Meeting of for licensing board uh will come to order Tuesday, October 14, 2025.

Um to my right is Michael Pereira, Commissioner Melanie Cadero, Commissioner. My name is Greg Brilliant.

I am the chairman of the board. Um we'll get started. Excuse me. Apologize. U pursuant to the open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting to any media.

Attendees are therefore advised that such accordance or transmissions are being made whether perceived or unpersceived by those present and are deemed acknowledged and permissible. The city charter section 9-18 mandates that all multiple member bodies develop and adopt rules all policies for public comment. We have adopted such a policy which in short provides for citizens input and license board specific matters

at the beginning of the meeting. There's a sign sheet is located in the back of the room. That will bring us to agenda item A which is public input. Do we have anyone? I'm a lawyer. My office address is 550 Locust Street in Fall River. Uh with me are my clients Tanya and Joshua, brother and sister and proprietors of this new uh proposed restaurant at the former Leage Seafood.

U so by way of background, 439 Martine is the former Leages. Tanya and Josh operate the Black Salt in Swansea.

They're looking to open at this location at 439 Martin. There was an available all alcohol license for which we applied under the name of Ankor and Stone LLC which is a newly formed limited liability company I created to take title and uh there's also a separate real estate purchase and sale agreement to acquire the real estate. Um the applicant is asking the board to approve the hours of 8 a.m. to 1:00 a.m.

Uh knowing that we can't serve alcohol on Sundays until 10 a.m.

Seven days a week.

And the proposed manager in the application is Tanya Novo.

Uh and also Mr. Billion uh alluded to the fact that this is also a request for a pledge because they're going to go through Bakos Bank and part of the commitment letter is a pledge of the liquor license. So in the application I've checked that box as well.

Okay. Obviously they have experience because they run the operation in Swansea.

Yeah. And before that many folks know them from Mesa 21 as well and Diamond Regional graduates, right?

I am. Yes.

All right. Um, under old business, new business, class 2 wholesale license board review, Lamar Grand Motors LLC, 99 South Main Street, James Sylvester.

Okay. The reason why we're back here, I believe, is because we voted on this last month, and I received a phone call that this particular gentleman in the address he listed, 99 North Main Street, was not a tenant.

South Main Street, I apologize. South Main is North was not a tenant.

And since that time, I'm told that he does not have a lease there. Is that accurate?

That's correct.

He does have a lease there.

Okay. What happened?

So, we wanted to open a business. We secure a representative. I believe this man is he does tax. He filled out all the paperwork for us and he provided the paperwork and he set up everything and gave James the green night to go and um appeared before you guys a month ago.

When he came in, we believe all of our paperwork were correct per him. He said everything was sorted. Unfortunately, he did not reach out to the place that he listed in the application. So, when the miss when Mrs. Um Carrie reached out to us um on the day James came to get the license. Um she asked for a copy of the lease. When we contacted him to give us the information, it turns out that he

didn't take any steps. So what I did, I reached out to the representative responsible for the building on that same Thursday. He wasn't able to set up an appointment with me because he had a few meetings. The following day was not going to work. We ended up going in on Monday. That's when um he agreed with James and um everything was sorted. Um they agreed on like a PO box because the

place that they had at the time was um too big. It was over 2,000 square ft and we're just starting and the rent would be roughly 2500. So um our lease is for two years. Um and he agreed that once he has a smaller place 400 square ft or less or more um available for us, we would transition from the PO box to the actual um location. But he gave us the

green light for to use the conference room when we have to meet with the people who purchased the car if we need to hold a meeting with them to um to sign the titles and etc. We have access to the uh So, I've never heard of it.

So, your your lease is for a PO box within the building, correct? Because the they don't have a um space ready like less than four what they have was over 3,000 square feet.

Do they have an expiring lease um and notice of that tenant vacating that you are currently waiting for or they just don't know when that's going to happen?

No, we are assigned for two years with them.

Um, for the PO box.

Not for a space.

Not for a space. But they with the PO box come access with the conference room just in case we need to meet with the people who are selling the car and uh sign the titles and then some.

Where were the cars located?

This is wholesale online.

Yes. I do have a a motion. The problem is we don't really need right now the office cuz you know I'm going to deal like with auction to auction and then dealer to dealer. Therefore when the dealer or if I need some paper from the DMV over here they might be seeing for me via the PO box. But the good thing the the owner over there taught us just wait until they have one less money.

Yes, we we got everything. They That's adequate for your business.

Yes. The same day on Monday we got everything and then I I left the the lease over there and then fifth floor everything.

But for that only 2500 it's it's a new business.

And then I'm going dealing you know when you buy it's a used car you know you you going to deal with auction to auction delay delay you not know make like more profit you know cuz we just knew when you knew.

So someone so someone views the vehicles online.

They purchase them and then they come and do the paperwork and the financing or whatever in an office over there.

We don't want to change anything. We want to leave it like that. That's why we just make made a contract with them for two years.

I'm nothing against him. I don't want to set a precedent that people come in here and have a wholesale license because they go get a PO box. What's the difference?

You do. Even if it's wholesale, you have to have an office in the uh zoning district that fits that type of business. So, they have to go to the building department.

Well, originally, Mike, I think it was on the agenda because the gentleman came in and said he had an office at 99. And I got a call from the landlord saying they didn't even know who he was. No disrespect to the gentleman. They said they didn't even know who he was.

He does have to have an office. I can tell you that everybody has to have an office for whether it's wholesale or on premise. So, if I were to second this and then it comes back that he technically needs an office, then what happens then?

Well, kind of look foolish because I'm we he does need an office.

I guess I'm looking for the I mean, the correct answer to this like not not an ad, not a PO box. He needs a place. The reason why I made the motion, just for full disclosure, is he he has the PO box, let's say, but he does have a place to work out of. He does I mean, it may not be a uh conventional office, but if he has access to that um if he has access

to that conference room, I don't think we should deny him his business opportunity in this in this country. So, I think I think he he's here. He wants a business opportunity. He has a place to work out of. he he uh um he's done the paperwork to the best of his ability and let him work out of that um that conference room until he gets that other little space over there or he finds

another place. I don't want to deny him his opportunity to to to earn and his business. So I think I think he has a spot to work out of which is that conference room.

All right. Well, I and I would if he had sole use of the conference room.

Yeah, that's the that's the other monkey wrench. I But he doesn't and he has to have a reservation and it has to be available for him to even use it. So if it's not available, he doesn't even have anywhere to go.

So I that's the problem that I have. If he had an exclusive use of a conference room, I understand this gentleman keeps saying that he's not going to deal with the conference room and he's just going to go auction to auction. You still have to have certain parameters to hold a license in the city of Fall River. To be just giving, in my opinion, to just give licenses out because someone has a

mailbox. I'm not going to do that.

Can we review it in six months or three months to see if he's got a he updated his office?

He needs to have an office.

I'm saying the conference room qualifies for an office even though he has to rent it. I mean, excuse me, schedule it.

I'm I'm all about giving people opportunity to bring business to Fall River and to have their business in Fall River. I just don't feel comfortable voting on something that our clerk is telling me is illegal.

And the reason why I know it is when I used to work for the uh for the attorney general's consumer division, we could never find the guy. Somebody wanted to sue him. He was nowhere in existence.
