U for the record to my right is board member Melanie Cado. I am the chairman attorney Greg Brilliant. Um I want to begin the meeting before I read the open meeting law statements. We only have a two member board tonight which obviously means if if you get one no vote something doesn't pass. So we do give you the option to withdraw or excuse me to table your your petition till the

next meeting so you'd have a full member board. So, um, before I even get started with reading the open meeting law, um, notice, is anybody, uh, does anybody want to, um, take advantage, well, I shouldn't say take advantage, but anybody want to, um, uh, withdraw, excuse me, table tonight in order to go before a full board at our next monthly meeting.

City charter section 9-18 mandates that all multiple member bodies develop and adopt rules or policy for public comment. We have adopted such a policy which in short provides the citizens input on licens and board specific matters. At the beginning of the meeting there was a signup sheet that is located in the back of the room. No one is anybody. Okay. So we're going to go to the agenda. There's no public input. Um

we're going to first uh do section two which is one day permits.

Uh the first one is St. Michael School 206 Essex Street Shaina Labold. Um and the request is being made for 37206.

Good evening, Mr. Chairman. Uh, my name is Jeffrey Maderas. I'm an attorney here in the city of Fall River with the law firm of Burke Espanola in Vancen located at 120 Purchase Street.

Okay. Um, before we get started, yeah, I uh I was I was reviewing the when uh it's went over there was a little small. So, I also printed out some letters that might be of use to you with regard to um as part of the special permit. Um this is a picture of the bookard when it's empty where the space is going to be.

And that that is the seating and the pocket also.

Okay. Good. All right. So, I first of all want to want to say to the board because I've done like some research in a couple areas. When Ralph Sack Ramon was here in the ABCC, I asked him about not this particular situation, but having outside uh outside facilities such as this. and he told me that just like um in Boston down by the seapport that you know it's obviously allowable

and that what we had to just make sure that we were very very cognizant of is that the that the um licensed premises was was designated so we know and the people would know exactly where they had to go and not go. So, I'm going to ask first of all a couple of questions regarding this command.

Those little squares, are those the concrete barriers?

Okay. And your total seating capacity or occupancy is 150 according to the special permit. Yes.

We we're not changing anything that the zoning board of appeals has done and they are restricted to what the zoning board of appeals has already allowed them to do which is this particular facility. Um so we're not

varying from that because and I know they've been this they've disclosed that um the petitioners is going to be trying to get further slips. So if that takes place and they're successful doing that it may it may change their variance but that has nothing to they'll have to go there and come back to us again if any changes are made along that way. We are only dealing with what has been approved

um by the zoning board of appeals. Um, now again, is this is that location? What is that's going in there?

Yeah. Like where is this in relation to this plan? Cuz that's your parking, which I'm going to ask you about in a minute.

Not a problem. Do you want to just I was at the zoning board meeting so I know a little bit about what you're doing but for Miss Cadero could you just explain what what what was given by the zoning board and what's what they said could go on there.

So I'll do the special permit portion and then I'll turn it over to Miss Okonnell who is the uh the president and treasurer of Danny's Doside Inc. Um so uh the special permit was granted. Uh we we appeared in front of the zoning board um on two occasions. The first was they had some questions with regard to safety. Uh we had to contact the fire department as well as the police

department which we did. I presented you copies of letters from both um the police and fire with regard to access to this location. Um they both indicated that there would be no issues with regard to getting down there. um the special permit after um discussion they granted it uh from May 15th until October 31st. That's why we're seeking a a seasonal license uh for this establishment. Uh they also limited the

hours of operation from um every day we can open from 11:30 a.m. until 1000 p.m.

Okay. Uh the reason why it's May 15 through October 31st as the um zoning board had asked was that's when most of or all of the boats are in the water and then they start getting pulled after that time.

What's those what's those dates again, mister?

Uh it was May 15th to October 31st.

Okay. Go ahead. I'm sorry.

Um so uh they indicated that uh it was a unanimous after discussion. They thought it was a great idea. Uh they questioned the parking. We have more than sufficient parking uh for the for the uh amount of the occupancy that's going to be there as well as an overflow. So, and now and you went from you required how many 19 198 [clears throat] to 252 on the plan that you have?

Well, technically uh according to the the seasonal bar, we really only needed 38 spots.

So, we only need 38 spots legally for 150 per p person capacity, but you're showing 152.

We're showing a lot as the for the overflow and we're showing enough if we do add slips out the front.

We're not dealing with that. Okay. I don't want to because I calls I don't want if you get to 80 slips then you'll probably have to deal with the zoning board again. So, fair enough. But what you have is what we're dealing with. The property is deceiving from North Main Street because of the 32 feet of elevation. So, I don't think people realize how large it is unless you walk it.

Okay. And the hours are going to be 11:30 a.m. to 10 p.m. Monday through Sunday.

Correct.

Okay. And and and this license is going to be seasonal May 15 through October 31st.

Correct.

Is that we can do that, right? Put those dates in.

Okay. Um, and then I'll go uh Miss Okonnell can go over the concept with regard to what we want to locate there.

Yeah, I I would like her to do that only because I heard it all, but I know Miss Cadillo probably may not know all the details.

Uh, so uh the vision is to have an outdoor seasonal spot for people to come and sit in the north end of the city and actually anywhere. Watch the sunset.

We're going just for a liquor license.

The variance did approve us to have a food truck on the property and Blunt Seafood actually approached us almost immediately and they would enter into would like to enter into a long-term lease and would like to build the food truck to offer what similar to what they do in Warren Rhode Island, a clamshack, tailor the menu for forever needs a little bit more and offer the food on the property. And as you can see from

the from the layout, there'd be picnic tables, some high tops, adorand deck chairs. People can come sit, watch the sunset, enjoy a bite to eat, eat, have a drink, and enjoy the north end of the city that really doesn't have an open spot to the public at all.

Uh, yeah, I think it's a great idea. Uh my concern is if Blount doesn't go into contract with you, will there be additional sources of food so it's not just people drinking?

No, we will have food no matter what. We have two or three other vendors that are waiting just in case Blunt doesn't.

Um I've been in contact, my sister and I, with Blunt through every step of the process and they have their two food trucks ready, okay, to be the food. Um, you know, so we're pretty confident that they're going to move ahead with it. If not, we do have two other people that have reached out and expressed to be the food.

Um my main concern was just getting the liquor license, the seasonal liquor license, but uh while we are here, can we cover at the same time uh an entertainment license or do we have to do that separately?

So if you got big trailers coming out of there and cars coming up and down or people parking on Clock Street, that's a very limited area for people to park.

Mr. Monty, I'm going to be very honest with you and I've already told this to to the petitioner in a conversation. I too am a little bit, you know, not concerned, but I have my, you know, my my little bit of a worry. I live right on Wilson Road and I totally and and that was all vetted at the zoning board of appeals because that that's more that's more pertinent to the actual

zoning variance. The board of appeals already said this could go there. We just want to make sure that these people are responsible. We vet them properly in terms of serving alcohol. So, there's not a lot that we have to say about that. However, I've talked to her, they're going to monitor that. If if um Miss Okonnell wants to speak on it because she has spoken to me about it um regarding some of the thing that she's

going to do with signage and so forth and so on. We have got a letter from the uh we didn't get it. They just presented it. But again, I I was fortunate enough to be at their zoning hearing. So, I heard a lot of the things when it pertained to zoning like parking, um traffic flow and so forth and so on. And that was all completely vetted by by the

zoning board of appeals. So I don't if if Miss Okonnell wants to address that for you, Mr. Bonnie. I would I I hope she would maybe to ease some fears.

Um so any signage you know where the red sign is?

The only sign is going to be underneath the red sign.

Y and that's going to be clearly stated everywhere. That's your entrance and your exit. There are no houses on Colin Street.

I hope everything is a success. If we do get to a success, I have no problem planting someone and having traffic flow in and out Colin Street to keep away from Clark Street.

Whether I stand there myself with orange flags, I mean, if you ever come down to the property, we want the trucks going to fit under that bridge. Um, it's not very high.

So, you mean uh for on Colin Streets like a delivery truck?

You were mentioning you might have because we already I mean I'm an operating business as it is. I already get a lot of deliveries. Well, we're talking about the you might have food trucks like the the food truck is going to stay there.

They're not going to come and go.

Okay. That's what we were concerned about the traffic moving in and out.

Noise will be seasonal and will stay there for the summer.

Would be a lot of noise after 10:00 at night. Once it shuts down, what kind of No. in to lay all my cards on the table.

Three people in the government center requested we go till 10:00 at night because sometimes we were thinking only 8, but the sunset does come go after 8:00 p.m. So if we were to have someone sitting there get a drink at 8:01 I would be in violation. Our goal is when the sun sets we wrap up.

I can't say special events at parties that it would be, but again, you we have 32 feet of elevation between the location and Clark Street. That's a big natural buffer with a lot of trees.

I mean, anybody that's ever had any complaints about the boatyard has come in. let this get to a situation when that's cumbersome to the neighbors. And I don't think Miss Okonnell, who's going to be spending money on this investment, is going to allow that to happen. I would hope not.

us telling and and she's told me directly that obviously they want to do the right thing by the neighbors and I don't think we're going to allow that to happen as as people know we just had a issue in the last meeting about noise complaints and things of that nature if those develop I can tell you that we still have the mechanism by which we have show cause hearings because we

don't want that to happen to the neighborhood she's aware of that so at this point in time from that standpoint it's not the end of the I mean we we if we grant this tonight, it's not like there's a free-for-all down there.
