1:29Next item of business is the request for the variance of the keeping of chickens for David Pimento at 435 David Street, Fall River, 02720.
1:40This is a matter that we're taking off the table from the June meeting.
1:46who uh who's presenting for the for the department.

1:52Okay. So, not much has changed since last time. Um I do want to make a point of clarification if it wasn't made earlier. On the plot plan, you would see not only the location of the coupe, but of a a run, but um there is no run, and the applicant has indicated that he's thought better of it is not going to do that. So uh so the coupe itself is about
2:1811 ft from the property line and if you saw that plot plan the board members you see another shape there but that's not there. Um the yard is much as um can you repeat what you just said what's not there?
2:32Yeah. Uh so the original plan submitted to the board were that in in addition to a coupe there would be a run for the chickens but the run was never built. It is not there now. So the board has drawings of this. So just to clarify when they see that shape on there that's that that is just a small rectangle represents the coupe. That other area is not has not been constructed.
2:57Exactly. So, uh, beyond that, um, I went up there today and I could only count approximately, I've expressed before the difficulty in counting chickens because they move 20 chickens. All I saw was 20 chickens. So, maybe the applicant could clarify that for us. I don't know where the other chickens uh went.
3:22uh but uh as as we you know ju it's just a review from last time you know he's met all the requirements on the ground all the requirements for application um all the plans are in place and other than that that's that's pretty much it. Oh one thing I must mention uh we got a letter um from an abut too late to submit um I don't know if you want me to read

I don't think I don't think they should be allowed. The property in question is in a heavily populated residential area. I believe that having livestock in this area is not only unsanitary but possibly
4:25could attract other predators to the area.
4:28I believe that this would be a nuisance to the neighborhood and should not be allowed at this time. Respectfully Paul Barabby that we address.

5:59So, is there an ordinance ordinance as to a limitation of how many chickens someone can have on property?

6:10It is at the discretion of the applicant's application and the discretion of the board.
6:16And knowing this neighborhood, the board of health is still saying this is fine.
6:20The applicant has met all the requirements of the application.
6:26You already built everything even before the approval was given.
6:29Correct.
6:31And that's fine to do that.
6:34I was told that they would have it down.
6:37it was their fault if they put it up before they were approved.

6:46Can I um just give my perspective on that? Is that okay with the board?
6:51Yes.
6:52And I'd like to see Okay. So many many of our permit holders have chickens without knowing that there is a regulation. So we have quite a few uh permit holders who who not only the coupe, it had the chickens be before approved.
7:11So, it's not it's just not unusual to at least have the coupe there uh before coming to the board.
7:19Um he said he had chickens in New Bedford and if he's already previously had chickens in New Bedford, he knows that there needs to be a permit. Um I I'm not Excuse me.
7:34Uh, so because people don't want to, you know, check in advance, the rest of the neighborhood has to deal with it. Um, June 19th, the chickens going, dogs are in the neighborhood of parking. July 6, rodent poop in my walkway, 241 Free Love Street. We've had feathers in the backyard, trespassing on 229. Um, Free Love to retrieve a chicken that went into the yard. Um, now I have rodent
7:59poop in my house. I have mice dropping uh July 23rd, um August 1st, August 7th, this past Friday, it got into one of my other cabinets, not just the dog food bowl, and into my daughter's uh granola bars and oatmeal. Um I mean, I understand that they have the contract with the exterminator for a year, but okay, so they're not over there. They're coming to everybody else's house. Um I'm I
8:28strongly ask the board to deny it or at least I limit it. I I can't I can't keep cleaning.
8:36I just want to say that. So, I was speaking, but I'm not sure.

8:58And every year he leaves saying he's amazed by he's never seen any evidence of any rodents, mice or rats in this area.

9:10Nothing. And within a month of having chickens, I've had five different instances.

9:17I have one year old. My twins, they are crawling on the floors. I don't want them to get the the h virus, one that gene died from.

9:29Yes. Um, we bought this property back in September of last year. And when we bought this property, it already had over two dozen mouse feeding stations.
9:41So, this was a problem in this neighborhood well before we ever got here. I still have the old boxes here.
9:47The the the contract that I have with Guardian and Pest Control now, it's all new boxes. And all the old boxes are still here to show that this was a problem well before we ever got here.
9:58Not on my property.
10:01Every year we get it inspected. You have three We don't have that problem here anymore at all.
10:06You have three other owners that have never had long-term. How long you've been here, Sue?
10:10Uh 40 years.
10:1340 years. No mice. I've been here nine years. No mice. And then within a month, we have mice. And now my grandkids are on the floor and we get mice in the house. So, we can't get You guys need to get an exterminator service. It sounds like ladies and gentlemen, hold on. We're going to keep this under control.

10:53Okay. Um, as far as far as the rodents, okay, the board requires the rodent contract. As I said at our last meeting, we've been granting permits for for animals for years, and we've never had anyone come back uh in a butter to a a grantee that said they were having a problem. Now, I will share this with you. Um a mice can show up any time. Last Sunday, I was out
11:27watering my flowers in the front of my house. It was about 6:00 in the evening and something moved in my flower bed, okay? And I hit it with the hose and it was a mouse probably about two inches long. And I'm thinking to myself, the nearest chickens to me are down on Stafford Road across from St. Jean's Church.
11:48So, it's not anything to do. It may be a contributing factor.
11:52It is.
11:53But in in Fall River, there are rodents all over town. I'm also entertaining some bunnies and I'm entertaining some chipmunks these last few weeks.
12:04I I cannot believe that the is showing him 30 chickens in this beautiful neighborhood of all river where there aren't that many beautiful neighborhoods anymore. I cannot believe you Thomas are speaking this way allowing him 30 chickens in this awesome neighborhood and you someone told her to go get an exterminator.
12:27Yeah. his other half there. You know, you may have your Incredible incredible problem.

12:49Why did he have roosters? He had roosters. He had to get rid of them. He said he he just admitted that they were when they were born. I don't know much how to tell about the the gender of a rooster or or or of a chicken.
13:00It's very difficult.
13:01So, as the uh as the rooster as the chicken grew, he realized it was a rooster. The rooster's gone. That shows good faith on his part.
13:10This is also very very common. There are stores that give guarantees on this, but that doesn't mean you don't get males.
13:17So, it's almost impossible. There are some people who say they can tell, but it's really difficult to tell if a chick is a boy or a girl. And that this happens all over the city. People will add to their I for months before we found out.
13:32Yeah.
13:33Last meeting I asked how often is this property are properties like this monitored by the city? And I was told maybe once a year. So once you guys approve this, you're gone.
13:46All right. That's not to us to have to fight whatever.

13:53I remember what happened there that it was actually Mr. Curry who said at least once a year.
13:58Um because on renewal of an application, we always inspect, but we we do unannounced sort of randomized checks from time to time. There's no special schedule. Uh, we do want to go there when the owner of the property doesn't know we're going to be there because we're looking for things like a generally messy yard, for instance, nothing to do directly with the chickens. Um, so I can't give you a
14:24schedule, but we do stop by the the permit holders houses from time to time.
14:29Is this for commercial use or personal use? I mean, 30 chickens, he originally wanted 50. It can't be for a family.
14:36It's I can I can I can uh I can answer that. the uh 30 chickens I want for laying eggs, 20 chickens, the extra 20 for the 50 it was to for meat to raise meat birds because meat birds you harvest every six weeks. So they're not you only feed them for six weeks you harvest them in the Cornish tens so it's to harvest meat so I can have meat over
14:58the winter. I eat a high protein diet and it cost a lot of money to do that in the store so I can do it at home. The 30 eggs I have a I still have a big family.
15:07I have both of my in-laws that are alive. My parents are alive. I have two adult children that have girlfriends. I have a big family. I'm the oldest of 40 grandchildren in my family. So, I have plenty of people to give these eggs to.
15:19Eggs are ridiculously Can I speak?
15:23Oh, sure. Sorry.
15:24Thank you. I have a ridiculously large family and eggs are super expensive in the store as we know. So I when I looked into the like the limit of eggs and of chickens I mean of how many you could have the the ordinances in Fall River stated that it depended on coupe size and land size. It so happens that our backside backyard is of large size and can house many many more chickens than
15:5150. And I don't want anything even more nowhere nowhere near more than that. But now you understand the reason why I wanted 20 more and that's to raise meat birds. These birds that are laying eggs will lay eggs for the next 5 to seven years. I don't I don't want to take them as meat birds while they're laying eggs.
16:07That's not how this is done. Sorry. It's just not.
16:10So, wait regulations did he did you did he pass? You said he met all regulations. What were they?
16:17The the three requirements that the board has. He he filed the permit, no roosters, a wrote contract, and to set the number of of animals.
16:28Why did I you know doesn't have to justify why he wants these. Um it's his choice if he wants to have chickens and as long you know there are the rules are set in place by the city. We're here just to make sure that people follow the rules. If you want to change the rules, there's another um mechanism for that.
16:47This isn't the mechanism for that. So if the rules are in place and you've met all the requirements, I don't see the point of this discussion anymore. 30 chickens.

17:07We're here. We're here to make sure that the rules are followed. And if the rules are followed, um I mean we don't have discretion in this. We can't according to Mr.

18:12this approval of so many chickens when there's so much push back and the neighborhood's pristine. That's our point. And I think that there's got to be some extra consideration. We could call it a variance to the variance.
18:28You're making a variance to to allow chickens which typically you would see driving along in Westport or nearby rural communities.
18:38This is an urban setting. want to go down the road and look in Fall River. I mean, the in New Bedford where they have severe rodent problems now, it's just so troubling. And this neighborhood needs some extra consideration. Why not start with a probationary like six chickens and see how it goes and then you can add on if everything's cool and everything's smooth. That's all I got.
19:02And one other thing, I I know we received five letters of opposition.
19:10Yes, five letters. Yes, five letters total in opposition, but 48 of Butters were notified.
19:19So that's only less than 10% of the neighborhood responded. Now, is the others just indifferent or don't care or in favor thereof?
19:30Quite a few elderly elderly. Two two of my neighbors are both elderly. They're both in their 70s, 80s. So I don't know about the rest of them, but a lot of them in here are elderly.
19:41I don't know. I have the list here.
19:43There were 48 of Butters notified. I don't we only received five letters. I received no calls. I don't believe any any of the other members received any calls. Uh Tess Curran from the board did not say that she had received any calls from a Butters.
19:59Um excuse me. I have been on the phone multiple times with Mrs. Well, we have we have a letter from you, ma'am. So, that that that counts as part of it.
20:08There's also pictures of what has been going and dropped off in my house. And I thought that the board should be able to see the pictures um that go along with the letters.
20:19I would like to know about the waste management. What is going on with the waste management?
20:26I would like to to speak. I just came in the meeting. Uh so, when you get a chance Okay, Mr. Mr. Pimento, can you discuss the the waste management?
20:38The waste management, the way that I do the poop, as you can see behind me, is a layering process. So that there's hay that they turn and it once it gets to be 6 to 9 in uh thick, it gets re it gets changed. When it when it's time to get ch get changed, it's going to be put into my garden as the whole compost like I I have an excavator. I will dig out
21:02the garden area. It will all be put under there and then new fresh loom will be put on top of it so it can feed my fruits and vegetables next summer.
21:10That's it. Usually it's it's it's done every um the reason why you can't smell anything. Um uh members of the board of health have been by the house on multiple occasions and the and have actually um con commended me on this on how you can't smell anything around the coupe until you're very very close to it. And that's because of this layering process. They they uh I put down a layer
21:36of hay about an inch and a half to two inches thick and then they do their business for about two weeks and then I put a little bit more hay and then they turn that all around. And because they're turning that all around, it's already composting. It's starting the composting process and it's emitting any of the odor. And because it's open to the air, it just dissipates. So it doesn't You have to be literally
21:59on like in the coupe to smell it. It's I I I am doing everything that I have to do to keep no smells. I have had no rodents in my yard personally, my house, anything like that.

The the cement pad around itself is at least 4 feet and then you have a little hill going up with um uh mulch, red mulch, and you've got your plants there and all. It is not within five feet. So, I
31:53personally did see that. The only thing that it is close is the garage at the house next door, not to you, ma'am. And again, if your pool is within 5 ft of her fence, there's an issue there. The coupe is going to be shortened, but she hasn't done it because nothing's been approved yet because of this back and forth. This is personal, and I don't believe it's anything environmental or
32:13that she's doing something wrong. It's not close to your within 5T. It is not.

32:51this is the red mulch you're talking about that I'm standing in ladies and gentlemen I'm just saying I don't want to smell it my pool in in in the in the continuing efforts to uh to be fair and transparent and everything about uh is it two Sundays ago or three Sundays ago that beautiful Sunday afternoon I uh I asked Mr. Fiori to provide me with a list of uh permit holders here in

And I went around on a Sunday afternoon and I parked my car and I got out of the vehicle and I went to properties I had an address for that had chickens and I uh I understand that um smells are subjective. Okay. But and none of the five sites that I visited did I have an odor of feces or an odor of chickens.
33:50There's the com there was some complaints about the noise. The sites that I visited, it was a Sunday afternoon. Everything was calm and quiet. It was warm. Maybe the chickens were sleeping. Okay. Um so I can't You're going to be you're going to be, you know, smelling all this. I I don't think that exists. Um, there's not a lot of noise.
34:13The situation with with rodents, they have the contract in place. I myself just confessed that I have a rodent contract in place and traps set up all over my yard and I don't have any chickens for at least a thousand yards.

Uh very excited to have you with us. Uh and and welcome you and and why don't you tell us a little bit about your background and and what your thoughts are going into the new position.

44:19Like you said, Crystal Stone. Um I've worked in primary prevention um for about 15 years. Uh the last seven years I worked at STAR um in their primary prevention grant called mass call 3B um which is really focused the city actually has the grunt for F river um I helped out with that one a little bit but mostly was focused on um substance use prevention for youth between the ages of 11 and 17 in Taton Norton
44:47Mansfield and Attboro um before that I worked for the Katy Brown Educational Program. Um, so that's dating violence prevention right in Fall River on Bedford Street for about five and a half years and then um I worked for the Chambers of Commerce for about fourish years after before then. So um I am I I grew up in Fall River although I live in Fair Haven right now. Um just really
45:11excited to be doing this work um here for the city that I grew up for. Um I'll be overseeing both the Shannon and the SSY grants that we hold. Um, and we're really looking at just kind of restructuring them, making sure that Shannon dollars are being spent on Shannon Youth, taking a closer look at our partners and the work that they're doing. So, I've been just taking um this is officially week three for me and so
45:35just a lot of time meeting partners, going over the budgets, making sure that the work that's being done is in accordance to um kind of grant and fun requirements. So, yeah, that's maybe more than a little bit about me. I'm also long-winded as Mr. Cofflin knows.
