Good evening, good evening everyone.
In
Out
0:02
Welcome to the Fall River Planning Board committee meeting, and we have, um, on Wednesday, September 9th, 2026, starting exactly at 5:30 PM.
In
Out
0:15
We have sign-up sheets in the back for any public comments, and that will be addressed during the process and towards the end for any Q&A.
In
Out
0:25
Our first line above, um, to proceed with is the reading of the open letter meeting law.
In
Out
0:34
It's chapter, um, Mass General Law Chapter 30A, Section 20.
In
Out
0:39
Pursuant to open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any medium.
In
Out
0:50
Attendees are therefore advised that such recordings and transmissions are being made, whether perceived or unperceived, by those present and/or deemed acknowledged and permissible.
In
Out
1:03
With that, I'd like to do a roll call starting to my right.
In
Out
1:09
Present.
In
Out
1:11
Gloria Pacheco?
In
Out
1:12
Present.
In
Out
1:13
To my left.
In
Out
1:14
Orlando?
In
Out
1:15
Present.
In
Out
1:16
Also in the room is Dan Pacheco, who is the director of Engineering and Planning.
In
Out
1:26
It's all right, I'm going to change it.
In
Out
1:28
I'm going to change it.
In
Out
1:29
I'm going to change it.
In
Out
1:30
I appreciate that.
In
Out
1:31
Sorry, Dan Aguiar.
In
Out
1:33
That's racial.
In
Out
1:34
And, uh, if you weren't nefarious, I'd take offense to it.
In
Out
1:37
I know, I know.
In
Out
1:39
And to, uh, in our court is Felicity Parker.
In
Out
1:44
And also recording this evening is Craig Salvador from Fred TV.
In
Out
1:49
With that, we have our old business news.
In
Out
1:53
Our first one is the roadway reconstruction, Spring Street, Section 66-185 City Ordinance, considering the roadway reconstruction plan and profile of Spring Street.
In
Out
2:07
It was voted to table this reconstruction on September 9th, 2025.
In
Out
2:12
Dan, could you please proceed with where we are with this project?
In
Out
2:16
So we received revised plans and supplemental information on August 26th.
In
Out
2:20
We sent that package to the Department of Community Utilities for review.
In
Out
2:25
We did finally get comment back from them at about 11:50 today.
In
Out
2:29
I did at that point send over a concise set of comments, which you have in your package, that email to the applicant with some outstanding items that need to be addressed.
In
Out
2:41
Some of them are fairly technical engineering.
In
Out
2:44
Some of them are more logistical.
In
Out
2:48
But I think it would probably be good to have the applicant provide the a small presentation of where they're at, and then we can talk about the comments that need to be resolved.
In
Out
2:56
Okay.
In
Out
2:57
Could the individuals please come forward?
In
Out
3:05
Please state your name, address, and the project, please.
In
Out
3:11
Thank you, Mr.
In
Out
3:11
Chair, members of the board, Mr. Raghiar.
In
Out
3:15
There you go.
In
Out
3:16
Thank you.
In
Out
3:16
Madam Clerk, for the record, my name is Arthur Frank.
In
Out
3:19
I'm a lawyer with address of 209 Bedford Street, Fall River, Massachusetts.
In
Out
3:23
I represent the applicant, Tiverton Investments, LLC.
In
Out
3:27
The principals of Tiverton Investments are here tonight, David Malkin, Samuel Malkin, and Mark DeMello.
In
Out
3:35
And with me also is the engineer, Bill Smith.
In
Out
3:38
What Mr. Aguiar had earlier stated is correct.
In
Out
3:42
There's been various exchanges of information these past few months, and this morning he was able to get us 7 bullet points that have to be addressed.
In
Out
3:53
So, not being an engineer, I'm going to defer to Mr. Smith to answer them as best as he can, and I'll help him out if he needs some help.
In
Out
4:01
Perfect, thank you.
In
Out
4:01
Good evening.
In
Out
4:02
Bill Smith from Civil Engineering Concepts.
In
Out
4:05
Nice to be back before you.
In
Out
4:07
We did make some changes to the plan that you previously saw.
In
Out
4:13
And essentially, we have met with the town of Tiverton, since this— let me refresh everybody's memory.
In
Out
4:24
Bolduc's Lane comes down from Crandall Road, heads this way.
In
Out
4:31
Bolduc's is improved.
In
Out
4:33
It's paved.
In
Out
4:34
It's 10 to 12 feet in width to a point.
In
Out
4:39
The state line, City of Fall River, Town of Timberton, line is right through here.
In
Out
4:45
Our clients have some property on the Tiverton side of the state line.
In
Out
4:52
The access would become from Bolduc's, across approximately 240 feet of Fall River, and then it would get into the Tiverton property.
In
Out
5:03
There's another 200, close to 300 feet to complete the Spring Street extension.
In
Out
5:12
So, a total of roughly 550 feet of roadway is being proposed to provide frontage for the Diverton lots and access for those lots.
In
Out
5:22
This was part of a turn-of-the-century subdivision called Stafford Heights.
In
Out
5:27
All of these lots, right-of-ways, roadways, those are all existing.
In
Out
5:33
We're trying to improve what was previously subdivided.
In
Out
5:39
And that's, that's kind of where we were.
In
Out
5:40
We had discussions about stormwater.
In
Out
5:44
We did some soil testing at Dan's request.
In
Out
5:47
Those results were satisfactory.
In
Out
5:50
We adjusted the design a little bit.
In
Out
5:52
And we are proposing a pervious asphalt surface with a reservoir course and the various requirements that make up the pervious asphalt.
In
Out
6:09
Rhode Island and Massachusetts have slightly different details on their standards, so we've incorporated both standards.
In
Out
6:18
So, the Massachusetts work will be done to the Massachusetts stormwater standards.
In
Out
6:22
The Rhode Island work will be done to the Rhode Island stormwater standards.
In
Out
6:27
And they'll essentially be seamless at the state line, so there won't be any elevation differences or anything substantial there.
In
Out
6:43
The roadway itself is to act as our infiltration component, so any water that falls on the roadway will percolate down through.
In
Out
6:53
Go into the reservoir course, and then ultimately infiltrate into the underlying ground.
In
Out
7:00
So, we do have some stormwater attenuation to make sure that our post-developed road meets the pre-developed water standards on the property.
In
Out
7:12
I can quickly go through those 7 items and try and respond to Dan's comments.
In
Out
7:19
The first one had X— actually, it's a multi-part comment, but proposed method of stormwater mitigation is unacceptable.
In
Out
7:27
So what we're proposing is that we use the pervious asphalt.
In
Out
7:32
And again, the— we'll have soil and vegetation on the sides of that where the pavement is, we will— it's porous, water pours through it.
In
Out
7:45
Infiltrates into the ground so that we don't have any excess water, or any water in excess of what runs off the property now.
In
Out
7:58
Presently, the topography kind of puts— it's a fairly small watershed, but it pushes everything down towards the southern intersection with Bolduc's Lane.
In
Out
8:07
And we are doing the same thing.
In
Out
8:10
Within our stormwater system, we've created check dams so that the water will actually be held in certain levels as it gets into the roadway.
In
Out
8:22
There's a slight slope to the road.
In
Out
8:24
It's approximately 2.3% at the maximum slope.
In
Out
8:28
So this will contain those water in those cells so that they do infiltrate into the ground.
In
Out
8:35
There's a question about the provided time of concentration is questionable.
In
Out
8:40
I've looked at that.
In
Out
8:42
We've looked at the numbers.
In
Out
8:44
I think it's consistent.
In
Out
8:45
I'll look at it again.
In
Out
8:46
We did have store well in excess of what we needed to meet our pre-developed runoff criteria.
In
Out
8:56
So, I think we were slightly overdesigned.
In
Out
8:59
But, I can look at that time of concentration number.
In
Out
9:04
Upgrading attenuation of runoff is possible on property owned by the applicant.
In
Out
9:09
If you look at the subdivision, there was a series of many small, small lots through here.
In
Out
9:19
So, there's not a lot of room.
In
Out
9:21
You can kind of see it up in here.
In
Out
9:25
But, these show one or multiple lots that are currently the assessor's designation.
In
Out
9:34
There's very little room to put the septic system, a well, and a stormwater system on, on the upgradient property.
In
Out
9:45
There was a comment about using the lateral streets for some of the stormwater attenuation.
In
Out
9:51
And if the board is okay with that, that's— that is an option for us as well.
In
Out
9:58
Because Spring Street intersects.
In
Out
10:04
So, Bullocks Lane, then we've got Beach Street, also known as East Street, Maple Street, and then Spruce Street.
In
Out
10:11
So, there's 3 sections of roadway.
In
Out
10:14
So, there's the potential to use some of that right-of-way on either side of the roadway to store some stormwater too.
In
Out
10:24
I think pervious pavement design that we've submitted meets the stormwater criteria.
In
Out
10:32
And, you know, I stand behind that.
In
Out
10:37
Collection and runoff disposal of such within the paper streets running perpendicular to Spring Street should be considered.
In
Out
10:45
I just kind of mentioned the possibility that there is some additional capacity that we could use there.
In
Out
10:51
But what that would do is it would prohibit any other development from occurring.
In
Out
10:59
All of this land on the Fall River side owned by the town, owned by the city, owned by individuals, so we might be taking away some of their rights.
In
Out
11:10
The roadside infiltration swales both west and east of the roadway should be considered.
In
Out
11:17
The roadway running north and south is 35 feet in width.
In
Out
11:22
East and west is 30 feet in width.
In
Out
11:26
Town of Tiverton is asking for us to have at least 20 foot of paved surface, plus 1 foot Cape Cod berm, so 22.
In
Out
11:34
By the time we have a shoulder on the side for safety, a drainage swale, and then try and regrade back to the adjacent grade, I think we're going to run out of room.
In
Out
11:46
Again, we'd like to use that pervious system that we've designed.
In
Out
11:52
If need be, we can do that.
In
Out
11:54
We might go back to the original infiltration system instead of having seepage pits.
In
Out
12:01
We could put a shallow stone trench or culverts or, you know, some sort of a stormwater device along the edges of the roadway.
In
Out
12:13
Again, I still feel that the pervious system is adequate.
In
Out
12:19
So, the use of porous asphalt specifically on greater than 2% slopes shall need to be discussed with the planning board.
In
Out
12:27
So, we are— our maximum slope is 2.3%.
In
Out
12:30
We have 1% where we meet the intersection.
In
Out
12:32
So, the short portion of that roadway is 2.3%.
In
Out
12:38
Normal standard, or maximum, is 5% for pervious asphalt.
In
Out
12:44
So, I ask you to accept our stormwater pervious system.
In
Out
12:56
The response to the existing way characterization is unsuitable.
In
Out
13:00
Dan clarified that for us just a few minutes before.
In
Out
13:04
So, Bullock's Lane is approximately 10 to 12 feet in width.
In
Out
13:08
It's paved.
In
Out
13:11
On the Tiverton side of it, the town maintains the road.
In
Out
13:15
They plow the snow.
In
Out
13:15
They pick up trash.
In
Out
13:17
On the Fall River side, it does turn to gravel.
In
Out
13:23
Trash collection is done by the city.
In
Out
13:25
In fact, they use this portion of Spring Street as to turn around to come in and out.
In
Out
13:31
Both Tiverton and Fall River have had a small section in here that was used for, like, a T-type turnaround.
In
Out
13:40
So, it is being maintained.
In
Out
13:43
Emergency calls are being handled.
In
Out
13:46
We agree that it's not perfect, but it is a system that is working.
In
Out
13:57
The Bolduc's Lane shall be improved to the same standard and shall be located within the right-of-way.
In
Out
14:02
A small portion of Bolduc's Lane strays from the actual platted right-of-way, as you can see on the east side over here.
In
Out
14:13
I think what's being requested is that Bolduc's be built to whatever we're ultimately end up with constructing here the 20-foot-wide paved surface up through here.
In
Out
14:30
Again, this portion on the Fall River side is existing.
In
Out
14:39
It certainly has adverse possession, if that's the right terminology, that it's It's there now.
In
Out
14:49
I think our clients would prefer not to, but if we had to, we would consider improving that section of Bolduc's between Spring Street and the Timberton Line.
In
Out
15:07
Ongoing maintenance responsibility of the proposed roadway and system of drainage is not been secured.
In
Out
15:13
So, I think at the end of the day, both Fall River will want to see, as will Tiverton, some sort of a road owners association to maintain the road.
In
Out
15:24
As a pervious driveway, or pervious roadway, it needs to be swept periodically to make sure that the fines don't get in the voids, so that it functions properly.
In
Out
15:39
So, there will be documentation that will be put in place for that.
In
Out
15:47
Dan indicated he will not recommend waiving the roadway monuments.
In
Out
15:52
So, the reason that we asked for the waiver on that is my land surveyor is registered in Rhode Island.
In
Out
15:58
He hasn't gotten his Massachusetts registration yet.
In
Out
16:01
We can do that.
In
Out
16:02
We'll get a Massachusetts surveyor to assist us.
In
Out
16:05
And we'll set the monuments that you've requested.
In
Out
16:11
And then the question was, has the approval from the Town of Tiburon Planning Board and Tiburon Fire Department been obtained?
In
Out
16:17
So we have met with Tiburon, discussed the project with them.
In
Out
16:21
They basically sent us to you and said, you know, get your blessing from Fall River, and then we will entertain your application.
In
Out
16:33
So, they basically put us on hold until, hopefully, you folks can make a decision for us.
In
Out
16:45
I'm happy to answer any questions you might have.
In
Out
16:49
First and foremost, I'd like to have Dan just kind of do an overview.
In
Out
16:54
We did receive these plans.
In
Out
16:55
We did have some recommendations.
In
Out
16:57
Of how to proceed with it.
In
Out
17:00
But, it seems to me like you tried to address some of those questions within a day, but I don't even know if the city's engineering or site plan approval process or anything of that nature has been kind of gone through.
In
Out
17:14
No, we haven't got anything back since these comments went out, which was only today.
In
Out
17:18
But, just to hit on a couple of them, I don't think Although I'm not opposed to porous asphalt, it's not a surface that's really allowed by your regulations.
In
Out
17:29
So a waiver of not being paved is something that we've got to deal with, the maintenance issue of it all.
In
Out
17:35
I have a concern about porous asphalt does not capture and infiltrate all rainwater.
In
Out
17:42
So there will be storm events where this water will now be channelized through this roadway section and run to the intersection of Bolduc.
In
Out
17:49
And will most likely either puddle there, will continue on to another abutter's property, Mr. Bolduc, who owns the property across the street.
In
Out
17:58
So I just want to make sure that if water is going to be making it to Bolduc, what's happening when it does hit Bolduc.
In
Out
18:06
Some of the different creative ideas of how drainage can be handled here, I'd be more than willing to sit and meet with the engineer and the applicant to discuss some different ways of handling this.
In
Out
18:17
It's not all that different from Monarch and Bach that we also have on tonight's agenda about ways of— and when I talk about utilizing the perpendicular right of ways, it's not for the storage.
In
Out
18:29
It could be for— you could collect water in intervals upgradient with a set of catch basins and discharge them into a swale at some point in the intersecting streets.
In
Out
18:41
To be a little bit more conventional within the right-of-way.
In
Out
18:46
I don't think— we could do this exact same thing on another project that's also on tonight's agenda, but I don't see them here tonight.
In
Out
18:53
So I think there are different ways of trying to wrap your head around what are we doing drainage-wise.
In
Out
18:59
I don't think we can just count on porous asphalt, which has incredible maintenance responsibilities, to be the save-all here.
In
Out
19:08
We use it in the City of Fall River more so not to trigger a lot coverage issue.
In
Out
19:14
But as far as relying upon that for stormwater runoff, it's never happened, especially on a street.
In
Out
19:23
So I do have some concerns about that.
In
Out
19:25
So, I mean, it would be my recommendation that we could sit and have a conversation about it.
In
Out
19:29
I would really like to know what Tiverton thinks about the 12-foot way of Bolduc Lane.
In
Out
19:35
And extending from that and adding more homes to, to a 12-foot way.
In
Out
19:41
So I would not, I would not— I mean, if at any point you wanted to consider a conditional approval, it should be based upon Tiverton's assessment of Bulldog Lane.
In
Out
19:51
Just my— I've worked with all of these types of materials before.
In
Out
19:55
We usually use them in parking lot areas or the main drive area because it does get salt, it does get plowed.
In
Out
20:01
It does get— it has to be maintained.
In
Out
20:04
The lots themselves, they use that for various material.
In
Out
20:08
But, I think at this point, that there were a bunch of questions that I think it'd be a little unfair to— I would suggest that we table this particular matter until these questions are vetted out between the engineer and them.
In
Out
20:27
Dan Aguiar, that is.
In
Out
20:29
And then what we can come up with is, you know, what is the process?
In
Out
20:35
We're the horse before the cart scenario, and then go back to the city, or the town of Tiverton, and say this is the direction that we would like it to be, and then figure out from that point.
In
Out
20:49
But, you've done a significant amount of work here, On this.
In
Out
20:53
I think there's just some pieces that we'll get there.
In
Out
20:56
There's no, there's no doubt about it.
In
Out
20:57
But one of the concerns, and I don't know if you watched last night's City Council meeting, but this has been going on for about 6 months.
In
Out
21:03
Not an identical situation to this, but off of Aruta's Lane, which is just up off of Stafford Road, which feeds down into Greenleaf and Judge Street in the city of Fall River, we have a series of streets, Judge and Greenleaf, with about 20 residents on the South Wachusett Pond that is accessed by a laneway that runs through Aruta's Dairy Farm.
In
Out
21:26
The homeowners in, in that development are now looking to the city of Fall River to maintain the 1 mile, over 5,000 linear feet of farm road that provides access to their property.
In
Out
21:40
Um, so we're, we're in the middle of that right now.
In
Out
21:42
So I want to make sure that this does not become that.
In
Out
21:45
It's a little bit different here because we're dealing with the right-of-ways, and— but we want to get— and Tiverton turned their back on these people.
In
Out
21:52
Sure.
In
Out
21:52
I deal with this all the time, as you know.
In
Out
21:55
And I, again, not only does it need to be communicated between the two, but there needs to be items in place legally binding that, you know, who's going to maintain it, who's going to do emergency response operations.
In
Out
22:08
And again, I think at this point, I would recommend, we've heard this, I would recommend that we table this until the next meeting.
In
Out
22:18
And hopefully between now and then, that you guys can come up with your given solutions.
In
Out
22:23
And ultimately, we're going to inherit it.
In
Out
22:26
Dan's going to inherit it.
In
Out
22:27
The maintenance department's going to inherit whatever it might be.
In
Out
22:30
And so, I think we need to have his blessing.
In
Out
22:33
Because what will happen is once everybody in this room is gone, one of those homeowners will come to the City Council of Fall River and petition for these streets to become accepted streets where we maintain them, we plow them, we pick up trash, all things that we shouldn't be doing already, but we do.
In
Out
22:50
And then homeowners become incredibly entitled that, no, you have to.
In
Out
22:54
Well, no, there's a difference.
In
Out
22:55
Are we legally bound to, or do we do it just to be good people?
In
Out
22:59
So we want to make sure that all those items are addressed.
In
Out
23:02
I'm available whatever time and date you want to meet as a group, as early as tomorrow, Friday.
In
Out
23:07
So, I mean, I don't want this to go on another meeting.
In
Out
23:10
I want to get this resolved.
In
Out
23:11
And I honestly think a 30-minute conversation can get that resolved.
In
Out
23:16
If you've got time tomorrow, Dan.
In
Out
23:17
I do.
In
Out
23:17
What time do you think is good for you?
In
Out
23:19
I'll talk to Bill.
In
Out
23:20
Bill's the busiest one out of all of us.
In
Out
23:23
Well, maybe other than Arthur.
In
Out
23:23
He's got to come up with solutions, answers, and get them back to you.
In
Out
23:27
Tomorrow is Would Friday work better?
In
Out
23:29
Friday could.
In
Out
23:30
I have a— currently I have a 9 and a 10, but other than that I can be available on Friday.
In
Out
23:35
1 o'clock?
In
Out
23:35
You're killing me on a Friday, but that's fine.
In
Out
23:37
No, for you, I'll be here at 1.
In
Out
23:38
11 would be better.
In
Out
23:42
Yeah.
In
Out
23:42
Can I— again, but what you both said, I agree.
In
Out
23:45
And again, number 5, the ongoing maintenance, maybe the developer will consider turning the street over to the town of Tiverton.
In
Out
23:52
At least that would be one less headache to 20 years from now.
In
Out
23:55
Yeah, Tiverton will never accept this.
In
Out
23:56
They won't take up that road in Massachusetts.
In
Out
23:59
They never will.
In
Out
24:00
Yeah, different standards.
In
Out
24:02
And it's not— how long is Bolduc now, linear footage, out to Crandall?
In
Out
24:07
Oh boy, that's just rough.
In
Out
24:10
But at least, at least the maintenance, about 1,000 feet.
In
Out
24:12
And that, and that's, that's private as well, right?
In
Out
24:15
They're actually plowing and maintaining it.
In
Out
24:17
That again, we'll go back to my comment, 30 visits.
In
Out
24:21
Just because they do it doesn't mean it's their responsibility or their street.
In
Out
24:25
Is it an accepted street in Tiverton?
In
Out
24:27
An accepted way?
In
Out
24:29
I have to fight that argument with the council.
In
Out
24:33
I believe the Tiverton police chief lives on Bulldog, so— oh, there you go.
In
Out
24:38
So for now, we're okay, right?
In
Out
24:41
But no, but if the board does— but if the board does want to, you know, I don't want you to rush and act on it tonight and not be favorable.
In
Out
24:49
So if you want to request that the matter be tabled, I'll make sure that I'm available to— I'm not comfortable.
In
Out
24:57
I think there's too much outstanding.
In
Out
24:58
I think it can be worked out, no problem.
In
Out
25:00
Okay.
In
Out
25:00
But I don't know.
In
Out
25:02
I'm not— Orlinda, Beth, I don't know.
In
Out
25:05
What are you guys thinking?
In
Out
25:06
I'm agreeing with you.
In
Out
25:07
It's a little bit of a nonce.
In
Out
25:10
Yeah.
In
Out
25:10
I mean, this feedback is great, Dan, but I think you have an opportunity to address all the issues.
In
Out
25:17
Should be okay.
In
Out
25:17
Yeah.
In
Out
25:17
Isn't that why they are having a meeting on Friday at 11?
In
Out
25:20
Yep.
In
Out
25:21
To discuss.
In
Out
25:22
Yeah.
In
Out
25:23
Can I have someone motion to table?
In
Out
25:25
Make a motion we table this to the next meeting in October.
In
Out
25:28
Second.
In
Out
25:29
Second.
In
Out
25:30
Roll call, please.
In
Out
25:31
Yes.
In
Out
25:32
Yes.
In
Out
25:33
Yes.
In
Out
25:37
Friday at 11.
In
Out
25:38
Mr. Chairman, is there anybody in the audience that had any comments so that we could— Is there?
In
Out
25:43
Yeah, I apologize.
In
Out
25:44
Is there anybody in the would like to make a comment at this point?
In
Out
25:48
Usually we wait till the end, but that's okay.
In
Out
25:50
Why don't we do this right after your presentation?
In
Out
25:52
Is there anybody here that would like to speak for or against the project, or even our decision?
In
Out
26:01
Just wanted to— we do.
In
Out
26:03
We know everybody and what they're here for.
In
Out
26:05
Yeah.
In
Out
26:06
Thank you.
In
Out
26:08
Thank you.
In
Out
26:08
Thank you.
In
Out
26:08
We'll see you guys on Friday.
In
Out
26:10
Thank you.
In
Out
26:10
Appreciate it.
In
Out
26:10
5 of them will leave.
In
Out
26:11
Thank you very much.
In
Out
26:12
Thank you.
In
Out
26:46
Thank you.
In
Out
26:47
Thanks again, Bill.
In
Out
26:48
Thank you.
In
Out
26:50
Okay, for old business item number 2, which is the roadway reconstruction vacant wooded lot off of Bark Street, Norwood Street, and Larnach Street, Section 66-1.
In
Out
27:05
185 City Ordinance considering the roadway reconstruction application for the vacant wood lots off Clark Street, Norwood Street, and Monarch Street.
In
Out
27:16
Dan, can you give us an overview of this, please?
In
Out
27:18
So after the last meeting, if you recall, we had— didn't— Alex didn't give much of a presentation because he was in the process of revising plans with our initial comments.
In
Out
27:29
He sent back in what I would consider a draft conceptual plan and the ideas that he wanted to implement, not a full set of drawings that could be technically reviewed and comments provided.
In
Out
27:42
We had sent a copy of that to DCU just for their initial comments.
In
Out
27:45
We have not received them back.
In
Out
27:47
I can tell you what he did submit wasn't sufficient to me in the proper direction, so I've asked them to similarly, as the last project, sit down, let's discuss how we can move forward in an expeditious way and make sure that we have all I's dotted and T's crossed engineering-wise before you're asked to act on that.
In
Out
28:05
So with that, the applicant's actually not here this evening, and I would recommend that we table the matter until they can provide a complete set of plans that can be reviewed.
In
Out
28:15
Okay, so I would make the recommendation— I do, we do have one neighbor here.
In
Out
28:19
Do you have any other questions you want to add?
In
Out
28:22
So again, before the next meeting, if you want to call even before, we'll let you know, is anything submitted?
In
Out
28:28
Are we even close?
In
Out
28:29
Just so you don't have to come out again.
In
Out
28:31
Okay.
In
Out
28:31
Just a question for you.
In
Out
28:33
Would it be advantageous if you wanted to speak upon this, either for or against it?
In
Out
28:38
And so perhaps whoever is watching this could perhaps maybe try to address whatever concerns you have.
In
Out
28:44
No, we did last month.
In
Out
28:45
My husband spoke last month.
In
Out
28:47
Yeah, do whatever you want.
In
Out
28:49
Okay.
In
Out
28:50
All right.
In
Out
28:50
With that, then could I have a motion to table this until the next meeting?
In
Out
28:54
I'll motion to table until the next meeting.
In
Out
28:56
I'll second.
In
Out
28:58
Orlando second.
In
Out
29:00
Roll call.
In
Out
29:01
Beth?
In
Out
29:02
Yes.
In
Out
29:03
Gloria?
In
Out
29:03
Yes.
In
Out
29:04
Orlando?
In
Out
29:04
Yes.
In
Out
29:05
And Michael Ferris?
In
Out
29:06
Yes.
In
Out
29:07
We'll table it to the next meeting.
In
Out
29:11
Item number 3 under old business.
In
Out
29:13
We have the King Phillips Estate subdivision, Princeton Circle, request to release lot 1 through 14 in exchange of a letter of credit from Bay Coast Bank.
In
Out
29:24
Do we have anybody here in the audience to speak about?
In
Out
29:27
Yes, Sean Ainsworth from Insight Engineering.
In
Out
29:32
Introduce yourself.
In
Out
29:33
Robert Kofori, the owner.
In
Out
29:35
Very good.
In
Out
29:36
Dan, could you give us an overview?
In
Out
29:38
Sure.
In
Out
29:38
So Mr. Cafari and his consultants submitted an interim roadway as-built a few weeks ago.
In
Out
29:46
It has been through review through the Department of Community Utilities and mine as well.
In
Out
29:50
It was not intended to be a final construction as-built.
In
Out
29:52
It's for the purpose of reviewing what's been constructed, what still needs to be constructed, so that an estimate can be prepared so that Mr. Cafari's bank could provide a letter of credit to cover the costs of those items in order for us to release the original covenant for the subdivision, which precludes Mr. Cafori from selling any of the lots in the subdivision until either the roadways are complete or until surety is posted.
In
Out
30:19
So the mechanism that we're at now is, after review, we've recommended a letter of surety in the amount of $200,000 with— I've itemized the outstanding items, which I had given to Mr. Cafori.
In
Out
30:31
He, in turn, gave to his bank.
In
Out
30:35
That would be the work that still needs to be cleaned up to determine that the subdivision is 100% complete.
In
Out
30:41
In your package, you will have a letter of credit, irrevocable letter of credit from Bay Coast Bank in the sum of $200,000.
In
Out
30:48
It goes through all of the rigmarole of what it covers and what its intention is, which is standard for what this planning board has received in approved in the past.
In
Out
31:00
With that, you will also see from Attorney Mark Levin is a release of the covenant that had previously been recorded.
In
Out
31:10
I know there's a bunch of documents in your package.
In
Out
31:13
We wanted to make sure that you did have everything from the original subdivision decision, copies of the recorded plans, copy of all of the easements.
In
Out
31:21
All of these items have been reviewed by my office as well as Department of Community Utilities to make sure that they were all done in accordance with the approval of this board back in 2019.
In
Out
31:32
So if you have any questions, I'd be more than glad to answer them.
In
Out
31:36
But with what we're— where we're at now, I would recommend that we accept the letter of surety and release the covenant.
In
Out
31:44
So this is, in reality, this is just kind of preliminary plans, pretty well in advanced in order to show the cost to your bank, your lender.
In
Out
31:56
Will you— a couple questions for you, Dan.
In
Out
32:00
Will these become public roads at any point in this development or this process?
In
Out
32:07
The applicant, the applicant or 10 registered voters have the ability to petition for these to become accepted.
In
Out
32:17
So once this, once this is completed, at that point, the applicant has the ability to petition the city through the City Council for acceptance.
In
Out
32:25
It's not just an automatic thing.
In
Out
32:28
When subdivisions get completely constructed, and even if they're constructed to 110% of what they were supposed to, fantastic.
In
Out
32:35
But there is a process for them to become city streets.
In
Out
32:39
That's a separate process.
In
Out
32:40
That, that's why you'll see them come back to you for recommendation.
In
Out
32:43
Once the City Council process begins, then we have to review it.
In
Out
32:47
And say, yeah, so it starts here.
In
Out
32:49
We say everything's been done fine.
In
Out
32:51
Then the applicant, maybe a few months later, goes through the city council process, comes back to us.
In
Out
32:56
They want to make sure that you're okay with it, and then it goes through the rest of the process.
In
Out
33:00
Okay.
In
Out
33:00
And then the other question I had— I did review all of this before I came here— and, um, the $200,000, is that what you think the cost is for the full construction, or is that just part of the That is the cost of complete construction, 100%.
In
Out
33:16
And that complete construction is up to— if we were to take over the city, if the city were to take over this road at some point down the line, that you feel like there's— it's— they have addressed the design guidelines and criteria that are needed.
In
Out
33:34
So 2 different issues.
In
Out
33:35
When you say if the city were ever to take over the road, Well, the standards of where— what they're proposing here, would they meet the standards of the city in your review?
In
Out
33:45
Well, these standards are based upon the subdivision plans that were approved by this board.
In
Out
33:52
There are a couple of items that were not completed yet because the subdivision is not complete.
In
Out
33:58
Sure.
In
Out
33:58
So this is what it would— this is what it would cost for Mr. Caffori to complete the subdivision construction.
In
Out
34:06
The letter of surety gives us surety that if Mr. Caffore defaults, leaves and defaults on the remaining work, we have the ability for the bank to provide us the funds of $200,000 to complete these items in the subdivision.
In
Out
34:24
That's what the process is.
In
Out
34:25
Can I say something?
In
Out
34:26
Sure.
In
Out
34:27
I just want to clarify that the subdivision roadway sewer line, water line, gas line has been installed, and the roadway has been paved.
In
Out
34:38
The only significant thing that needs to be done is paving the second coat in the entire subdivision.
In
Out
34:45
That's a big item.
In
Out
34:45
That's $75,000.
In
Out
34:47
Yes.
In
Out
34:47
The rest of it— there are a few other things too.
In
Out
34:50
I mean, some of the drainage needs to be— they have this list.
In
Out
34:53
Yeah, yeah.
In
Out
34:54
So the subdivision is built is what I'm trying to say, and there's 2 houses building this subdivision.
In
Out
34:58
And if I'm not mistaken too, I'm sure that Dan added the 20% above.
In
Out
35:05
So basically the price to finish the road wouldn't be $200,000.
In
Out
35:09
I mean, there's a 20% contingency in there, obviously, for interest rates and so on and so forth, and material costs, whatever.
In
Out
35:17
And I have a heavy pen when it comes to that.
In
Out
35:19
And he does have a heavy pen.
In
Out
35:21
I reviewed the estimate.
In
Out
35:25
The estimate itself was kind of heavy in my mind, but no, Bob accepted it.
In
Out
35:33
And yeah, well, God knows we're accepting it because our intention is to finish the road and do a beautiful subdivision.
In
Out
35:38
That's the end result, and build beautiful homes.
In
Out
35:40
Yeah, that's what we're after.
In
Out
35:41
So the $200,000, a little heavy, but if we're willing to do the work according to the city standard, we're fine.
In
Out
35:47
And once— just like we have in other subdivisions— once a portion of this work gets done Mr. Cafuri can come back in and ask for an amended letter of credit.
In
Out
35:55
He comes in and he's done everything but $20,000 worth of work, then we can release it.
In
Out
36:00
The bank provides us the funds to complete what's ready to complete.
In
Out
36:03
So along the way, there are— there is the ability to reduce this, this amount of money.
In
Out
36:06
Part of these questions that I do ask is less for us and more about the general public when we do these things.
In
Out
36:13
Of course.
In
Out
36:14
And so that's why I'm making sure that— but one more thing I want to mention.
In
Out
36:18
The city requires to hire a consultant that we pay for, that supervises every aspect of the road being constructed.
In
Out
36:26
Sewer line, they provide pictures, reports, water lines, so on and so forth.
In
Out
36:31
So it's, it's an extensive thing, and that's how the city protects their interest of what we're doing.
In
Out
36:37
Thank you.
In
Out
36:38
So I appreciate that.
In
Out
36:39
No problem.
In
Out
36:40
Everything that's been done to date has been done correctly.
In
Out
36:45
I am.
In
Out
36:46
Well, with that being said, I think we should approve, approve this, but I can't make a comment, Chair.
In
Out
36:56
I just want to say, Mr. Kefori, you've done a lot of development in the city, and of course I know you want a development that looks good.
In
Out
37:02
Thank you.
In
Out
37:03
You know, so thank you.
In
Out
37:04
I have all the confidence in the world.
In
Out
37:05
Then again, the 20% that is added doesn't get done within 5 years, those costs may increase.
In
Out
37:11
So thank you, Dan.
In
Out
37:12
Oh, that's one you'll get emailed.
In
Out
37:13
Yeah.
In
Out
37:14
So I make a motion that we accept the letter of credit and we release the covenants, lots 1 through 14.
In
Out
37:23
Do I have a second?
In
Out
37:25
I'll second that.
In
Out
37:26
Roll call.
In
Out
37:27
Beth?
In
Out
37:28
Yes.
In
Out
37:28
Gloria?
In
Out
37:29
Yes.
In
Out
37:30
Orlando?
In
Out
37:30
Yes.
In
Out
37:31
And I, Michael Canarias?
In
Out
37:32
Yes.
In
Out
37:33
Thank you.
In
Out
37:34
I'll present the board with an original letter of credit.
In
Out
37:36
Okay, good.
In
Out
37:37
Signed by me.
In
Out
37:38
Only because the, um, the covenant release requires, uh, notary.
In
Out
37:44
So give me a day or so to get everybody in with the clerk to be able to sign these things on people's availability.
In
Out
37:50
As soon as I get it, I'm closing on Monday.
In
Out
37:52
That's okay.
In
Out
37:53
Okay, only— there's only Mike needs to sign, right?
In
Out
37:56
Well, the way that Attorney Levin wrote it, I know, I saw it says the majority of the planning board.
In
Out
38:01
If you want to edit that and say Yeah, because he has— I believe he has notice of records that he could sign for all of us.
In
Out
38:08
I, I don't disagree, and that's why on subdivision plans and everything else, the chairman signature is okay.
In
Out
38:15
I just don't want this to go back to the bank signed, or this release, or to the registry, and the registry comes back and says to us, you need the majority, because that's what Attorney Levin wrote.
In
Out
38:26
Because I can notarize the signature and stamp it tomorrow, but Well, okay, that would be great.
In
Out
38:31
You can do everybody's signature if you want and stamp it tomorrow.
In
Out
38:33
1, 2, 3.
In
Out
38:34
I could do 3 of them.
In
Out
38:35
Okay, great.
In
Out
38:35
Okay, that's fine.
In
Out
38:36
Um, yeah, we only need 3.
In
Out
38:38
Yeah, that's fine.
In
Out
38:40
Perfect.
In
Out
38:40
That'd be great.
In
Out
38:42
All right, perfect.
In
Out
38:43
Thank you.
In
Out
38:43
See that?
In
Out
38:44
Thank you, everybody.
In
Out
38:46
I'll probably end up giving it to, uh, Dan in the office.
In
Out
38:49
Thank you very much.
In
Out
38:50
Yeah, we have to give that to the treasurer, so that's good.
In
Out
38:52
Thank you.
In
Out
38:53
Nice to see you.
In
Out
38:54
Don't lose it.
In
Out
38:57
We have nobody in the audience or here to speak against or for the project.
In
Out
39:04
So with that, we will say thank you very much for bringing this to us.
In
Out
39:08
Thank you so much.
In
Out
39:09
Thank you.
In
Out
39:09
Thank you.
In
Out
39:10
Thank you.
In
Out
39:12
You're welcome.
In
Out
39:14
Thank you.
In
Out
39:19
The fourth old business we have is Highland Woods subdivision request for full release of posted surety and therefore return of the original letter of credit on file with the City of Fall River.
In
Out
39:33
Dan?
In
Out
39:34
The review of that final as-built and construction has not been completed by the Department of Community Utilities or myself, so we'll have to kick that one down until, until we're ready for it.
In
Out
39:46
So may I have a motion Motion to table this for the next meeting.
In
Out
39:50
Motion to table.
In
Out
39:51
Yeah, you can just leave it till the next meeting.
In
Out
39:54
Second.
In
Out
39:54
I second.
In
Out
39:56
Roll call.
In
Out
39:56
Beth?
In
Out
39:57
Yes.
In
Out
39:57
Gloria?
In
Out
39:58
Yes.
In
Out
39:59
Yes.
In
Out
39:59
Orlando?
In
Out
40:01
And Michael Perez?
In
Out
40:03
Yes.
In
Out
40:04
Okay, that was— for new business, we have a Form A Application for endorsement of plan believed not to require approval for an ANR plan of land, file number 26-1685.
In
Out
40:27
The owner applicant, June Perry.
In
Out
40:29
Property location, 311 Crescent Street.

Out
40:32
Assessor's map lot C-07-0001.
In
Out
40:38
Then So this is a subdivision of an existing parcel of land that's 17,270 square feet located at 311 Crescent Street.
In
Out
40:48
It's an existing 3-family dwelling that's located at the corner of Crescent and Valentine.
In
Out
40:53
What this plan does is it subdivides Lot 2, which is frontage along Valentine Street, upwards of the existing home at 311.
In
Out
41:04
This parcel did need to get zoning relief.
In
Out
41:07
From the Zoning Board of Appeals, which it did.
In
Out
41:10
That decision was recorded at the Registry of Deeds.
In
Out
41:13
Notation of that is on the plan, and I believe that decision was also forwarded to all of you as well.
In
Out
41:18
The plan has been in accord— has been designed and submitted in accordance with what was provided and approved through the Zoning Board of Appeals.
In
Out
41:25
So with that, I would recommend that endorsement is allowed.
In
Out
41:32
I just had one question, Dan.
In
Out
41:35
Sure.
In
Out
41:35
I believe on the zoning, um, they were identifying the frontage for lot number 2 as Crescent Street.
In
Out
41:44
Would it not be Valentine Street?
In
Out
41:49
On the zoning decision?
In
Out
41:52
Yeah, I believe it was the zoning.
In
Out
41:57
Creating a new lot.
In
Out
42:00
You're correct.
In
Out
42:00
It does say on Crescent Street.
In
Out
42:02
That's right.
In
Out
42:03
Yeah, it wasn't.
In
Out
42:04
That should be Valentine.
In
Out
42:05
That's the only thing that I have.
In
Out
42:13
I wonder if they can write a scribner's error affidavit to fix that.
In
Out
42:16
You can.
In
Out
42:16
I can go to the.
In
Out
42:17
I'll go to the registry and see if they'll accept that.
In
Out
42:19
Yeah, whoever drafted this could just probably.
In
Out
42:22
Well, what happens is it comes.
In
Out
42:25
The attorney that submits.
In
Out
42:26
Yeah, in this case, I don't think it was an attorney.
In
Out
42:28
I think it was Jeff Tallman.
In
Out
42:29
So whatever they submit for requested relief is what it has to be.
In
Out
42:34
We can't change that, right?
In
Out
42:35
So when we read it, we did not pick up on that it was Crescent, or I did not, um, and that should read Valentine.
In
Out
42:42
But we can work towards resolving it.
In
Out
42:43
Hopefully it was an attorney.
In
Out
42:45
You sure it was not an attorney?
In
Out
42:46
No, it wasn't.
In
Out
42:47
Okay, because if you see, well, usually on there, I want to say it was, uh, I want to say it was Jeff Tallman did this on his own.
In
Out
42:53
Okay, because it's just a typo.
In
Out
42:55
He just made a mistake.
In
Out
42:57
Yeah, yeah, again, right.
In
Out
42:58
But the typo carried over onto our paperwork, which you're— which you're right.
In
Out
43:02
So the— so that myself and the 3 people that reviewed this after me didn't catch it either.
In
Out
43:07
So it happens.
In
Out
43:08
Mike, you're sharp.
In
Out
43:10
Sharp.
In
Out
43:10
Yeah, fixing it afterwards.
In
Out
43:18
But I just want— that was the only thing that I had a comment.
In
Out
43:20
Everything else, pretty much pretty straightforward.
In
Out
43:26
So how do you approach— how do you approve this?
In
Out
43:32
Or do you have this, you know, stipulation where that needs to be changed?
In
Out
43:39
How would you want to work that?
In
Out
43:41
I can't make the motion.
In
Out
43:42
I'm just making the observation somebody else has to make the motion, um, as chair.
In
Out
43:47
So what's the— legally, what would you think?
In
Out
43:51
I would go to the attorney for a scriptural error affidavit.
In
Out
43:54
Dan, what do you think in this situation considering who's the engineer?
In
Out
43:57
I don't— well, it wasn't— it doesn't matter if it was the engineer.
In
Out
44:00
It was— it's ours.
In
Out
44:02
My recommendation is that we endorse the plan and we can work towards getting the decision if— yeah, I'm sure the developers are going to want fixed right away so you could sell it.
In
Out
44:11
I doubt it.
In
Out
44:11
Yeah.
In
Out
44:13
No one else is going to pick it up.
In
Out
44:16
I'll guarantee it.
In
Out
44:17
But we'll— very good chance you're right.
In
Out
44:19
I will work towards getting it resolved.
In
Out
44:21
Yeah.
In
Out
44:22
I just don't want to kick the can down the road.
In
Out
44:24
And all of a sudden, why didn't you do what we noticed it?
In
Out
44:28
But as long as we have some caveat said in the statement, we approve it.
In
Out
44:33
Well, the variance plan Yeah, that this is based upon.
In
Out
44:37
Yeah, shows the 75 feet of frontage on Valentine Street.
In
Out
44:41
It does, but right, but it does— it's the, the, the, the written part of it in the decision says Crescent, right?
In
Out
44:48
But wait a minute, normally it says— and I don't know if that's the case, it's just a small error.
In
Out
44:58
No, no, if I was going to buy the land I found out that my front— so, so as it relates to item 1, a variance request, a motion was made by Mr. Sahadi and seconded by Mr. Kelly to grant the variance request in accordance with the plan of record, and that the driveways be shown shall be entirely impervious.
In
Out
45:18
So the first section is what they requested.
In
Out
45:22
The vote approves it in accordance with the approved plan which shows 75 feet of Valentine Street.
In
Out
45:30
So to make an argument, it wasn't for number 1, it was— well, again, item 1 is the request for a variance.
In
Out
45:38
The vote specifically references the plan of record.
In
Out
45:42
So item 1 doesn't say that we're granting what item 1 is.
In
Out
45:47
No.
In
Out
45:49
In, in my many years of experience in this, it's not something that I would be bothered about.
In
Out
45:53
But we can still move forward with getting— normally what we'll do in a situation like this is actually correct or even provide a corrected decision and get it recorded.
In
Out
46:05
As far as an endorsement for the ANR and the recording of that plan, I see no reason why that couldn't proceed.
In
Out
46:16
I'll motion to endorse.
In
Out
46:17
I'll second the motion.
In
Out
46:21
Yes.
In
Out
46:22
Gloria?
In
Out
46:22
Yes.
In
Out
46:25
Yes.
In
Out
46:26
Yes.
In
Out
46:27
And Michael Perez?
In
Out
46:27
Yes.
In
Out
46:29
With, I guess, the condition that we get things.
In
Out
46:35
All right, thank you.
In
Out
46:44
Item number Number 6, or actually number 5 of the new business is proposed 2027 planning board meeting schedule review considerations and proposed planning board meetings dates for the calendar year of 2027.
In
Out
47:08
So these are all based upon, again, being the second Wednesday of every month unless a holiday kicks things over.
In
Out
47:14
But, as you know, at any time during the year, if we have an issue with not being able to provide a quorum, we're flexible.
In
Out
47:22
We normally don't have items on the agenda that require public notification or legal advertisement.
In
Out
47:28
We're just dealing with A&R plans.
In
Out
47:29
So, if any time you want to schedule a vacation, or you come up with something, just let us know as soon as you can.
In
Out
47:34
And, if we need to change the date of a meeting, we can do that.
In
Out
47:38
But, we are required to submit this to, to the clerk's office just to have on file so they can reserve the room.
In
Out
47:44
You wouldn't believe what it's like trying to get this room when you want to change the date.
In
Out
47:49
That's right.
In
Out
47:49
Yeah.
In
Out
47:53
So, okay.
In
Out
47:57
Is everybody okay with setting it how we've been doing it?
In
Out
48:00
Yes.
In
Out
48:02
So can I have a motion to approve?
In
Out
48:04
Motion be scheduled for 2027 for the planning board meetings.
In
Out
48:09
I second the motion.
In
Out
48:11
Roll call.
In
Out
48:11
Beth?
In
Out
48:12
Yes.
In
Out
48:12
Gloria?
In
Out
48:13
Yes.
In
Out
48:13
Orlando?
In
Out
48:14
Yes.
In
Out
48:15
And Michael Ferris?
In
Out
48:18
Yes.
In
Out
48:19
Item number 6, approve meeting minutes from August 12, 2026.
In
Out
48:27
If you need a moment to read through them, give me a minute.
In
Out
48:32
Do I have a motion to approve the meeting minutes for August 12th, 2018?
In
Out
48:56
A motion to approve the meetings— I mean, the meetings— the minutes from the last meeting.
In
Out
49:04
I approve all the meetings.
In
Out
49:07
I second the motion.
In
Out
49:08
All right, roll the call, please.
In
Out
49:10
Beth?
In
Out
49:10
Yes.
In
Out
49:11
Gloria?
In
Out
49:11
Yes.
In
Out
49:12
Orlando?
In
Out
49:13
Yes.
In
Out
49:13
And Michael Ferris?
In
Out
49:16
Yes.
In
Out
49:18
Item number 7, citizens input, 3 minutes per citizen.
In
Out
49:22
We've had people speak on associated with projects already.
In
Out
49:27
We have nobody in the audience.
In
Out
49:28
So with that, can I get approval for citizens' input and close?
In
Out
49:33
Make a motion to close citizens' input.
In
Out
49:36
I second.
In
Out
49:37
Beth, we have to have a roll call, please.
In
Out
49:40
Yes.
In
Out
49:41
Gloria?
In
Out
49:42
Yes.
In
Out
49:43
Orlando?
In
Out
49:43
Yes.
In
Out
49:44
And Michael Farage?
In
Out
49:45
Yes.
In
Out
49:47
Can I make a motion to adjourn?
In
Out
49:49
Motion to adjourn.
In
Out
49:51
And a second?
In
Out
49:53
Second.
In
Out
49:54
Yes.
In
Out
49:54
Gloria?
In
Out
49:55
Yes.
In
Out
49:55
Orlando?
In
Out
49:56
Yes.
In
Out
49:57
Thank you very much.
In
Out
49:59
Thank you all.
In
Out
50:00
Have a great night.
In
Out
50:01
You also.

Out
