9.3.2025 Park Board

I'd like to call this regular meeting of the park board of commissioners uh to order. Today's Wednesday, September 3rd, 2025.

This meeting is being held in the council hearing room. Um pursuant to the open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any media. Attendees are therefore advised that such recordings or transmissions are being made whether perceived or unpersceived by those present and are deemed acknowledged and permissible.

We'll start with the roll call.

Um I I volunteered to work on the flowers at the Kashisco Square and one of the stop signs there is kind of obliterated by the uh branches of a tree and I'm concerned that there might be an accident at the intersection of Hamlet and East Main. I was just showing a picture I took today to the gentleman there who's who's uh taking over for Nancy Smith and um if you guys could have it moved I think

figures it's a stop sign.

Yeah, it's a stop sign.

Then you got to go to traffic. You got to go to traffic.

Well, it's it's on it's on park land.

Yeah, that doesn't I don't think that right.

Yeah.

So, let me ask you. Is the tree covering the sign?

You still have to go to traffic department. But if it's the tree that's covering it.

It's And that department that's going to remove the sign's fine. It's the tree. You can't see the sign because of the tree.

See how the tree is over the sign?

So the tree's got to be trimmed.

Well, I I was going to say move the sign because the the tree is a young tree.

You move the sign. You got to order track.

Yeah, that wouldn't be us.

Well, yeah. Well Well, but it's on Parkland. And that's why I figured I'd come here first because if the board if the park board says no, you're not going to move our sign, then it'd be a waste of time to me to go to traffic. Yeah.

So, I figured I'd come here and bring this to your attention, you know, and um hopefully you can if you can get the sign moved, then then that would be perfect because then you you won't be cutting the tree up because those that's a young tree that people have been cutting the the tree where the bus stop is of short distance from there and it's the tree is suffering. It's not doing

very well at all because people keep breaking off the lower branches. So, it would be easier to just move the sign and the sign is is u is not in alignment with the other one because the other stop sign I took these today by the way these pictures I took for today.

Can we keep copies of these?

Yes, you could keep that's why I made you as to keep um you see where the sign is in back of the the stop line.

We can't move the sign. The traffic department I know that but they're not going to move it. They're not going to move it unless you tell them to move it.

Well, you got to go to the meeting though because not next week. the week after the third Wednesday of the month at 4:00.

But it's on your property.

We're going to start here and we're going to tell traffic we think they should move it.

Still have to go to Exactly. See, um, see here's here's the here's the way the layout is. See how it's it's it's on this side of the line where on this one it's on the other. That's what I'm saying. If they move it there, it'll be in line with this one. So, you're not asking traffic to do anything that they haven't already done at this intersection.

Okay. And this is another picture I took from the backside. So you can see there's a little bit of you know just to show you the the uh you know and this is and this is the uh the other stop sign that's there.

Perfect. So I think um I can talk to Stephanie and if she wants them to go to the traffic board then it has to go to it. It has to go.

So what we can do then is we can keep these so Darren can maybe scan these send these over. hours. They're traffic.

Somebody can go down and take a look.

Maybe the board will uh make a motion to, you know, move the sign pending traffic approval. And so I don't think we can make a motion because is it on the agenda?

So what we can do is we can just reach out because obviously it's not on the agenda. So I don't think we can make a motion, but we can with these reach out to Stephanie and and facilitate something.

Well, yeah, that's that's the reason I did it and I I didn't want the tree to be butchered. So that's why makes sense.

I mean, I have a water in those streets.

I didn't do it today and I told why I couldn't do it. And we're going to talk take those pictures. I'll go see Stephanie tomorrow.

So, what we'll do then is you'll follow up with Stephanie in traffic. Whatever they want to do, and then if we have to put it on next month's agenda so that it can get approved, I don't see why anyone would not approve, you know, pending whatever traffic is going to look.

Well, the only thing that would happen is if traffic says, "No, we're not going to sign. going to have to trim the tree.

Yeah. So, so that's the whole thing.

It's that's the reason I'm trying to do it the easy way.

Find a way to leave the tree there.

We'll just move the sign.

We cut down too many trees.

Yeah. And I've been watering those trees to try to keep them keep them going.

So, I don't know. That was the only thing that I thought of. I was like, I don't know if it has to be that was next year because nobody we don't get a lot of requests for Travasos Park.

So, I know in the past we can't approve until the next year and I know it's usually March the March meeting with all of but it's fiscal year that it's still in our this fiscal year. So, does it go by fiscal or calendar?

I think it's calendar because like for my event, I have to wait until Nancy always makes me wait until the March meeting of every year for something in the summer.

Here I am being proactive.

That was the first thing I was like, "Oh, can we even maybe I didn't even notice the I was like, "Yeah, go for it."

Um, yeah, I think it has to wait.

So then maybe we'll table we'll just table it and we'll lift it and we'll lift it in January and approve it.

I mean, does anyone have any questions so he doesn't have to come back?

No. I mean, as far so for the record, Andrew Rapo, 1166 New Boston Road. Um, principal is Spur Central School. Uh, essentially the two events are the fun run is a half day run around the track.

We throw uh different types of powdered colors at the kids and they have loads of fun. And then the field day we've been doing since I've been principal for a while. Um, it's two days we basically use the park for setup activities. Um, no need for bathrooms we have at the school. So, we take care of all that and all the trash is taken up by the kids.

So we clean everything up afterwards.

That's why there's no questions because this has come before.

Um item B and C will take together the two letters from Michael Pereira for the request of the use of Kennedy Park to hold the fall of a hot shot challenge and three-point competition to take place on September 26 from 4 to 8. And his other request is to install a memorial bench at Kennedy Park.

Yeah. So, so we've been doing this event for a number of years. We started off in um Griffin Park, which was very successful there. And then um when they we did the courts behind the station, we did in um Britain Park again, very successful. That's been the last two years. But unfortunately, there was a young young fellow um Pablo Aosta last September 5th. passed away while playing basketball on the Kennedy Park

basketball court. And I've um just from a pre-existing illness. It was not nothing, you know, was obviously out of the blue. And um I've met with his uh I've in communication with his family.

He has a young little little like three-year-old that he he left behind and his wife. So a lot uh two weeks ago, myself and Chief Title met with the with the family and we um asked them if they were in favor of doing this and they and they are. you know, um they obviously they're a little still nerved up about it, but uh um so I met with Darren the

other day and we went by, you know, um Kennedy Park is actually a perfect place to do the event, but we picked out a nice little spot that's on just off Park Drive between two trees. We could fasten um the the um the the um the bench there, and we got a nice little plaque.

I already had the plaque made. It's in the process of being made and it'll just be a memorial for him and we'll we'll have somebody say some words there and then we'll just do the event. I think it's a good thing to do. Um the the young the young man deserves something like that. I think that that's not too much to ask for the city and I don't think there's going to be an issue with

it obviously.

Do do you have time to get the bench for Yeah, we have he has the bench.

Yeah. So we talked about fundra going to fund raise.

I have the money. I have it's all it's all funded already. The whole event is fun. The only other issue I had with that bench, cuz I thought about it after, is to match the aesthetics of that park is to have the bench face the walkway because then that would be face it out.

Yeah, it would have to because the rest of the park is facing out be the only bench that probably just to match the aesthetics of the park.

Yeah. Obviously, I was thinking face it in so someone could sit and watch the kids play basketball, but if that's what that was my only my only thought about that after the fact.

Is is is that I know so how many benches? There's a bunch of benches along the uh drive that are they close to that area that it would make a aesthetic difference.

There's a bench close I think the next bench up is at the ball field.

I was going to say a distance away the the Kyle uh not Yeah. Kyle Brady uh bench that's at on the bottom. Yeah.

Is it facing in or out? Do you know?

So it's it's near the baseball field, but it's a memorial bench, but I I feel like it's facing in.

Yeah. This one would be better facing in. But Darren's in charge of that that that part of it. But you can look like I I wouldn't Yeah, cuz I think it makes more sense to have it facing in if that's what it's for. But and I like I said, I know that there's a bench there. Um they put it in I want to say two last year or the year before field. Yeah.

So, that's what So, we might be able to like I know we have regular bench special we've done previously. I That's fine then.

Yeah. It's it's the it's very nice. Oh, we want to get we want to make sure with historical too.

It is. So, as long as it matches and all that.

Well, it's I'm getting from him.

And as far as the event, event's a good event. It's sponsored by Blue Cross and Blue Shield of New of Massachusetts. And um last year we had over 100 kids participate. We give a bunch of sneakers away to kids. Um there's there's we did have hot dogs last year. We and I know and I'm looking at the rules and the odd part it was I don't think Nancy to said anything about it and then because I

didn't come in front of you guys last time but I remember I did have to speak to the board of health and they approved I had we had a matter of fact Lieutenant Cullen um deputy chief Cullen from the police department had to go up there and fill out a form and and we had to get a permit for it but they did allow it. So I do it is allowed but it's like there's a

special grill that you need. The fire department has to inspect it. So there's a lot of different need to do that. A lot of it's just not within we can't approve the food.

I think it's the board of health that does it.

So I'll go with them because all it was it was very easy. All we did was a little um Blackstone this big with a matter of fact with little camping things. It wasn't even a big tank and it worked very very well. And and I'm also thinking of contacting Blunt because I did use them in the past and they just set up a they come down there with a truck. Is there what is

there any issues with that remove list you've been using?

I'm sure they are. Yeah, I'm sure they are.

They are.

And um I I mean I don't know if they're going to do it's a little short notice.

It's kind of an afterthought, but other than that, I mean, we've been doing this for a number of years and I have obviously have plenty of experience doing these events. I've been doing them my my entire career at the police department. So, back to us now in No actually it's next it's in three weeks.

Yeah, it's in a couple weeks the 26th.

Oh, and if you guys I I would encourage you guys to come down and check it out.

We match whatever it's like what we have at bsentennial. All the plaques are basically a standard set plaque.

Right before it we'll do it right before we probably have one of our chaplain from the police department do it. There's far as police and and coverage as far as security and

for the event. Uh the union guys all volunteer and then the chief she's they've done an excellent job over the years. They'll send a bunch of guys down in uniform too like community policing officers and they'll parade around like we've done. You've seen us do this type of thing and then she she can I think she'll pro I think she's going to use it in the Shannon grant. So that's good.

Um item D is a letter from Kenneth Fet in the city's law department on behalf of the law department. Um on the request from Mr. Paul Mayer on a tree removal at 466 Warren Street. Um, so backstory on this, the those trees there was with the 4th of July and Mr. Lair, if you want to correct me if I'm wrong, but the the 3rd of July, we had that storm. There was a

couple trees that came down. Uh, Mr.

Lair's lived at this property for a long time. There was nothing on file that anyone could really find as far as whose trees they were. There was a lot of fingerpointing as far as are they park trees, are they his trees, whose trees are they? So, the uh, city engineer, Mr.

Aguar sent somebody out. He took a look.

He said the property line went right through the middle of the trees. So, uh, we had So, the law department drew up a release releasing the city from any liability associated with the trees and this is in front of us to approve the removal of those trees. Mr. La Mer has already signed the release releasing the city from any liability associated with the tree removal. Um, so that's all of

the backstory behind this and what's gone on between the 3rd of July when that storm happened and today. Did I miss anything?

No, you hit it right on um Dian A. Yeah, he actually went down there and did the survey.

So, you know, so the the motion for us and and what we're looking for uh today is to approve the removal of the trees. Chris has already been out there to to look at them. So once we approve it, he can go out and take them down. We've got the paperwork signed. So um do I have a motion to approve? So we can motion those trees.

Sure have. It's It's not a city trade, it's in between two properties and I guess they can't come to an agreement as to how to I guess whose whose tree it is. It's kind of on in the middle of both their properties.

So, um, it's really nothing for us to get involved in as far as I'm concerned with it.

Um, the next one is item H. I think it's also a letter from Mr. Marren. These are all the tree removal requests that came in over the course of the last couple weeks. It's 218 Rainy Street, 269 Hyestin Street, 136 Bower Street, 58 Edgemont Street, 128 Wood Street, 466 Warren Street, which we just talked about, 634 State A, and then the Bank Street Armory.

These all city trees. Yes.

The Bank Street Armory that that we don't have jurisdiction over that one though, do we?

No.

There's there's two dead trees. They're kind They're like right in from the sidewalk. They're on that Dery Street side.

There's two of them that are completely dead. There's just a little green like viny stuff growing up them. And they're they're like all the tops are dead and pieces have been falling off them. So, I think it's time for them to to go as far as those trees go.

They say they're city property. So, motion to approve.

Um item I was an addendum from uh John Battello on behalf of Federal Little League. He's recording he's uh requesting the use of the Kennedy Park baseball fields for a craft fair um on September 13th, 2025.

I think he already has a permit for the park through the summer. So, I don't know if it's even really necessary, but I wanted to make sure that No, he would still need one because it's that's for baseball. This would be different. But I make a motion to approve.

Um, old business tabled from the August 6th meeting, we have a letter from Lorie Pelier regarding the request of the removal of four trees from the corner of Garden Street in Kelly Drive.

Um, so if I'm not these street, we may need your help on this one too, Chris. Sure.

Give us a little bit of the backstory here. So, um, during that July 4th storm, um, one of those trees on the side of Mrs. Pelier's house, um, broke from the wind, landed on her roof gutter line, did a did some damage there. Um, again, we had 70 mph winds, right? But for the most part, it's a multi- trunk tree. One of the trunks towards the house snapped off, landed on her house

and damaged. So, um, there's two trees right in the middle that are alongside her house. They're all by her house. Um, but I feel like the two in the middle we can would be the safest bet to remove those because they have, like I said, both of them are multi- trunk. So, they have limbs that go up towards her house and if any one of those two break off,

the odds are going to it's going to hit her house.

There's a couple of other trees. So altogether there's like five.

So when I went there, looked at them, spoke with her, um I told her that we could probably take out the two in the middle, and she seemed pretty satisfied with that. But overall, she really wants them all removed. I don't see anything wrong really with the other ones as a reason to remove. Um, but I would I I would and and also the law department thought that that would be a good thing to

stop their city. They're all city trees along that Kelly Drive there. There's like and they're all along the side of like that. Her house is on on the corner of Garden and Kelly. Um, it's right on the corner, just set back from the corner a little bit, but all the trees are on that Kelly Street side and there's five of them all in a row. We have had an we had an issue

a few years back where one limb came off and landed on the there's a flat roof little addition behind our house also.

It it went over it was still kind of connected. landed on her roof and did poke a hole in the in that roof a few years back also.

So, you want to remove just the two?

I would I would I my recommendation was to remove the two and then are the other ones like over her property line?

They're not so like they're both after kind of after the front.

Okay. It's still I mean it's still there. There's always a chance of you know something happening.

However, they all look the the rest of them that are there look good and healthy.

They're not dead.

There was a lot of trees that were alive that came down during that right and 70 mph winds, you know, things can happen with trees. Okay.

And I mean that's that's my thought. I don't know how the board feels about that.

Well, I wanted to know you know, and I didn't know anything about it public. Well, didn't you you told him to call me? U we had uh a resident on uh Oswwell Oswell Street Oswell Street cut down trees in our park. He took it upon himself. I don't know what did he ever give a reason why he did that?

Uh there was confusion on he contacted a couple departments. He said somebody had gone out to look at the tree. He couldn't they the wife I talked to he she couldn't uh give me a name like she gave me she gave me a name didn't match anybody that would have gone down there she said specifically a DCM truck an SUV I only know one in DCM that we haven't that's lettered SUV the name she gave

didn't match who went they had promised they were going to do work two three weeks went by uh there was no response so I guess they took it upon themselves to just take care of block to cut down the other tree. He was going to cut the rest of the trees down.

He's going to have them all spray painted.

I just But they're already trees. They're not They're not They're not They're like five trunks. They're like What are they, Chris? Like two or three shoots off a trunk.

Yeah, they're multi. There's like one of them has three or four leaders coming off and the other They're good trees. They're good trees.

They're not dead.

I didn't see any anything wrong with you know the trees themselves. So the problem was this they were hanging over uh the branches were hanging over the property. So they didn't hire a company like they should have done and cut what was hanging over.

They just went on the other side and cut that whole tree down and it took everything that was hanging over out.

That's what his I guess what he aimed to do.

And we had um when we found out I had to call PD they came down did a police report I guess they find him. But going forward, an ordinance, I guess, uh me and Chris have to come up with a some kind of like restitution like for tree size to like to replace what was uh removed.

We haven't got to that point yet, but they did assess him a $100 fine, a civil fine.

So I guess then for us once that's done that that'll probably have to come before us to for approval before it goes.

Yeah. Should have contacted. what you should have done.

No, but I'm saying he's what Darren's working on with with uh Al as far as setting up like what the consequences, right? So, if you if you take down a tree like that, you know, the $100 fine is one thing, but you should have to replace the tree that was taken down, but doesn't sound like there's that that it's never happened before.

You never contacted us, the the park department or the city?

No. Well, he they said they reached out to parks, but I never got the phone. We knew about nothing. Nancy did. She would have told us.

My thing was um I the Holy Ghost feast happened and I was doing a detail with uh emergency management and I went there and there was a a group of people having alcohol and cooking at the basketball court next to the basketball court and um I don't know we can do something about it maybe next time but the lady that was there actually came up to me and told me that she came in front of

and got permission from us. And I said, "No, you didn't." And she she kept going on and on. She says, "Look, I got permission from the park." I says, "I'm on the podcast board. You didn't get no permission from me." So your husband calmed down. I told him, "Look, next time if you want to do something like this, you got to go through us and the proper channels." He says, "Okay, we're

going to leave." I said, "Well, you have to leave. You got no choice but to leave." He says, "Well, what's going to happen?" I said, "Well, just call the Florida Police Department. They'll come and get you." So there was a generator, there was food, there was a grill, there was alcohol.

So I think because the Holy Ghost was going on, they might have just taken advantage of that where nobody would notice it. But I just happened to be there doing a detail and I just went up to them. And uh also we do have an audience I think we do for politicians to go in all politicians can't go in with their I saw a few of them with they're not supposed to

so we'll have to make that a judgment next year.

They can't go in with anything that says right I'm running for city council or anything any anything. So, there was a couple people that I saw again. I Which ones?

The only thing that I was extremely concerned with was when I was in the park on the other side where the Holy Ghost feast usual is, there were a significant amount of individuals sleeping in the park visibly on something. um it was far enough away from the event that it it didn't deter anyone from coming or and it didn't impact us by any means. Um and then I I did have a conversation

Darren and I were walking around and I was telling him all of these I like these things because it was very concerning. Um then we had a conversation about the um the dugouts over there are I think we should give them We lock them.

We do. We did. We started locking every every field in the city.

I was going to say because I know they did it to the the park at North Park, the baseball North Park. We went there uh in the last week. We actually chained off the new pathway they paved for the basketball court cuz people were driving up there on with their cars and turning around the grass. So, we just chained that off uh yesterday. We put the chain up and then all the fields in over there even

though they're not being used like the upper little league field we're chained off all the gates because people are walking their dogs in there.

They're messing inside that field. So we're we're moving forward we're locking every field we can and dugouts. We're chaining.

Okay. Yeah. So that was the I knew you and I had had a conversation about how someone had basically made a home in one of the um the dugouts behind Maplewood. When I talked to Sean, he said he actually had a mattress in one of his dugouts.

Yeah. So, um, but yeah, just as something just so everyone's aware that there was there was a lot I think there was at least like six people in the park that were just sleeping and like I said, there was a couple that hadn't moved and I was very concerned at one point because they hadn't moved at all in like several hours. So I know like park rules you can't sleep or lay down on a bench, but

like during park hours it's tough for me to to actually go in a park and have somebody move like during open park hours. I mean if it was after 9 Yeah.

Okay. it would be an issue and it I I'm having this problem in almost every council repos behind him in and out of all these parks and we're we're tailing you know a lot of these individuals that just hanging around making messes in the parks yeah that was it do are you do you have anything that was not on the agenda or you had just before we adjourn I have uh
