Uh good evening. This is April 9th, 2025. Uh this is the planning board meeting. We have an open meeting law.

member bodies develop and adopt rules or policies for public comment. We have adopted such policies which is short provides for citizens input on the planning board specific matters at the end of the meeting. There is a signup sheet at the back of the room for anyone to sign. I'd like to proceed with um attendance. To my right we have Gloria Pico present. Mario present.

Michael Far is present. Also with us are the um our administrative assistant Daddy and also our city engineer and planner Dan Aguier in the office is our assistant uh city planner and also from Fred TV. With that we'll go right into the agenda.

The the agenda is actually posted uh on the website. Notice um is here to give the city of U planning board will hold a public hearing on Wednesday, April 9th um 2025 at 5:30 here in the first floor hearing room one government center fall river Massachusetts to consider the following. Our new business number one is a form a application to endorse a plan believed not to require an approved

ANR plan. The file number is number 25-1618. And we will let Dan Aguiar explain that to the public and to the board. So the plan that you have before you today um is with regards to the subdivision of this parcel uh located on Duth Street. There is currently a single family dwelling number seven that is located on the very far west of the parcel. The applicant appeared before the zoning board of appeals, was granted

zoning relief with regards to frontage and area in an R8 zoning district, and then has followed that up with the submission of this ANR plan uh for your endorsement this evening. On the plan, you will see under uh item number 10 under the survey notes. Purpose of this plan is to divide assessor's parcel E1631 with an area of 10,564 square ft into parcel 1 with an area of 5,275 square ft and parcel 2 with an

area of 5,289 square ft. You will also see that uh there is a note with regards to that this this plan is subject to a variance granted on January 16th, 2025 by the Fall River Board of Appeals and reported in the Bristol County Registry of Deeds book 1128 page 348. And then uh lastly a note that you are all uh comfortable with and have been asking and commenting about under the signature page you will see

that there is a note that states the above endorsement is not a determination as to conformance with zoning regulations. So with all of those items being addressed I can offer that the plan is in conformance with the plan that relief was granted for and that the plan submitted meets all of the requirements for endorsement of an ANR.

I apologize. I should have given you the owner application on this. The owner applicant is Kimberly J. Smith, PR of Estate of Ronald J. Uh, Canard. Uh, the property's location is 7th Street. The assessor's map is E-16, lot number 31. Uh, all members of the planning board have received all of these plans. um these applications and agenda and meeting minutes prior uh to attending this at that point. Um we'll

the owner applicant G toalt uh real estate property is located at 102 Mason Road. The assessor's map is C-08 lot number 14.

So again, submitted to you is an ANR approval not requires subdivision plan uh seeking endorsement of the subdivision proposed at the location as stated by the chairman uh regarding the dwelling at 102 Mason Street. You'll see on the plan that the proposal is to subdivide this overall parcel into three, leaving the existing two family dwelling on lot one with 8,000 square ft, creating lots two and lot three. uh

plan note six. It's rather lengthy, but that gives you the same general purpose of this plan uh subdividing this lot 14 into three parcels. And it goes on to describe the areas and frontage for each. Uh note number seven, you will see the appropriate reference for the grant of relief that has been recorded in the registry of deeds in book 1147 page 82. And again, under the endorsement box for the planning board,

no determination as to compliance with the applicable zoning bylaws is made, intended, or implied as a result of this endorsement. With that, I offer that this plan is in conformity with the plan that was previously granted relief and I would recommend it to be endorsed.

I just had one question, Dan. Uh the uh lot number three I'm assuming pretty easy assumption uh that is frontage on clip street and for lot number two uh it's a mis street. Is that correct? That is correct. Okay, that's it. I yield.

And and through the the variance both of these lots um are proposed to have single family homes built on them. So Okay. nothing more than the single families.

We'll move on to application number three. It's a form A application to endorse a plan believed not to require approve A and R plan file number 251620. That's huge. The uh owner and applicant again is real estate. The property is located at 72 Belmont Street. It's assessor's map M-24 lot 7.

Again, board members, this is uh a submission of an ANR uh endorsement for a former subdivision with regards to the subdivision of the real estate located at 72 Belmont Street. This is an existing three family dwelling that was located to the far north of the overall parcel. The applicant appeared before the zoning board of appeals requesting relief with regards to the frontage requirement in this zoning district

where 100 ft is required. That was the relief needed with regards to subdivision. So you'll see lot one has proposed 12,256 ft which is in excess of what's required in the district. Lot two is 12,986.

Lot two has 100 feet of frontage which is the required uh dimension and lot one did uh receive zoning relief with regards to the proposed 87.67. That intent is listed in plan note number six. And then again in plan note number seven they reference the appropriate legal recording reference for the decision of the zoning board of appeals in book 1144 page 277. And then lastly, again in

Uh with that, I will offer that the plan is in conformity with the uh plan that has received previous zoning relief and the remainder of the plan meets the requirements for endorsement and recording.
