Out
52:26
And the access off of Odd Street, the topography, although not shown on this particular plan, the topography going up Odd Street would create an issue, because it does go up pretty substantially.
In
Out
52:38
So then to have to make that turn onto Odd Street, then drop back down into the site, Like you said, that information's— I mean, there's a house built there running along Arch Street, so they could apparently build a house.
In
Out
52:50
I'm not going to add anything else.
In
Out
52:52
No, because we're not going to design this.
In
Out
53:01
I mean, you close the lot coverage, you're not getting too crazy on the lot coverage, but I just feel like— I just feel like it's too much.
In
Out
53:14
And that's just gut right now.
In
Out
53:18
And cutting down, getting waiving— we always say waivers.
In
Out
53:23
I hate the fact that we say waivers here in Fall River.
In
Out
53:26
They're variances.
In
Out
53:28
Well, they're actually waivers in Fall River.
In
Out
53:31
Waiver.
In
Out
53:32
No jiu-jitsu.
In
Out
53:35
You're not in Kansas anymore.
In
Out
53:41
You know, so we're looking at, we're looking at a density variance, we're looking at setback variances, we're looking at, you know, modification of the proximity to lot line for parking spaces.
In
Out
53:57
We're jamming the lot.
In
Out
54:00
And anybody else can jump in at this point, because I'm not asking questions, because I don't think there's an answer that's going to make me like this.
In
Out
54:08
I can't ask a question that's going to get me an answer that I'm going to like, looking at what I'm looking at.
In
Out
54:14
You know, height, great, you can do a 5-story building.
In
Out
54:18
That's cool.
In
Out
54:19
That's easy.
In
Out
54:20
Whoever thought that was going to be the easy part?
In
Out
54:23
Yeah, zoning allows that.
In
Out
54:27
Anybody else?
In
Out
54:30
Either question or opinion at this point in time?
In
Out
54:32
I think it's too much.
In
Out
54:41
And since it's, you know, since it is predicated upon parking, I think you got to work backwards.
In
Out
54:49
And I can't tell you how, and I can't tell you if that's going to make a financial decision possible, or whatever it comes down to to do it.
In
Out
55:01
And I know that's what it always comes down to.
In
Out
55:03
We're in a time of expensive construction materials, contracting, etc.
In
Out
55:08
I get it.
In
Out
55:10
So, we try to get the most out of everything.
In
Out
55:11
But sometimes I just shake my head, and I'm shaking my head from this one.
In
Out
55:16
Going to the general public.
In
Out
55:17
Is there anyone here wishing to speak in favor of this petition in support?
In
Out
55:22
Anybody wishing to speak in opposition?
In
Out
55:29
Can I have a brief second to speak to the plan?
In
Out
55:31
Yes.
In
Out
55:31
Thank you.
In
Out
55:55
Mr. Chairman, yes, the petitioner would like to make a motion to table this petition to the August meeting so that we can look at the design more carefully and be responsive to the board's questions and concerns.
In
Out
56:05
Thank you.
In
Out
56:07
Do we have a motion for table?
In
Out
56:10
Motion to grant table.
In
Out
56:12
Second.
In
Out
56:14
On the motion to table, Eric?
In
Out
56:16
Yes.
In
Out
56:17
Ricky?
In
Out
56:18
Yes.
In
Out
56:18
Dan?
In
Out
56:18
Yes.
In
Out
56:19
Jim?
In
Out
56:19
No.
In
Out
56:21
And Chairman Prairie?
In
Out
56:22
Yes.
In
Out
56:24
Okay.
In
Out
56:25
Thank you.
In
Out
56:26
See what you can do.
In
Out
56:26
Can you fill this form out?
In
Out
56:34
It was online.
In
Out
56:36
I'm sure you can.
In
Out
56:47
Just taking the stuff and going home.
In
Out
56:51
All set.
In
Out
56:51
Item number 6, applicant owner is Carlos Ifris Estrella and Carlos Aquino.
In
Out
56:59
Care of Attorney Peter A. Salino, 0 Augusta Street, Map I-26, Lot 0018.
In
Out
57:11
The applicant is seeking a variance to allow the following: 1, pursuant to 86 Attachment 1, Fall River Zoning Ordinance, to construct a 2-family dwelling on the subject property, waiving the requirements related to Lot A area and lot coverage.
In
Out
57:26
The applicant is seeking a special permit to allow the following: 1, pursuant to Section 86-443 of the Fall River Zoning Ordinance, to waive parking aisle requirements.
In
Out
57:36
Property is located in an A-2 apartment zoning district.
In
Out
57:40
Good evening.
In
Out
57:41
For the record, Peter Cellino on behalf of multiple Estrellas, the owners of the property at 0 Augustus.
In
Out
57:48
The property is located off of Broadman Street.
In
Out
57:50
It's a narrow lot.
In
Out
57:51
It contains about 5,500 square feet of land.
In
Out
57:54
The variance requests are 2, and then the special permit requests are 1.
In
Out
57:59
So the variance request is that the parcel is in an A-2 district that requires 6,500 square feet in order to build a 2-family.
In
Out
58:07
The proposal here is to build a 2-family.
In
Out
58:10
As a result, we're short on the square footage for a 2-family in the A-2, so variance 1 is the overall square footage of the lot.
In
Out
58:18
Variance 2 is the lot coverage.
In
Out
58:21
You'll notice on the plan that the applicant has proposed 6 off-street parking spaces, which obviously exceeds the requirement by 2.
In
Out
58:29
But as we just saw in the last petition, parking is at a premium in Fall River.
In
Out
58:33
And so the engineer, I think, thoughtfully designed this petition to— or this plan to include extra spaces.
In
Out
58:40
As a result of that, We have a lot coverage as proposed of 55.5.
In
Out
58:45
So the lot coverage would require variance since the district requires 30%.
In
Out
58:50
And then finally, the drive aisle as you drive into the property as contemplated and proposed from Augusta Street is 20.5 feet, and the travel aisle must be 22 feet.
In
Out
59:02
And so as a result, there's a request there for special permit to relax as opposed to waive the parking requirement by a foot and a half.
In
Out
59:11
So I've pled in my papers that the petition and the hardship associated with it is obviously the existing size of the lot.
In
Out
59:18
I think it's a reasonable proposal for this neighborhood.
In
Out
59:21
It's all multifamily use surrounding it.
In
Out
59:24
The Estrellas are here as well as their engineer if anybody has any specific questions that require a technical answer.
In
Out
59:31
Otherwise, I'm happy to review further or answer questions the board has.
In
Out
59:35
Parking spaces 5 and 6, are those stacked?
In
Out
59:39
They're— yes, I think you'd say that they're parallel spots, effectively.
In
Out
59:47
Which is the only way you could get 20 feet for— right.
In
Out
59:50
Yeah.
In
Out
59:53
And attorneys, do we know how short are you with square footage?
In
Out
59:57
The requirement in the district is 6,500.
In
Out
59:59
And we're at 5,055, so just under 1,000.
In
Out
1:00:11
I'll just start with that.
In
Out
1:00:14
Within the last year, we modified the A-2 zoning district from 10,000 square feet and 2,000 square feet per additional unit down to 5,000 square feet for a single-family home.
In
Out
1:00:25
And the frontage requirement from 100 to 50.
In
Out
1:00:28
So all the efforts that this board took, the planning board and the city council, to allow construction on lots in this district that have 50 feet of frontage and 5,000 square feet would afford this landowner to build a single-family house in accordance with your new regulations that you created.
In
Out
1:00:46
You are now being asked to go beyond that and allow a 2-family house to be constructed, and lot coverage waivers, and parking setback waivers.
In
Out
1:00:56
So it's almost undoing the efforts of allowing people to construct on something.
In
Out
1:01:01
If you remember, part of that discussion was we keep getting all these requests for variances in the A-2, and everybody agreed that the lot areas were excessive in A-2 of 10,000 square feet to start.
In
Out
1:01:14
So you made that change.
In
Out
1:01:15
That apparently isn't enough for some people, where 50 feet of frontage and 5,000 square feet, that allows you to build a single-family house with 2 off-street parking spaces and 25% lot coverage.
In
Out
1:01:27
We all thought that would be enough for people.
In
Out
1:01:29
But now we're going to start getting variance petitions to waive those more progressive requirements as well.
In
Out
1:01:35
So I would just ask you to contemplate that.
In
Out
1:01:44
Yeah, it's another shoehorn.
In
Out
1:01:49
Other questions from the board?
In
Out
1:01:50
Comments from the board at this point?
In
Out
1:01:52
So just to be clear, Dan, if this were— if this proposal were one family, they would not be here.
In
Out
1:01:57
They don't need to be here, right?
In
Out
1:02:10
Okay, $5,050.
In
Out
1:02:11
So it's $6,500 required for this.
In
Out
1:02:16
And you're just shy of $1,000 off.
In
Out
1:02:19
Yeah, I mean, I've got a— we've been here before.
In
Out
1:02:23
And personally, I'm standing, I'm standing with the efforts that were made.
In
Out
1:02:30
I'm standing with the efforts that were made.
In
Out
1:02:33
Questions?
In
Out
1:02:36
Comments?
In
Out
1:02:40
I'm going to go to the general public.
In
Out
1:02:42
Anybody here wishing to speak in support of this application?
In
Out
1:02:47
Anyone wishing to speak in opposition?
In
Out
1:02:52
Okay.
In
Out
1:02:53
Was a single family contemplated?
In
Out
1:02:55
If I could have a brief minute and speak to Mr. Ostrowa.
In
Out
1:03:09
That's true too.
In
Out
1:03:10
Is that correct?
In
Out
1:03:13
What's that?
In
Out
1:03:13
A single family with an ADU, am I right?
In
Out
1:03:17
Correct.
In
Out
1:03:18
Yeah.
In
Out
1:03:20
But the second unit will be limited to 900 square feet.
In
Out
1:03:23
Right.
In
Out
1:03:24
Right.
In
Out
1:03:25
Difference.
In
Out
1:03:26
Right?
In
Out
1:03:26
Yeah.
In
Out
1:03:26
So they're not going to get a 3-bedroom, right?
In
Out
1:03:29
6 bedrooms would be a 3-bedroom.
In
Out
1:03:34
You don't design the things for that.
In
Out
1:03:36
No, right.
In
Out
1:03:36
Saying that's by a matter of right.
In
Out
1:03:41
I just wanted to be clear what the matter of right was.
In
Out
1:03:43
Yep.
In
Out
1:04:41
I was just looking at your robot and blew up.
In
Out
1:04:45
Probably could have done something.
In
Out
1:04:57
My client's willing to let it go to vote, see what happens, and obviously then he could revert back to a single-family if he has to.
In
Out
1:05:05
Okay, let me I mean, there's a clear way to get 2 units here.
In
Out
1:05:11
I understand, okay.
In
Out
1:05:13
Motion to deny.
In
Out
1:05:15
Second.
In
Out
1:05:16
Motion to deny, seconded.
In
Out
1:05:19
On the motion, Jim?
In
Out
1:05:22
Yes.
In
Out
1:05:23
Dan?
In
Out
1:05:23
Yes.
In
Out
1:05:24
Ricky?
In
Out
1:05:24
No.
In
Out
1:05:26
Eric?
In
Out
1:05:26
Yes.
In
Out
1:05:28
Chairman Ferriero?
In
Out
1:05:28
Yes.
In
Out
1:05:29
Thank you.
In
Out
1:05:29
Thank you.
In
Out
1:05:32
4-1 goes down.
In
Out
1:05:38
Okay.
In
Out
1:05:40
Item number 7, applicant owner Seth D. Ellie and Lisa— is it Eli?
In
Out
1:05:48
Okay.
In
Out
1:05:49
I never saw Eli with an E on the end, but I apologize.
In
Out
1:05:54
Care of attorney Peter A. Salino.
In
Out
1:05:56
Subject property is 1214 14 Watkins Street, Map R-08, Lot 0021.
In
Out
1:06:02
The applicant is requesting a variance to allow the following: to construct an addition to an existing single-family dwelling with relief from Section 86, Attachment 1 of the Fall River Zoning Ordinance, specifically related to side yard setback requirements.
In
Out
1:06:19
Property is located in an R-30 single-family zoning Good evening.
In
Out
1:06:25
For the record, Peter Cellino on behalf of Mr. and Mrs. Eli, who are over my shoulder to the left.
In
Out
1:06:30
This proposal is to add an addition to their current single-family home at 1214 Watkins Street in Fall River.
In
Out
1:06:39
Cutting to the chase of this petition, it all relates to the side setback, which is planned right.
In
Out
1:06:44
You can see that the property line is not straight.
In
Out
1:06:48
As a consequence, I've already argued that the shape of the property necessitates this waiver.
In
Out
1:06:52
You can see that they can comply with all other setback requirements, but for that side yard setback on the proposed addition.
In
Out
1:07:00
So to be clear, it's supposed to be 25 feet in the district.
In
Out
1:07:04
The proposal is to build the addition such that it's 10.3 feet from that side property line.
In
Out
1:07:10
So I think the hardship is the shape of the lot.
In
Out
1:07:13
And the ELIs are here, to answer any questions to the extent that the board has any.
In
Out
1:07:21
Okay.
In
Out
1:07:22
Use of this is just additional living space?
In
Out
1:07:27
Yes, my understanding.
In
Out
1:07:28
Yeah.
In
Out
1:07:28
You want to speak?
In
Out
1:07:30
Yeah, for my mother.
In
Out
1:07:32
Additional living space for my mother.
In
Out
1:07:36
So essentially, as an ADU, it'll be a separate unit.
In
Out
1:07:40
It's okay to say ADU.
In
Out
1:07:41
Don't be afraid.
In
Out
1:07:43
Basically just an extra bedroom.
In
Out
1:07:45
It's not going to have a kitchen.
In
Out
1:07:46
It's not going to have— no, that's not our plan.
In
Out
1:07:53
So you could make a condition that no ADU, if you chose to, only because we haven't contemplated parking and anything else that comes along with ADU.
In
Out
1:08:02
Right.
In
Out
1:08:02
That's up to you.
In
Out
1:08:05
Okay.
In
Out
1:08:06
I don't think it was clear.
In
Out
1:08:07
Proposed additional, proposed additional unit are 2 different things.
In
Out
1:08:14
And I'll just add that I don't think that the intent was to create a separate unit.
In
Out
1:08:18
My understanding is that Seth— but that doesn't mean somebody else won't.
In
Out
1:08:21
No, I understand that.
In
Out
1:08:22
I understand that.
In
Out
1:08:23
But right now, the objective, bluntly here, is can they build the addition on the house and have mom come in?
In
Out
1:08:29
And if they can't, they're going to sell the house.
In
Out
1:08:31
That's where they're at.
In
Out
1:08:36
I don't really have a problem with the 10.3.
In
Out
1:08:40
How close is the— is there a neighbor?
In
Out
1:08:44
What's the question?
In
Out
1:08:45
Is there a neighbor?
In
Out
1:08:46
Yeah, there is.
In
Out
1:08:47
Yeah, and that's that single-family next door is probably about 30 feet, 30 or 40 feet off the lot one.
In
Out
1:08:58
It's pretty big.
In
Out
1:09:01
Yeah, I think the last month there was a petition to build a garage on one of these lots, but the shape of the lots at the end of Watkins is just— get a little crazy.
In
Out
1:09:09
Yeah, very creative.
In
Out
1:09:10
Creative.
In
Out
1:09:11
That's a nice way to put it.
In
Out
1:09:13
Wait a minute, do you have the— is there a dogleg to your lot that goes all the way over to 24th?
In
Out
1:09:18
I did not design this.
In
Out
1:09:19
And Seth is very happy he's paid taxes on that land.
In
Out
1:09:24
Land for all these years.
In
Out
1:09:25
He was expressing to me earlier that the house wouldn't be there if it wasn't.
In
Out
1:09:28
So, wow.
In
Out
1:09:31
He didn't reap the benefits from it, but somebody did.
In
Out
1:09:34
That's true.
In
Out
1:09:36
Wow, that's great.
In
Out
1:09:39
We discovered one of these in my— the neighborhood I grew up in.
In
Out
1:09:42
We realized that we owned a ridiculous piece of property that had been chopped off at some point.
In
Out
1:09:48
It was the same type of situation.
In
Out
1:09:52
Okay, questions from the board?
In
Out
1:09:57
Anybody in the audience wishing to speak in favor?
In
Out
1:10:00
Anyone wishing to speak in opposition?
In
Out
1:10:04
Let's do it.
In
Out
1:10:06
Tee up.
In
Out
1:10:08
Mr. Chairman, I would make the motion that the variance be granted as requested.
In
Out
1:10:13
Second.
In
Out
1:10:15
Motion and second.
In
Out
1:10:17
Discussion on the motion?
In
Out
1:10:18
Hearing none.
In
Out
1:10:20
Eric?
In
Out
1:10:21
Yes.
In
Out
1:10:22
Ricky?
In
Out
1:10:22
Yes.
In
Out
1:10:23
Dan?
In
Out
1:10:23
Yes.
In
Out
1:10:24
James?
In
Out
1:10:24
Yes.
In
Out
1:10:25
And Chairman Perriero?
In
Out
1:10:26
Yes.
In
Out
1:10:27
Thank you.
In
Out
1:10:31
See, you can win stuff.
In
Out
1:10:35
And item number 8, applicant owner 2573 South Main Street, LLC.
In
Out
1:10:42
2589 South Main Street, LLC, care of attorney Peter A. Salino.
In
Out
1:10:47
Subject, properties of 2573 South Main Street, Map B-1, Lot 9, and 2598 South Main Street, Map B-01, Lot 10.
In
Out
1:10:57
The applicant is requesting that the variance and special permit previously granted to— by the board on August 21st, 2025, be extended for a period of 6 months to allow additional time to appropriately exercise the relief granted.
In
Out
1:11:16
Thank you.
In
Out
1:11:16
For the record, Peter Salino on behalf of the 2 LLCs that own the property.
In
Out
1:11:21
The board may remember this petition.
In
Out
1:11:22
This is last August.
In
Out
1:11:24
Substantial petition, requires a lot of work.
In
Out
1:11:26
Mr. Martin is cognizant of the fact that he's not going to be able to get all that work done within the time allotted by the decision.
In
Out
1:11:34
I know he's met several times with the planner relative to different strategies on how to attack this project.
In
Out
1:11:41
And still, he met with Jeff Tallman yesterday.
In
Out
1:11:43
So the request is simple, which is, can we please have more time to finish and/or exercise the relief granted under the variance, seeking 6 months?
In
Out
1:11:54
Okay.
In
Out
1:11:57
We can go directly to the board on that.
In
Out
1:12:01
Mr. Chairman, I move that we grant the extension.
In
Out
1:12:07
Second.
In
Out
1:12:08
Motion and seconded.
In
Out
1:12:11
No discussion on the motion.
In
Out
1:12:13
Jim?
In
Out
1:12:14
Yes.
In
Out
1:12:14
Dan?
In
Out
1:12:15
Yes.
In
Out
1:12:16
Ricky?
In
Out
1:12:16
Yes.
In
Out
1:12:17
Eric?
In
Out
1:12:17
Yes.
In
Out
1:12:17
Chairman Pereira?
In
Out
1:12:18
Yes.
In
Out
1:12:19
Thank you.
In
Out
1:12:19
See, isn't that a nice way to end the night?
In
Out
1:12:28
Uh, citizens input.
In
Out
1:12:31
Yes.
In
Out
1:12:32
Yep.
In
Out
1:12:32
Yeah, just ask one question in regard to— so citizen employees, you get— is you say you don't have to answer questions?
In
Out
1:12:39
We make statements, we cannot answer questions.
In
Out
1:12:41
I was just trying to find out if, uh, in terms of Holy Name Church, whether or not there was a date for the land court and whether or not that's— we would have no idea.
In
Out
1:12:50
That's not our jurisdiction.
In
Out
1:12:51
Yeah, call the law office and maybe they can answer you, but we don't know.
In
Out
1:12:54
All right.
In
Out
1:12:55
Okay.
In
Out
1:12:56
I'm just wondering why, why you went into executive session.
In
Out
1:13:02
That's why it's executive session, is because it's not a public hearing.
In
Out
1:13:05
I'm allowed to know.
In
Out
1:13:06
Okay.
In
Out
1:13:06
Yep.
In
Out
1:13:07
I just find what you guys do absolutely fascinating, the issues that you have to grapple with.
In
Out
1:13:12
So do we.
In
Out
1:13:14
And also dealing with public safety is amazing.
In
Out
1:13:16
To watch you guys in action.
In
Out
1:13:19
I'll take that as a compliment.
In
Out
1:13:21
Sometimes it's, uh— we thank you for your patience and staying all this time.
In
Out
1:13:26
But the law department might be able to provide more information.
In
Out
1:13:28
Okay, so feel free to call.
In
Out
1:13:29
Thank you for, uh— I'm sorry for interrupting.
In
Out
1:13:32
It's quite all right, not a problem.
In
Out
1:13:33
We don't expect everybody to understand the procedure.
In
Out
1:13:35
We don't understand it ourselves.
In
Out
1:13:38
All right, approval of minutes for the June 18th, 2026 Mr. Chairman, I move waiving of the reading of the minutes and approval of the same.
In
Out
1:13:47
No, I think we should read it.
In
Out
1:13:48
No.
In
Out
1:13:49
Motion is seconded.
In
Out
1:13:50
We have the right members here to do that?
In
Out
1:13:53
Minutes?
In
Out
1:13:55
I forgot who was here last month.
In
Out
1:13:57
Raise your hand.
In
Out
1:13:59
John was here.
In
Out
1:14:01
Yeah, we don't need him.
In
Out
1:14:02
I know.
In
Out
1:14:03
You had a full board.
In
Out
1:14:04
You were here.
In
Out
1:14:05
Yeah, we're here.
In
Out
1:14:06
We're good.
In
Out
1:14:09
We're good.
In
Out
1:14:11
On the motion, all in favor?
In
Out
1:14:13
Aye.
In
Out
1:14:14
Opposed?
In
Out
1:14:16
And motion for adjournment.
In
Out
1:14:18
Motion to adjourn.
In
Out
1:14:21
Somebody's just seconded it so we can just— nobody wants to second.
In
Out
1:14:28
All in favor?
In
Out
1:14:28
Aye.
In
Out
1:14:29
There's no soccer on.
In
Out
1:14:31
Thank you.
In
Out
