Okay. Um, obviously this is a regular event. Um, can first what's what's the hours of the event, gentlemen? All right. So, this year we actually cut back the the event. So, we're not doing a Thursday. So, we're doing a Friday.

Yeah. And the Friday is from 5 to 12.

Yep. Uh Saturday, uh the event starts at 3, the ceremony, but 1:00. We want to get people there from 1:00 to midnight. Yep. And on the Sunday, we cut back an hour as well. So, we're we're going 12 to 9 on a Sunday. And that's less hours than premises. I know you always meet with the the city and the police department.

And um has that happened again this year?

Has it happened? Yeah. So uh last week we had a we had a meeting with all department heads in the city. Police department had three uh JT was there, the sergeant was there. So everybody on the same page, fire department and everybody. So no, I haven't been made aware of any issues now. So the game plan is basically the same. We're not changing anything. We're uh we're still with the bracelets, two drink minimum,

and everybody was everybody was comfortable with that with the police department and so forth and so on. Well, okay.

Um, again, I don't have any questions. I just wanted to say to the board, one of the things that I was going to speak to the mayor about, not not in by way of uh a complaint or anything, but I know sometimes that we have certain one day liquor permits that come before us that say, well, it's a city sponsored event, so they don't have to get the police department.

Um, and that is well, they have to get it. They're just not responsible for the payment. the city will in in more than is that how it works? Yeah, they still have they still have to have a but they wave the fee. Is that what what happens?

I believe in certain circumstances they may wave it. Okay. All right then. I I'll take that back. I'm still going to have a talk to how that works and what goes into the determination, but I just for my own edification, not that there's anything wrong here, but for my own edification as to how they determine who may get a wave in city circumstance and who not. That being said, um, anybody

So we'll be there from 11 to 2 for the river ribbon

cutting. And then on July 4th, I'm sorry, um, Father's Day, we'd be there um, at the carousel as well. So that's what, June 26, I believe that is 15th.

June 15th. Um, thanks. So whatever Father's Day is that day, and that'd be from um, uh, 6 to 10. Is it 6 to 12? Um yeah, 6 to 10 at the carousel. Yes. And those others are where? At the carousel. Um the other all the other dates would be at the um the farmers market.

Um and obviously also the carousel would be July 4th as well from um 6 to 10.

Where is it being held? I know that Viva Patty Rigo. I just It's on um Street. Yeah. Could remember. So, what do they have? Like like what do you have like it's a a booth or it's like a a a standup tent that's probably I don't know as big as this table with a table and then they have um a cooler with a tap system that is built in and you'll be selling beer. Um yes.

Yeah. I mean it's it's is it is that customary? I I don't know anything about it. So So it's the first year the city has done the farmers market. So, there is a police deal detail there that I'm aware of. Um, and it's just local vendors from the city that sell them their their wares and things like that.

And you're going to be the only one selling alcohol as far as I know. Yes.

So we're selling because we have a farmer brewer's license which allows us to make the beer and therefore we make the beer and sell four packs of beer to go. You're part of the same petition. Yeah. Our our organization helps operate candy craft beer. So, are you going to be selling beer like people can drink it there? They're selling the cans. brewery buy the fourack and go the state sees the brewery like a farmer collecting honey or lavender and selling it as a farmers market because we're using state grown grain state grown ingredients to make the beer all right so do we have to or should put it put a um condition on this that that not to be consumed there. of this. You guys obviously are doing a good thing, but if you if they're going to be able to drink it there, they're not where they going to go. That's why I'm trying to monitor where would they be? things. My client has entered into a purchase and sale agreement to buy that from Mr. Souza who is retiring from the business uh getting married and giving up running a restaurant. Uh my client desires to have a similar type business that he had a restaurant and different type of food. My client has a background in uh Portuguese and Brazilian other cooking and she has professional chefs

that we work in there. She already has them in line that are friends and families that are in the business. My client actually is interesting is that she works now for Jet Brew Blue. She is the uh coordinating manager for operations for employment. uh she's very uh careful and has to be because she has to report the FDA uh the employees has drug tests and alcohol tests periodically and surprise tests and has

to report these to the government uh monthly. So she's very aware of alcohol and problems that could range with employees and not only that but people that would be patrons. Uh she's buying this business. She will be uh taking Sundays off as her one day of rest. Uh her hours of operation would be Monday from 11 to 10 p.m. Tuesday also from 11 to 10:00 p.m. Wednesday from 2:00 p.m.

to 10:00 p.m. Thursday from 11:00 a.m.

to 10:00 p.m. Friday from 11:00 a.m. to 12 midnight. and Saturday from 9:00 a.m.

to 9:00 p.m. Uh she intends to have a brunch on uh Sundays. Uh the she understands she's actually already taken the alcohol test and food handling test in advance because it's online. Um the operation would be very similar. Uh right now they have the occupancy of the first floor. They use that for their Ming uh uh area for dining. They do have a bar there. They have a kitchen in the

back. They have the basement that is for storage. They can use the same outdoor area that we've applied for in the patio outside in front as they have in the past. And I think the barricades are still out there and they'll be they'll be staying there. Um, we believe that this will be a nice thing because uh there's been a death of a depth of restaurants in this area of a nicer um

dining experience cuz it is a very lovely place. I used to go there all the time and disappointed when Mr. Soua decided it was time to go and he just didn't have product anymore when you'd go in. So, my client uh desires to run this restaurant. uh they've entered into a contract with the the owners and actually the academy building is transferring its ownership to a same management company but a new buyer will

be owned the building so it's a new landlord and we believe it'll be a nice thing. She's uh put up quite a bit of money of her own. She's got an equity line to on her home to take care of the balance of the sale plus she's giving a small mortgage back to Mr. Suza that she hopes that she'll be able to uh recoup soon so he can pay him more off quickly.

Um I'll have leave it up to you to ask any other questions you might want to know of my client. Is this your first time in the restaurant business? Yes.

Yes. I have my friends, my family that help they been doing this for longer than me. Yeah. But um just I work at with the as a manager before but at the airport. So, so, um, who is who is listed as the manager? Yourself? Myself?

Um I'm going to ask that the for police department um uh Miss Melo give us a detective give detective Monus to give you a uh give us a synopsis of what is uh what is the issue we have. We the board already has a list of police calls and so forth and so on, but detective.

Okay. No, that's okay. I'm sorry. Did you want me to read this email first or do you want me to just give a brief explanation of what's been transpiring first? I just a brief explanation and then I will, you know, we'll have questions from the board. Okay. Okay. So, we've been receiving a number of complaints regarding iced out pub. This this is something that I feel like we had actually met with maybe a year ago

regarding this matter. Um I know that things have been quiet for a while more recently. I don't know if it's just the weather warming up and there have been more entertainment going on, but the calls have been coming in pretty regularly every weekend. Um they do come in with a named complainant pretty often rather than not. The same gentleman.

Same gentleman. And sometimes there are actually others that come in from um unknown callers or there was one that was like a refused caller. I believe it was a female. So there are some calls coming in from other people. But we do have one in particular u male that we know of that calls regularly. There is something here that I was actually just asked to read as well. Um I will read

this. This is an email that was sent to um the licensing board. So, uh, to whom it may concern, we are next door neighbors to the iced out pub. We have issues we've been experiencing since the location operated in business. Loud noise from customers outside the building, smoking or all arguments or laughing.

It's loud customers and the cars partying outside where you can actually hear the conversation in my multif family. I've lost tenants on the second floor, moved out due to the noise. This is my first floor. I have family. Sometimes the noise stays until 3:00 a.m. after the party from the bar.

On the weekends, you can hear loud music. Um, this person did want to remain unnamed. So, it just came in as a neighbor, but nonetheless, I've provided the board with all of the calls that we've received recently. Um, I know that some of our officers that patrol that area, they do go by regularly. We have business checks is what we call them.

Any officer that's working during the time frame in which we're normally receiving these complaints will go in and check to make sure that they're not hearing or observing any arguments in the parking lot or loud noise, anything that could be preventative of neighbors calling. However, the calls are still coming in and I'm finding that they are a little later in the night, closer to like 2:00 a.m. quarter ofish.

Um, yeah, that's all I really have. So, I don't I want to turn it over to the board to review. There was two that I actually provided you all with. Those were the most recent ones from this past weekend, May 15th and 18th, the calls came in. So, every weekend it's being documented. We do have officers that have started a report in which every every time that we respond to a call,

they're documenting whether or not when they respond that there is noise. More often than not, it's not something that if the officer is available because obviously it goes by sector car. So it goes in order of priority for the call that's coming in. Um they might not always get there in time. So sometimes there are officers that will report that they've been by and there are no noise,

but it's also been like 30 minutes and maybe since the call has come in. Um and then there are often times where they do say that they're going in and speaking with a gentleman who's identifying himself as the owner. Okay. He's my brother. Okay. And that they speak with him and that he's aware of it and that they'll he'll lower the music down. So, I know that when we last spoke, I had

suggested I know that you guys had just started taking over the business and we had talked about maybe there not being enough insulation in the area in which you have the speaker and that you thought that maybe it was the bass that was and we lowered the bass and we did new like with speakers we moved them more forward and like towards the back, right? But I think it's the same guy and

now he'll call and he'll be like, "Oh, there's a there's a this phone over and over again. You can't just you have you're going to have to come up and give me your name if you can't all just speak. She I'm I'm not trying to be disrespectful. We just can't do that. But yeah, it's it's a lot of it is the same gentleman. And I don't know if he's having others call. I mean

I have people that literally live right behind our building. He's never never complained. Literally my parking lot, his driveway are fence to fence. I have um a customer who lives across the street. She's been inside my establishment, you know, and she's like, "Your music is never loud and obnoxious to where I have to put my TV full volume." And she said her parlor is literally adjacent to the street, like

right at the street. I mean, I get it.

We're an establishment. People can be loud. I understand that. Um I But we're just trying to provide a good time. I mean, the calls are mainly for music. We we try to prevent fights or any of that.

People bringing in weapons. We try to prevent all of that before they even come in our building. You know what I mean? Like make sure nothing's wrong.

Make sure it's safe, fun environment. I mean, and I don't mean to be rude and interrupt you. I'm going to tell you what I really have an issue with here.

I've been in that place not since you owned it when Tony you stole it years ago.

Um, this these calls are coming in late.

Like this at 10:50 a.m. they had to go in your the police said they had to go in your building and tell the DJ to stop the music at 10:50 a.m.

1:50. 1:50 a.m. That that can't be happening. No, the music should be off by 1:45. Yeah.

Well, even that's a little late because I You going to get people out of there in 15 minutes?

We pro majority of the time we do because when because I would say the past month and a half lately the police have been outside our establishment when we've been closing they've been outside inside the se inside the the parking lot. This officer went there at 3:30.

I was not there anymore. And then if they're addressing somebody outside, I'm not there at 3:30 a.m.

This is 2:00 a.m. People rowdy yelling and screaming and yelling. Well, I mean, I'm not trying to put anybody out of business and I'm not about my opinion and I'm only one person on the board.

Um, I just The only thing is I got a lot of like I don't I used to own about Trust me, in a neighborhood far more condensed than you you young ladies have, but down on uh South Beacon Street, there was the houses all across the the every right right around me. And uh I know it can be a problem, but like this last one is this is 14 2:15 they showed up. 1:44 the

large group of people congregating pocket talking loudly and being disruptive. spoke to the owner. Was told that was noise complaint. Had to clear everyone out of the parking lot.

What's the license to two?

So, this this board wants you to be successful. We certainly want businesses to be successful in this area. Like like Mr. Brilliant said he he has a lot of experience in this area. We have a lot of experience in this area. I mean, I I go back to the days of um Jake's Twin Saloon and there'd be riots out there in the middle of the streets. I was in the

middle of some of those riots and uh um I think it comes down to problem solving on on you guys. You're going to look at what what are the issues.

Clearly loud music is one of the issues.

Clearly, right? Well, with one person mostly. Yeah. All right. But but that but that seems to be an issue that you're in front of us for right now. So you you unfortunately you got to deal with it, right? And uh um so you got to come up with a solution to that problem.

This is you these um these um young ladies here said something about you guys did something with the the base and move the move the speaker. Those are you're trying to solve that problem. Um you have a license to two. Um maybe you could say you you this would be a managerial decision but the m just music completely off at 1:30. I'm just making suggestions like completely off because what's going to happen is if this

continues going to be back in front of us to get today. I don't think we're going to take much action today. I don't know. I'm not going to make a recommendation for action today but uh the um you're going to be back in front of us and it's just going to kill your business. It's going to and eventually you are going to be sanctioned at at some point. You know what I mean? So,

uh, you got to really really try to solve these issues and solve the problem. So, that, you know, just make a decision of that's it. No music. They can stay there and and and drink and and and and and hopefully wake make their way out, but just no music. You don't need and I've worked a bunch of bars in my day. You don't need to have music on at 1:30. You can shut it off and your

and your patrons can still have fun and talk and socialize and make their way out the door eventually without a problem. You know what I mean?

Um, what kind of security do you have in it? Do you have um door man bounces?

What do you got? Are you guys a security? I have a door man and I have two. You look it could be I have a door man and I have three in three security.

Well, the doorman is one of my security, but he controls the door and then I have two inside. I mean I mean a lot of people talked and there was a rap competition of some sort. Nobody has any issues with that. You don't seem to be having like massive fights and everything else, right? It doesn't seem that there was one I I found one fight but a bar one fight I have no issues

with that. I mean just so it doesn't seem like there's violence and and criminal activity going on in your bar.

It seems like you are handling business that way. It's more of like the people when they're out Sorry for interrupting you. It's more of like when the people are outside in the parking lot, they're too loud. Yeah. And they're not going away fast enough. You know what I mean?

And it's more of the music. But this gentleman that calls every single weekend, what can I do about him? Cuz he'll start calling at 9:30 and the DJ doesn't start till 10:00. Yeah. So again, all your doors closed. Like even in the subs, do you go in the back anymore? In the back, that's where I Well, in the back is where our bar is. That's where it always was. Yeah. Used to be downstairs

where the We don't have a downstairs. We have one whole floor. That's not open anymore. No. Used to be one. Our downstairs is a basement. Used to have a pool table down there. No, our our pool table now is in the bar area where the where the don shop used to be. You go all the way. No, in the bar bar in the front front is where we have like booths

and where the DJ sets up. Yeah. So, your DJ music is on that side street on on East Main Street. Where's the gentleman who And I'm not trying to point out that gentleman. Whatever it is, he thinks it's too loud. That's where does he live? I believe he lives across the street in behind Patty Pogi. Patty perogi's area. That's a distance away, man. And it's every single weekend he calls the cops on this. Well, that's

that's an issue. I mean, it's not, you know, what are you going to do? But, but, but again, if you if you work on the things that people are, whether it's this guy, a million other people, I don't know, that are complaining about, it's definitely noise. So, come up with a strategy. So, work on the parking lot and making sure the music is shut by a certain time. What time is your last

call? Do you guys have a last call? We do last call like 1:40. Okay. Maybe maybe that's too late. Can you can you for for me and I don't want to interrupt anybody on the board. Can you just maybe bring that back a little bit? Just a little bit. So So you're not like rushing people out of there at 2:00.

They just have already still having a drink in their hand as a a song playing till 10 of and they're running out all excited whatever it may be. Can we maybe trying to help you? No, I'm not. Yeah, I don't I'm I'm like Mr. Pereira and Melanie. I think we're not trying to Is there any like recommendation? There hasn't been no um I mean all the officers that have come

are awesome. Yeah. And I and I don't think this board's in a position to say we're shutting you down or even giving you any type of suspension or anything like that. But as Mr. Pereira rightfully said at some point in time if it keeps coming keeps coming keeps coming there then it'll be a show cause hearing and there'll just be more problems for you.

Okay. For me, looking at the reports, the ones that have that have narratives, they're all between like 1:30 and like 2:30, like and it probably is your Listen, I it's hard to get people to go damn home. I understand that. I I did it for years. It's It is hard. But I think and I started closing earlier because it just was too much for the neighbors and it really was in my It was I didn't like

it. So, um I think if you can maybe do that to stop I would I know listen I know it's money. I know I'm not trying to take money out of your pocket, but if you can do a little bit of that at least if you're showing the board, hey, people cops don't have to policemen don't have to show up at 10:02 2:15 and still have people in the

parking lot. If you can cut it back and have last call a little earlier, shut the DJ off a little earlier. Okay. If you can do that, I think that that would I think for me that's a stop and it's going to show that you guys are also willing to address the problem. So when you come in here and say to our board, hey listen, we've been shutting the shutting the um the DJ off at quarter

after 1:30 what and and last call has been at 1:30 what and we cut it back. I think it's going to go a long way to show you're trying your best for us and the community. So, it gives us a reason to try to help you. And if if be quite honest, because we've done this before with other businesses, if I were you, I would document that and an email to Carrie and say, "These are the

strategies that we are trying. We we understand there are complaints. Don't mention the one guy. Don't even mention that. Just obviously you feel it's one guy, we don't know, but just just say there are complaints with noise in the parking lot and music. So, these are the strategies that we will be trying going forward." would just do that in an email to Carrie and just say we are going to

have last calls like uh Melanie said it's 20 probably too late you know you know we're going to back that down 10 minutes it's not going to kill you to do that and music also at 10 I mean excuse me not to 10:30 1:30 1:30 music's off 1:30 we're going to we're going to um not serve anymore after 1:30 a call last call anyway and just document that so you have something with a little bit of

um little bit of meat to it when you come back here and somebody still complain and say, "No, this is what we're doing." Okay, that's what I would do. And it's just the I don't Is that okay, Carrie? You defer to do that? I think that's great advice. I mean, I don't I don't even drink anymore. But I mean, I think at more at You got people staying until 2:00. There's the last

place they're going. They don't want to go home. They've been drinking all night. Not many places in Florida stay open till 2:00. Yeah. This is old school right now. This is old. That's old school now. Most of them are closing at 10, 11. So you're getting, no disrespect, the guys that are out there drinking a bit. We're getting the end of the crowd. Yeah. So So that's why honestly we've been stopping. If you're

not in our establishment by 1:30 or 1:15, you're not coming in. Well, put that put that in the document as well.

Put that in the email. That's a strategy I use. That's what we've been doing.

Just to cover your covers. The calls are on just the weekends because we have it's just maybe it's solely the weekends. Honestly, the only calls I get are literally just on the weekends. All week long there's nothing. I do have a quick question. Do you have uh surveillance on the outside of your building by any? You do? Okay. Um when when your bouncers are assisting obviously in your crowd control, are

they kind of pushing people along outside as well? They do. They tell them like, "Let's go. You need to get in your cars. Like, let's go. You need to leave." Okay. I mean, because that's helpful obviously. Like, if they're controlling the inside of the building, that's fantastic. And I know that like you're trying to push people out the door by a certain time, but if they can hang out in the parking lot and be like,

"Hey, you guys can continue your conversation elsewhere. Please get off the property." Our premises and go to the right, right? And then that's what happens. It's still our fault because now they're over there, right? Or no, technically. Technically, I'm not going to speak for the police, but but you know, I would say probably technically not. Okay. But the thing is is it is though. But I think again, no, like I

think Mike made the best statement. you know there's an issue whether it's one person or it's 10 there is some things so if at least if you do some some positive things to try to say we understand there's an issue these are the things we did because we do not want to upset the neighborhood we want to be good neighbors at least at that point in time when you come before us we're not

saying well here's a person that knows there's an issue and is doing they're doing nothing about it nothing so that's all I'm trying to say and that listen that no and if you guys have opinions to help us you know allevate 8 problems.

You know that crowd from from 1:30 to 2 is not going to be that's probably turn the lights on like 10 minutes before too. We already started. We've been doing that for a while. I you know it'll save you then you don't need the extra money. It'll save you. Trust me. It's a smart thing to do. I think in today I think I think the consensus is we've told you what the issues are. Okay.

We've asked you to work with Kerry in terms of an email relative to what you possibly can do. Um, I for me personally, the issues I think that's a little too late to let people in and and serve that last drink. I think you're only asking for trouble. I I personally believe that, but that's I don't it's not it's your business and not mine. So, uh, for me, that's what it is. And I
