all right welcome everyone to the uh Wednesday uh January 23rd meeting of the planning board pursuant to the open meeting February 14 February oh jeez that's when it was posted sorry February 14th I was reading up top 24 2024 pursuant to the open meeting by law any person may make an audio or video recording of this public meeting or may transmit the meeting through any media attendees are therefore advised

that such recordings or Transmissions are being made whether perceived or UNP perceived by those present and are deemed acknowledged and permissible the city Charter section 9 through 18 mandates that all municiple uh member bodies develop and adopt rules or policy for public comment we have adopted such a policy which in short provides for citizen input on planning board specific matters at the end of the meeting

there's a signup sheet that is located at the back of the room we'll do roll call glor Pico present Beth Andre not present Mario luciola here Mike farias pres and I John Ferrer I'm present as well uh we also have with us Nina Krueger the administrative clerk Chris Pano the assistant planner uh Dan agard the city planner and Craig Salvador from for River govern TV under new business first on the

agenda is assurity reduction for a Fieldstone Lane Brookfield Terrace and Stony Brook Circle review and discuss reduction request for Highland Farms 2 Fieldstone Lane Brookfield Terrace and Stony Brook Circle in your packages Mr chairman you'll see a letter of recommendation uh from me as city engineer after review of of the request the applicant was requesting a full release of the remaining 2200 plus

th000 we I recommend issuing about half of that U so a reduction of $2,870 180 requiring a new letter of credit in the amount of $3,472 if you look at the items that are still covering retainage it's basically just clean up work some loaming and seating that's not done because it's winter time um just a few little items to to button up before we issue a final release of all the

funds thank you uh any questions from the board on this one Kevin when do you think uh that'll be complete you think by year end spring so by December 2024 this should be oh yeah no I think they would be done soon as grass can grow oh good um some stuff like updating asilt plans getting a letter in saying that the monuments were set certified by professional land surveyor a lot of the

Gloria second on the agenda we got a repetitive petition from Sharon atano 298 King Street map B-12 lot two in accordance with Mass General law c40a and 16 and 86 through 486 of the Four River zoning bylaw the applicant requests that the Four River planning board make a determination that the submitt a submitted proposal contains specific and material changes in the conditions for which

unfavorable action had previously be taken by the for of zoning board of appeals on January 19th 2023 the applicant was denied a zoning variant to divide the existing parcel B-1 12- 000000 2 into three lots the new petition defers as it seeks to divide the existing parcel into two lots this property is located in an R4 two family zoning District Mr Aspen for members of the board attorney

grandfather of the U the children that I represent actually bought this property in several different purchases so we kind of added sub subsize lots to create this larer lot when we before the zoning board uh the families contemplating fixing up the house and getting rid of the property at some point um we went before the zoning board uh it was a lengthy very lengthy hearing uh last

January and um the petition was shot down it was I think it was a close vote on it um there was some comments from the neighbors for uh you know some congestion in the area but obviously it's a very unique lot I I think we do have the hardship for the variants it was suggested that we might seek a lesser um petition on this so that's why we're coming back it certainly is a a

much less uh a lesser petition two Lots now uh the variance is going to be decreased because we will no longer need an area variance we will just need a frontage variance for the new lot on Butler Street um it'll conform and every other way um the existing dwelling won't change that front lot is going to be lodged the back l on Butler Street is going to be 6,000 square ft so I would

suggest it is a it is a very specific and a material change in our original petition our request the board approv that it be sent back to the Zone board so we can have that uh that haing go forward all righty thank you Danny I would concur yeah I think it's pretty cut and dry that it's a substantial change from three lots to two lots anything else from uh from the board any other

applicant 847 to 864 Pleasant Street real estate LLC property location 847 Pleasant Street and 807 Pleasant Street assessors map k-4 lot 6 and 18 so this anr is really dealing with uh eliminating some encroachments and some areas where one landowner had occupied another uh thinking that he had owned it so it's kind of like a two-party resolution conveying a couple of parcels back and forth to to

eliminate those items um nothing with regards to zoning uh is required uh by the zoning board of appeals on this so it's afforded the anr endorsement all right any questions from the board on the anr do I have a motion um motion by Mike second I second second by Gloria all in favor I hi I Mike I as well okay number four another form a application for endorsement of plan believed not to require approval anarch

plan of land file number 24-15 69 owner applicant Robert surviva property location 2011 pekam Street 213 pekam Street and zero Veil Street s map G13 Lots 2 3 and 79 So the plan before you was before the zoning board of appeals a few months ago um the new proposed subdivision line eliminates an encroachment of what we know as Peckham Street Garage um if you get to the rear of that building it kind

of extends over onto the lot to the right of it so the new lot line for that parcel gets shifted over a little bit and contain me S what that garage Little Wing will now go with Lot number two Lot number three currently exists um as it is here however due to zoning merger it uh was considered to be merged so through the zoning board of appeals process lot three was now pulled out to

be able to stay the way that it has been uh over time and that lot line in between what you see lots one to just gets modified uh to be the way that it's shown now right now you'll see that the dash line uh that that's going to get shifted over that that cuts the lot perfectly in half now so it's been through the zoning board of appeals uh decision's been recorded and it afforded

an anr endorsement so he's separating that three family from the from the garage itself basically Y and then that back lot I know that front lot there's a little house yeah the three family was always considered separate what happened is because of that construction of the garage Edition the yeah the apostles merge because of that so it's to clean that up so that the the three family can

be conveyed separately from the from the all right I know the property well any uh any questions from the board do I have a motion I'll make a motion to approve motion by Mario do I have a second second second by Michael all in favor I number five on the agenda another form a application for endorsement of plan believed not to require approve approval andr plan of land file number 241

5-1570 owner applicant Savoy Street LLC prop location 111 seavoy Street assessor map l-09 lot 73 so almost similarly to to the last one we have a situation where an existing single family home was constructed over the existing property line these were two lots that were um 60 ft uh in Frontage and 6,000 square fet each 100 ft deep both owned by the same property owner so once that dwelling was built over the lot

line the pels became merged as well as the fact that over time this fell into a single uh family s zoning District that required 12,000 ft of land so they merged they went through the zoning board of appeals process and were granted relief to allow the subdivision uh as it's proposed on this plan now eliminating the encroachment and cutting out a now 5200 foot parcel with 52 fet

of Frontage to construct a single family home on that being said it's afforded an anr endorsement because of the zoning relief that was granted okay that'll straighten out that thing on the encroachment any comments from the board do I have a motion to accept I make a motion to accept motion by Mario second second motion by Gloria all in favor I I I as well number six on the agenda receipt of Correspondence

review and discuss the termination of notice of activity and use limitation recorded in accordance with mass d by Sage environmental Inc for property located at 109 house street so just so that you you're aware what happens is when when a property has some level of contamination there is placed on it an activity and use limitations basically telling it's recorded at the register you can't do these certain types of

things in these areas when they get cleaned up the process of removing that is they go through the cleanup they go through D and every the mayor's office as well as every other board and agency in the city gets a copy of this letter so I would recommend that you just vote to place it on file all right do we have a motion to place this uh correspondence on file make a motion to place

correspond file motion by Gloria do I have a second second Michael second all in favor I I as well uh number seven receipt of Correspondence review and discussion of the acceptance of the Bradford dery textile school for the national register of historic places from the Massachusetts historical Commission so again something that just gets sent to the different uh Municipal agencies um normally something that you

would just vote and and place on file the only question I had on this is they don't give the specific address of the property I know what building it is but it doesn't say it on the letter not that it really matters to you because you're just going to place it on file they're not asking for a comment so all right I wonder if I wonder if that was just an oversight when they typed up
