6.26.2026 Licensing Board

Uh we will now open the uh meeting of the forever licensing board um for June, excuse me, June 26, 2026 at 1 p.m. To my right is Michael Pereira, board member Melanie Cado and my name is Gregory Brilliant. I'm the chairman of the board. Um pursuant to the open meeting law, any person may make an audio or video recording of this public meeting and may transmit the meeting through any

media. Attendees are therefore advised that such recordings or transmissions are being made whether perceived or unpersceived by those present and are deemed acknowledged and permissible.

The city charter section 9-18 mandates that all multiple member bodies develop and adopt rules or policy for public comment. We have adopted such a policy which in short provides for citizens input and license board specific matters at the beginning of each meeting. There is a signup sheet that is located at the back of the room. Anybody sign up?

Okay. Um, we are going to, first of all, I'm going to entertain a motion on three matters on the old business which are going to be further tabled. Uh, I'm going to entertain a motion first of all to further table Leonard's Package Store, 131 Pleasure Street, Tin Patel.

And his grandmother actually left the business to Alex. The license never got transferred.

Okay. So that's what this is all about.

It went through and Alex worked with the state because it came through a trust.

It was a little bit complicated and it's finally they told him he was ready to go forward. So it's really just to put the license in Alex's name. He's been acting as the manager even while the grandmother was alive. He was the manager. So um it's nothing's going to change. It's there always everything is exactly the same. No changes to it's really the paperwork.

Okay. Because I thought that they were serving beer and wine before.

They have been. That was the problem.

And then when the state got involved, they they allowed him to continue, but they said you need to get this filed to get it into his name. And that's what we did.

Um but nothing at all is going to change.

His hours are the same. The the building no changes to the building.

The um and he is the manager.

I'm there quite often.

So, we're waiting on something from that because we got this gentleman in front of us. I mean, he's going to sell us stuff and he's going to, you know, is he hiring a detail? Is is he in pro uh in in charge of everything that goes on down there or is the is the organizer of the event in charge? Is the organizer event details of the sanitary part of it? I think we do need an answer

on that.

So Mike, I think I do have an answer for that. So like special events like the food truck and the 4th of July, everyone has had a meeting. All the head of the boards have sat down and discussed each department heads like Yeah, the chief everyone has sat down and discussed what the appropriate number what's needed and plan. So have are you familiar with that?

So they've already done that.

I think what Mike's asking I don't want to speak for him. We had a matter last last meeting. I'm not sure of the month now where we had Charleston Memorial was putting on the event.

So it's probably going to be more of an issue with a private one rather than a I mean this is so this is being run by the city this event the food truck thing is usually something that this is an annual one may things that is usually met here at city hall I I just we need a clarification on that going forward for you know

that the uh Charlton that was completely separate from like the 4th of July the food truck event those types of things there usually are someone that sit down for the safety meetings and coordinate everything that needs to be done prior to it.

Well, I think I think that's getting getting the licenses I think should be part of that.

Me personally, I just think that the question becomes is is Mr. is this gentleman from Primos responsible for getting that detail? And if it's not that if that detail is not there, is he in trouble?

So, the details from my understanding for like I said the Fourth of July, the food truck events, those have already been worked out with the city.

I know, but is the city providing it? Is he in trouble if for some reason it's not there? The city, I believe, is providing it. It's a collaborative thing.

No, I know. But if they weren't there, I don't think I'd be able to sell anyway.

I I couldn't I could because you get a one day license.

So, but the the police would have to be on site. Yeah.

I know. I'm I'm just trying to figure out moving forward how we're going to do that because if the city's going to do it, then the city's responsible and that's not him. So, if that some reason there's a there's a discrepancy or some reason something's not done correctly because we have rules and regulations. Is the city bypassing that?

I don't think so. But I will be honest in saying like I said, I think it's a collaborative thing. I think they're still responsible for paying for the details, but the city is also providing that there's going to be a certain number of I don't know if that comes out of the licensing fee or anything like that. I don't I don't think I've ever directly cut a check for a detail to be honest. I

mean, I pay for the licenses and the detail I believe was always provided by the city for those type of events. Mhm.

So for large events like that, it's usually like the city is providing those details.

Yeah. And it's also about the liability too in case there's something occurs there. You know, they're going to say, "Oh, there was no police officer there or there was no not just cops. It could be a paramedic. It could be a firefighter if it's indoors or whether and and it fell through the cracks cuz this one thought they were going to hire him. this one thought they were going to

hire him and no one hired him and the event still rolls on and then there's an incident and they're going to be believe me when they give civil litigation everybody's gonna be pointing their fingers at each other saying he was supposed to hire him he was supposed to hire him and and and now we don't and then now there's a problem I don't want I I'd hate to see the vendor this not not necessarily you the

Supreme Court but any vendor on the hook for something that they're not even supposed to be on the hook that's all yeah we just got to figure it out Courtney going forward you just got to get a ruling on this of some sort through corporate counsel See, see my issue is also just piggy back on what Mike said. We have rules and regulations relative to one day liquor permits what somebody has to provide.

Um, as far as what they're telling in the event coordinating office, I can't really speak on that. I just taken the one day permits when I received them.

Now, when you just say police details, you're going to get your own?

No, sir. I just make sure that there's at least police details there before I pour any beer in the city. I I won't pour a pint of beer unless things are followed correctly.

All right. This is this isn't on these applicants if the city's telling them to do this, but I mean it may it may well be on them. We I just we should get a a ruling from corporate council. That's all. It may maybe the ruling is no, he's he's the one that's serving the liquor. He's got to get a one day permit.

I would think that he'd have to hire him and pay him.

He's not. I know that's it's wrenched on into this.

We have documentation stated that u all the police details were going to be taken care of from the city of Fall River.

I I I they they got to coordinate that better. I will call the mayor's office because this is not the right way to do it in my humble opinion. We're not going to hold it up because obviously the Fourth of July is next Saturday and I'm not going to stop any of that or or in terms of my vote personally. I'm okay with that. But they got to coordinate this the right way

as as to who's doing what. So you're just getting a permit and you're not not saying this to you and I just said it.

You're not responsible to do anything else other than to get this permit and show up that day.

Which is not what our normal regulations would have for a one-day permit. That's all I'm saying. So either the city should be telling us anything beyond that it's being taken care of and those regulations are being because when we're leaving when we give you this permit under normal circumstances you would be responsible for the details. If you don't get it you're in violation and the nor if you were if you were just

going to an event and asking for a one-day permit which is going to be for instance when we get to St. Michael School when they have their event, we if we give them a one-day liquor permit, the city doesn't do do the details. They got to go out and get their own details.

If they don't get it, they're in violation of the one-day permit. That's not going to be the case for you or Mr.

Primo who just left. And the city's got to make sure they're telling us as a license board that those details are being done cuz we're not waving the detail, right? We're not waving that.

So, when when these city events are occurring, I believe that there there's all the tees and the eyes are being crossed because there's meetings. I know there are meetings at the there's meetings at se all the department heads fires there's police there are you actually involved in those meetings as well okay but the chief's there so I I know he's he or she is making it known and making sure that

there's going to be details and I'm sure the fire chief is doing that that as well is doing that so I I don't think there's issues that way I'm more concerned with private ones because there aren't those meetings occurring you know what I mean for the most part they could be if it was like a huge private one where they brought the police department in for to consult consult with them, you know, but there's

a lot of them like people St. Michaels and all these these um these um feasts that we have, they're here every year.

They know what they're supposed to be doing. But if if a private entity pops up and they want to have a party or they want to have an event that is going to have a one day liquor license, stuff might get fall through the cracks. So I I would think that it would be on the people who are running the event to be coming here for the licenses. They want

to hire a a a bar service. Okay. But we're going to hire you. We already have the license serving liquor. You know what I mean? That's that's what I'm concerned. I don't think there's issues with the city doing it because I think all those tees and eyes will be crossed.

They could fall through the cracks, but that's what that's what I think. So, I'm more interested in the private ones.

That's what I'm interested.

But like the private ones like the one that we were talking about earlier that was brought to our say a lot of these one day permits don't come to me specifically. Um, and so when it was, which is kind of even worse, I made it uh I brought it to the chief's attention and they ended up meeting with um our event coordinator after our meeting.

No, this was prior to I believe this was prior to the meeting. They came it came to my attention well before and they sat down with the event coordinator from the police department to determine what was the safe amount of details that was going to be necessary for that event.

See, I I'm and I agree with Mike. I don't think the city's not going to have people there. I don't think Charlton Memorial didn't have people there. But when they come here and they have no idea about it, the city's not telling us they're doing it.

So, how do we know? They're they're not We have regulations that anybody else has to follow. I'm I understand the city's actively involved, so they're going to do that plus more than likely, but someone's got to tell us that that's what's happening. It should come down from the mayor's office or somebody or the event coordinator to say and put in the file. All details are going to be

handled by the city of Forilla. So we have it in the file. So we don't have people sitting in front of us like today. Oh no, we don't do details. We're not we have nothing to do with it. So how do we know? You know what I'm saying? Something should be done that we all know. Like when the the the poor gentleman from that one we did with Charlton came, he was the vendor. He

didn't know one thing. He looked at us and said, "I don't I think every who was here with me that day. You might he didn't know anything." He really didn't.

He was told to come down here.

And I'm just saying I think we just got to straighten that out that they send a letter as well. Whether it comes from you guys, but I don't want to create more work. If it's the event coordinator from the city of Fall River who is in charge of putting those things together, then they should be just giving us a letter of sort saying this is all set.

We we will handle the details and make sure the regulations that we have in front of us are being followed. This way we don't ever have a problem that it's in the file and someone says, "Oh, I didn't know that. I thought the city was handling it."

All right. So, Mr. Le Point, can you just describe a little bit about what it is? It looks like you got pictures of a a portion of the parking lot. Correct.

So uh when uh COVID came uh we were instructed by the city that in order to hold some functions outside. We would have to come up with a plan to include a traffic plan, a fire safety plan, police officer would come down and inspect us.

The board of health would come and inspect us and the building inspector to come. So, right off the right off the bat, four years ago, we had to purchase these cement blocks because our halls were restricted of the amount of people we could hold there and we we had more room outside to for distancing and things like that. So, we purchased five of the uh concrete blocks. There's

pictures that I had uh attached to that.

So, that would alleviate any cars or any traffic that would go back there. So, we developed the plan. We put it forward.

We started having some outside events like concerts and uh barbecues, things of that nature. So, we've done it for the last four years, uh, every year, uh, submitted an application. Not much has changed. If anything, we've we've improved on some of the safety factors, things of that nature.

Now, is this is this considered a seasonal license?

At the uh, if I may, at the I believe we used to have to get it in by May 1st or first couple weeks of May and it would run into November 1st.

I remember this. Well, I do remember doing it, but I I thought they were considered season licenses and at some point in time.

I wasn't on the board, but I thought these seasonal license were just reoccurring licenses.

That was so the outdoor permits were always handled by Glenn Hathaway in the buildings department and then I believe after co um switched over to And that's when this application process was came up with. So that's what they've been filling out for at least the past five years.

Five years or so.

I think at one point in time they were going to allow Boston to uh regulate everybody, but they couldn't come up with a plan in place. So Carrie told us to just go with the previous application from the year before.

I don't think we considered it alteration of premises. I think we considered it a seasonal license.

That's why I was confused when I saw that. Well, because the only reason and I have no issues with this because you've already altered the premises years ago, right? I I just Who who monitors the occupancy?

How many people can be back there?

That would be the building department.

Do they do that, John? Do they give you a number?

They've come every year. We've set up tables. I have indicated in a diagram there of how many tables or distance and that obviously has been relaxed since co sometimes it may only be 50 people or 100 people out in the yard. It's it's quite spacious.

Normally normally when you have a any type of uh liquor license, they give you an occupancy.

But you don't have one on this. We have them for the inside of the the buildings for each room. And uh Mr. Hathaway has come every year. Uh police, fire, traffic, and board of health have come and inspected the premises where we showed them the we don't put the tables out because every event the tables are put out and they're put back in the ConX trailer. We leave nothing out at night.

I'm just I'm only asking this because it says number of outdoor tabletops. Number will vary depending on event. I get that.

And then it says number of outdoor seats. number will vary. So, I was just wondering if anybody ever gave the Elks an occupancy. I mean, can you have 200 people there? Can you have 400 people there? Can you have I that's not necessary. We don't get involved.

Um, on their liquor license, I know they No, their liquor license. They definitely have it.

As far as the outside, I did inform the blind that they apply it again. So, he said they were all set. And I'm sure I just like I said it does say here Rat Skele has got 80 occupants, function rooms got 225, their lounge has 100, their banquet hall has 100. So when you go and you now alter this permit, which is what he's here for, where does that go? And who's going to determine that

for the Would you like me to submit a paper with like the range of range of based on the table?

I don't I'm not even questioning whether maybe you don't have to do it. I I maybe they you don't I'm not trying to say what it is or what it isn't, right?

But I'm just saying normally you do have to have like like when you get the board of health it says number of seats. Okay.

And then somebody gives you an occupancy and it's not us.

Yeah. So um that's the only question I have. And again, it's more of a procedural thing.

It's not about the Elks. It's not about you guys doing it. I I mean I don't have any anything to do with that. But if one day you guys have a con concert and a thousand people show up, is that going to be okay?

I think the most people I've seen there was uh actually when the when the Junter race finally kicked off again, we had about 200 people.

This isn't seasonal. So, we altered the premises, but I don't think that that's what you intended when you first started this for the summertime, right?

Seems to get the holes fil the the place filled up again because of the restrictions on the amount of people you have in the That's what I thought this was all about. But again, I'll it's something. So, I understand for the 4th of July, you have that space outside roped off and you have a police officer, you know, watching people coming and going, but you're not going to have that every day.

No, we're going to have to make sure that we manage heavily. And I mean, that's something we do at our other locations in Far River as well. And we have outdoor seating at those, and it's just something that has to really be watched and and something that has to be kind of trained and taught as well.

So, will you increase staff because I know that at Oh, of course.

got the got the got the um asked for a license to be in Jimmy Cameron's building on the corner of North Main and Beford Street where the guy decid that's not license to sell cars. I mean, excuse me, that's not zone and sell cars there, but he was only doing wholesale.

So, I think he could do it in the office.

He's saying six cars.

it there was never a number of I don't think you request a number of cars with a wholesale business but also on the agenda it's a new class two license so I don't even think we can look at it that's I don't the way it is but but now this previously in the past always granted the class two license and then there was like a little note section and it would say wholesale or satellite

but I think on the agenda it should have said that instead of class two a satellite no it should have said wholesale How did we This didn't come to be when we just did that other one for that gentleman. Do you know how that was advertised as a class two license?

It was and it didn't say anything about wholesale.

I thought it just in the application section. So if you where the description it says satellite in one place then it says wholesale in another place. So right here, premise description would say the wholesale online sales only. And then when you print the class 2 license, that would come out on the license.

Okay. But I just And then below it says six cars.

It says six cars prior to that.

It's got He's not going to be limited to six cars wholesale.

I I don't know. I'm not even going to lie. I just want to make sure we're doing things consistently for what we did with the other people because that doesn't seem to me to be the same. They can sell a

100 cars. We don't we don't get involved in that.

But how much you guys say say is what I'm going to sell. I don't limit a wholesale you're going to have to pay rent and you're going to after you get to six cars, you're going to stop selling cars, but you're paying rent. Well, yeah, that's you can't do that. You don't want to do that. You'd be wasting money. Oh.

Well, it seems like they went down there. He's looking for a wholesale to sell a thousand cars a day if he can, right? But like Frank went did Frank go down there and say, "Hey, you can put six cars there." Like Frank said, "No cars."

No cars. So, how'd that six get on there?

What I what I think happened is that's an industrial district. This is my thought.

That's an industrial district. Frank went down there and says, "You're not properly zoned to sell used cars. you. So, you technically can't have a car here.

But I guess you can have a they they allow to have a a wholesale license in an office.

I think I think that may have been what happened to this young man.
