hi good evening everyone my name is Tim McCoy and I'd like to commence the Fall River licensing board meeting for the month of August today is Thursday August 24th 2023 5 o'clock I'm going to read aloud the open meeting law pursuant to the open meeting law any person may make an audio a video recording of this public meeting or may transmit the meeting through any media attendees are

there for advised that such recordings or Transmissions are being made whether perceived or unperceived by those present and I deemed acknowledged and permissible City Charter section 9-18 mandates that all multiple member bodies develop and adopt rules or policy for public comment we have adopted such a policy which insurf provides for Citizens input on licensing board specific matters at the beginning of the

meeting there is a sign up sheet that is located at the back of the room so with that said on our agenda tonight we have item number one which is public or slash citizens input we have no one who has signed up so we will move on to item number two which is an application from the Liberal Club uh by bar manager Donna Bergeron the Liberal Club is located at 20 star Street Fall River

how are you sir can you give us name and address good it's good to see I'm well chassis hi Paul president of the local Club Paul can you just at least say it into the microphone please name an address uh my name is Paul chassis president of Level Club 56 First Street Fall River Mass Paul thanks for coming tonight uh it looks like we have a letter from Miss Bergeron this year

um I can read the hours publicly um she's asking us to consider the following hours of operation for the bar and you tell me if I get these correctly or if there's any change or edit to the letter we have Sunday 11 A.M to 8 P.M Mondays 10 a.m to midnight Tuesdays 10 a.m to 10 p.m Wednesday 10 a.m to 10 p.m Thursday 10 a.m 10 p.m 11 p.m excuse me

Friday 10 a.m to 1 a.m and Saturday 10 a.m to 1 a.m that's correct that is accurate and again your physician you're president I'm the president so at this point uh I don't know if we have any questions from the commission is what the chairwood entertain a motion make a motion to change the hours for the Liberal Club thank you second motion made by Mr Pereira seconded by miss godero any discussion on this matter

don't mind sitting in doesn't change much no it doesn't change much um again if you could give us name and address please just call chassis 56th Street forever thanks Mr chassis so we have three one-day permits on behalf of the Liberal Club for their Holy Ghost Feast uh submitted by Kevin Palmer for the dates of September 1st September 2nd September 3rd I'm going to read this is an all beverage request the Friday

evening September 1st timing is 6 p.m to 11 P.M on Saturday also an old beverage from noon to 11 p.m and then on Sunday also all beverage and it is 11 30 a.m to 11 P.M so the uh and we do have a we do have a letter here uh signed by Uh Kevin Mr Palmer yeah so the chair would entertain a motion if the board is inclined I'll make a motion to approve the one-day

to see you sir thank you Police Athletic League Fall River uh Charles Cullen president and we're located at 31 Franklin Street in Fall River and Deputy it looks like we have two requests here uh it is for a boxing show it is a all alcohol uh we have the dates here of September 16th that's correct 2023 and also is November 18th at a second request it's not a rainy day correct okay for a

second event two different shows two different shows the November show will be with the West Point army military cadets coming down for the second time they were here last year the boxing team that is so they're coming down for the Veterans Day it's close to Veterans Day fantastic fantastic the chair would entertain of motion I'll just get the hours of the oh I apologize so I have it on the

application uh we have both Saturdays uh the September 16th is 6 to 10 and Saturday November 18th six to ten is that accurate correct okay very good thank you I'll make a motion to approve the one day permits for the of September 16th and November 18 2023.

the agenda item number four is an entertainment permit for the King Philip Yacht Club how are you sir if you'd please in the in the microphone please give name and address name's Charles Mulkey I'm the treasurer for the king Phillips Yacht Club and I reside 65 Beach Avenue in Tiverton Rhode Island thank you Mr Mulcahy it looks like we have a we do have a letter here um let me see

so we have an application which was submitted on July 17th and it looks like we're requesting a permission for a permit for a wrestling event on September 30th 2023. that's correct sir would you have the time Sandy I do not okay I'm sorry I have it here it looks like it's 7 30 to 10.

application was filled out by Mr Lavoy president of the of the club too president of Cub and I believe he was he had an engagement tonight A prior engagement tonight he did too um so the chair would um entertain a motion uh make a motion to uh approve the entertainment permit for King Philip Yacht Club I'll second motion made by Mr Pereira seconded by Miss kadiro do we have any discussion on

okay so we have an application here um the uh I I would like to notify my colleagues that I I Believe Miss pyres will have to meet um detective Monas to settle up uh one issue regarding the application that the police department deals with so if I could advise my clients if there is the desire to approve this application if we could do it pending resolution of the issue with Detective monus of the refer

to it as a police police manner so with the board like to entertain such a motion I'll make a motion to approve the common victriller's license for Imperial Grill and pizza pending resolution with Detective bonus I second that motion motion made by Miss cadero seconded by Mr Pereira any discussion all in favor aye aye again motions uh application is granted pended pending the resolution of

currently held by karalpa for the premises I think I'm sorry Council can you move the mic over a little bit I'm sorry sorry I go ahead sir I'm sorry I didn't mean to interrupt should I start again sure I know okay the police the board my name is Arthur Perlman I'm an attorney my office is located at 75 Union Avenue in Sudbury Massachusetts I represent Heaven Patel and ACTA Inc they're seeking a transfer of the

package store all alcohol license currently held by karapa Inc for the premises at 879 Pleasant Street in Fall River and transferring that license to act to Inc DBA Pleasant Discount Liquors in mini mart published notice was accomplished by the city of Fall River mailed notice to about us is not required for a transfer of a license ACTA Inc is a Massachusetts Corporation Evan Patel is a sole officer and

director he's also a 67 percent owner of the corporate stock bip and Patel is a 35 shareholder Heaven Patel is currently living at 28 jills away in Tewksbury Massachusetts Heaven hasn't had an interest in two liquor license previously one in Ipswich one in New Bedford however at this time this will be the only liquor license he has in interest in uh Patel is currently living at 121 East Falmouth Street Highway in

eastbound three licenses so both of them are familiar with alcohol on the sale of alcohol Smith Patel will be the manager on the license Smith Patel is currently living at 40 Main Street in Stoneham Mass Smith has no interest in any other license he's not a manager on any other license uh but he has been trained in liquor in the New Bedford store uh Smith has been employed by fisa for I think over well

over 10 years uh he's seeking a transition into the liquor business and at some point time he's going to try to get his own but for now he's going to work with these people and manage their business all of these gentlemen will be helping to operate the business so all of them will be there helping to operate that business we request operating hours of 8 to 11 Monday through Saturday and

10 to 11 on Sunday unless I say all these gentlemen have been in the liquor business they're familiar with the laws relative to the sale of alcohol heaven and bipin both have been tip strained Schmidt will be tips trained before this license is approved by the ABC and they will all uphold the statutory law as well as any other rules or regulations that the city of Fall River may have therefore I would respectfully

request that the board approve the transfer of license thank you councilor I see you're always up here to be in line with our ordinances I do see also um we have a counselor that's uh that's here tonight an attorney that's not representing the applicants I don't know if there's any interest he needs to speak on any other matter I don't believe so okay okay thank you so much um the chairwood Entertainer motion sure

attorney Assad an opportunity if he needed to he needed to participate thank you very much uh all right moving on to item number seven uh we have old business Slash new business 7A I'd like a motion uh to approve the June 21st 2023 minutes and I asked Fall River government TV to stay with us so we could sign on the air so could I get a motion to approve that day I'll make a motion to

approve the June 21st 2023 second motion so motion made by Miss cadero seconded by Mr Pereira any discussion hearing none all in favor the eyes have it I'm going to sign and pass down

moving on to item sure counselor why don't you come up though come up to the table I just realized we're not using a lender so we didn't have a pledge to A lender but the um the seller is taking back some paper and Michelle would like a pledge of the license can I ask that that also be approved let me see one thing hold on okay

I checked off for a pledge of a license that I put the pledge in with the package if I look at page one of the application it does ask for a pledge of the license but my question is did I put a pledge in there I'm gonna check right quick okay you must have could you put me I would hope so but it didn't add it when I was talking to you

yeah number 11 is pledge of license hold on I know I'm sorry no please no worry

that's a copy of the of the note and the pleasure of the pledge if you want I love you I'll have you keep that if you want you can email it back to me tomorrow you trust me yeah absolutely

everything it's right before the bank statements

I probably just can't find it because I can't separate these forms quick enough and the pressure is getting to me I know

yeah we got it got him yep okay okay so if you could at least describe what we have here as far as the pledge once you settle back at the table what we have is the uh seller is taking that paper on the soap we have a note that we gave we're giving going to sign and give to him at the closing and a copy of the Pledge document that we'll

be securing it both of which the ABC is going to want to see gotcha so we have a pledge here from atka Inc DBA Pleasant Discount Liquors to Albert carram and Paula Karen who are the individuals that own uh karalpa Inc so again it's the principles of Albert Albert carram and Paula Karen same name p-a-u-l-a okay I've got a Boston accent so okay so the the chair would entertain a pledge

um of license uh from adca Inc DBA Pleasant Discount Liquors individuals represented by councilor Perlman Kip right and uh the pledge being made to Albert and Paula Karam any DBA or can you that corporate name do I need there no it's to them personally personally okay okay so I'll make a motion to uh pledge of license from akka Inc to Alba and Paula Karam I'll second motion made by Mr Pereira seconded by
