The City of Florida License Board will come to order. To my right is Board Member Michael Pereira. My name is Gregory Brain. I'm the chairman.

Pursuant to the open meeting law, any person may make an audio or video recording of this public meeting and may transmit the meeting to any media. Attendees are therefore advised that such recordings or transmissions are being made, whether perceived or unperceived, by those present and are deemed acknowledged and permissible. City Charter Section 9-18 mandates that all multiple

member bodies develop and adopt rules or policy for public comment. We have adopted such a policy, which in short provides your citizens' input and licensing board specific matters at the beginning of the meeting. There is a sign-up sheet that is located in the back of the room. Did anybody sign up? I know, I thought so.

This is our first public input. I've never had one since I've been here. This is my first public input too. So I'm very interested in see what... Well, thank you for having me. My name is Dr. Gloria Sadler. Hello, dearest members of the Fall River Licensing Board. Tonight I come before you as a resident of the Flint community living at 318 Jink Street. My home

directly abuts the city's Cass Street parking lot, giving me a clear view of the top of Jink Street at Pleasant Street, where Leonard's Package Store is located.

I purchased my home in 2014, so I've seen firsthand the changes in the neighborhood, especially when Leonard's liquor store changed hands.

Since then, I've noticed an increase in people hanging in the liquor store, in the liquor store parking lot, sometimes openly drinking, sometimes trying to hide behind the dumpster on the property. I've witnessed fist fights, including men beating women outside and in front of the liquor store. As a city employee, I do work for the city of Fall River, tasked with revitalizing the Flint community,

specifically Pleasant Street, I've also seen drug dealing, overly intoxicated individuals, and liquor store patrons who purchase their alcohol and then sit on the steps of the Bank 5 or in front of the old Shalimar furniture store, drinking, arguing, cursing, and fighting.

Because I actually live in the neighborhood, no one pays any special attention to me.

So I see it all as it happens. With the exception of the liquor store, the neighborhood has seen good changes. There's been real revitalization along Pleasant Street. The homes near mine at Jenks and Alden recently sold for $1 million. Imagine that on Jenks Street in the Flint.

New residents have purchased and updated what were once decrepit Flint properties. There's a growing sense of pride among those who live here. Multiple new businesses have opened on Pleasant Street. The Flint is seeing real revitalization. I've watched, though, as the liquor store's unruly patrons create an atmosphere of fear. especially for seniors. My own senior citizen tenant

was so concerned about being robbed by liquor store patrons that she closed her Bank 5 account and opened another at a local Pleasant Street bank.

I've also seen neighborhood police ask patrons laudering in front of the bank Why they're there and they simply claim we're waiting for the bus. But then when the police leave, the bus arrives and the lotterers, they don't get on. They just keep publicly drinking, hanging out, entering and exiting the liquor store for more drinks. In closing, I am asking the Fall River Licensing Board

not to revoke the probationary status of Leonard's Liquor Store at this time. The probationary period has taken place during the winter months, which have been especially cold and snowy, meaning that the usual activity that the store has seen had come to a minimal during the cold winter months. Now that the weather is warming, we're just starting to see people coming out and gathering again near the liquor

store. As a resident of the Flint and as a City of Fall River employee, I respectfully request that Leonard's probationary status remain in place for now. And what I have for you is a copy of my letter for each of you. I did print enough, but I also included photos of the foot traffic. Who do I give these to? You give them to me, and I'll give them to you. So you will see pictures.

There are drug interactions going on. And because I work for the city and my job is community revitalization, my job is to be out in the community and see where are the problem areas. What is the problem? What is causing businesses not to want to move into the Flint? And me specifically, I was able to convince a doctor to consider opening up an urgent care facility in the Flint. And when that doctor saw the behavior

that was going on in front of that liquor store, she said, no way. She just decided it was not the place for her to open up a business. Thank you for your time. Do you have any questions for me? Well, wait a minute, Mike. In all due respect, Ms. Sandler did this under citizens input, but we have an agenda item. This should be addressed as the agenda item. Do you want me

I happened to pop open licensing, and I said, oh my gosh, there was a hearing, and I've been timing it and checking the calendar because I said for the next go around... Because I got some questions about the pictures as well. I have video footage as well, and other businesses have been sending me footage as well. Well, the agenda item is under old business number seven, but... So your attendance goes pretty

They're working with the City of Fall River is the big seafood festival for the year, so we're going to have a liquor tent that will be sanctioned off and having police details already been booked for the event. They have their courtyard right in front of the, where

the Viva Forever used to be that courtyard area. So they've asked us if we wanted to extend our Cinco de Mayo this year to the courtyard area. We'd have a band in place. We'd have a police detail in place. We have a mobile food truck coming in. We would be serving food and the liquor out of the truck. Okay. So it's you, not them, though? It is not them. It is us.

They're letting us use the space, but it is for us.

11am to 10pm? That was the, our normal business hours on that day are 11 to 10. I don't plan on saying open any later that day, even though it is Cinco. We're just doing regular business hours. We won't have the band until nighttime, 530, 830. So they'll be wrapped up by 830. There's not going to be any, like, alcohol going from... Not back and forth. People, patrons in the restaurant will be

in the restaurant. People that are at the courtyard area will be at the courtyard.

That's what I'm going to be. As those planters, right? Correct. Yep. So it'd be everything inside the planters. Once 5 o'clock comes, they said that all those parking spots will empty out while they have people working. We're going to plan on putting up tables and chairs, and that will kind of be our little barrier for everything inside.

Sounds tough. Our concern would be people walking back and forth to Purchase Street. It's going to be very, very difficult to control that.

Especially on single tomorrow because people are going, I want to be drinking and partying.

And for some reason, they're going to think they can. It's going to be hard for you to communicate to your customers that they can't. So how do you, we're not going to stop you. No, no, yeah. But we want to help you. So again, this is my first, I just took this over recently. So this is my first thing. Are you the owner? I'm the owner. Yeah, I'm the new owner. Thank

you. I took it over last month. So we just hit our one month mark of being reopened now. So this is our first year having this business. So this is kind of all new to us as well. keep those people confined to that area. I just don't want to see you get in trouble with your overall liquor license by having people think, as Mr. Pereira rightfully states, that they can go back and forth. You've got to just make sure, you've really got to tell your police detail that they've got to monitor. I also plan on having our own door man, whatever word you want to use to be out

there policing as well outside of the actual detail. Can I make a suggestion? Sure.

Detectives, is it, I don't want to give you more work, last thing I want to do, but you think you can meet with him or he can meet with you guys, come to the station, whatever, meet upstairs and come up with a safety plan? And he can forward it to Ms. Pereira? So there is a strategy in place. that they're going to be able to prevent people from walking across Burgess Street.

Because you know they're going to want to. You know, I think it's a block party. Of course. And that's why I didn't want to do it. In the past, they had it. In the past, they did the door sign, but they cornered off the Burgess Street. And it worked good. I actually worked at DTL a few times.

That's not what's happening. You're just going to be the only one. Right, right. Yeah.

Obviously, in the year's future, I'd love to get it to that level, to do what they used to do there years ago. But for this... quickly and you know.

The owner of the property, I'm his landlord. I used to hold that license since 2006. I was at Allen's Auto Sales for over 20 years there. and we can fit 20 vehicles on the outside parking with parking for the clients and that's where the property fits. And I was there holding the license for over 20 years. Okay. So you want 10 cars and you're going to be able to accommodate the parking for customers and for your

workers. Because you're saying you have 20 spaces. Yeah. Okay.

Hathaway building commissioner slash zoning officer for the city of Fort River mr. chairman we've had some complaints from the neighbors in the past in regards to this particular location I would ask this gentleman has not checked with us the meaning the zoning office to see if they can we can work anything out or knowing that there was a change of ownership. So he's not aware, I'm sure, of the complaints from the

neighbors extensively from the neighbors whereby there were, let's say, renting or leasing or borrowing adjacent pocket places from an adjacent business and it became contentious. So what I would like to suggest to the board, if I can, is that he come to the building department at some point and have a conversation with the zoning officer because I

believe there is also a zoning decision on the number of vehicles that this place can carry. We don't have that in front of us, but I believe there is.

If it isn't in the zoning, it was in the licensing of the former owner to have a restricted number of car spaces for auto sales.

Yes, there is some off-street parking on the side street that's there, but that was contentious also with the neighbors. Yeah, well, you can't count Wall Street parking.

So I would like to see the board, ask the board to table this, have the prospective owner come to me and talk to me about it. We'll sit down.

We can discuss it with perhaps the detectives also and come to a conclusion.

I have no problem with that. I'd rather just have this young man getting into business to make sure his plan is accurate. No disrespect to him, but still only shows nine clouds. I know he's only handwriting them in. I'd like to know where the parking spaces are going to be to display the cars, where he's going to have customer parking and employee parking, because I think that's required under the ordinance.

have Ms. Heather Moniz right there that did a full investigation on this matter with my neighbors. She did check with about 15 or 20 neighbors by that back in the day. She has a report. They are saying there is no issues with the neighbors whatsoever and was a win-win situation on my side because I hold that license for over 20 years. I gave up that license two years ago to change

business. And back in the day when I did... Don't say that. You might want to stop talking. Oh, I'm sorry. No, because after two years, it lapses. So if you shut this place down two years ago, you don't have a business anymore, sir.

The business was not shut off, sir. Someone else took over the license. We have a lease agreement with them. And now they couldn't keep up to the business. Someone else is taking it. No, no, I understand. I thought you said you gave up the business two years ago. You're meaning you. Mr. Chairman, may I elaborate a little bit? So with that change of... I don't think you're going to have to because

I think we're going to make a motion to table this and get this right because it has a variance... to operate auto repair and auto sales for not more than 20 cars. 10 only can be shown. That's pursuant to his variant, so that's gonna go through you. So he can't have any more than 10 cars for sale, but he also has to make sure he has the requisite amount of cars for

the business itself. And I want him to know that before this. I'm not saying there's any problem, but I think we're gonna, I would entertain a table of this to the next meeting, and at that point in time for him, even the former owner, to go in and see you and get these all things all resolved. Just a couple of, Heather, before I make the motion, the investigation of that gentleman back

there that you conducted, how long ago was that? It's been probably about several years.

I will say that Glenn and I did work on frequent neighbor complaints that were coming in, mostly that there was limited parking, there was parking obstructing the roadway and things of that nature. So, obviously this board has been very, very pro-business and we want to help you Just like the staff that we want to help you, keep you out of trouble. So I'm going to make a motion to table

this business to a time in the future where you reapply after you need to go upstairs with the zoning, the license, whatever you need, whoever you need to meet with upstairs and square this stuff away. And then come back once you're squared away and we'll most certainly entertain this business. Again, could be as recent as next month. It could be in a couple months, whatever it is. It's kind of

like on you at this point. I don't think we can make any conditions to the motion. You're just going to motion to table it. It's up to him to do what he has to do. I can tell you what I'm going to look for myself afterwards is a detailed plan that shows the amount of spaces you're going to show cars for sale, spaces that you have designated for the auto

repair shop, spaces that you have for customer parking, and spaces that you have for your employees. Because by this variance, you only got 20 spaces for both businesses. That's why you're not going to have these other problems with things on the street. I want to see your plan showing how you're allocating 20 spaces for two businesses, customers, and for employees. That I'm

fairly certain. I mean, I'm an attorney. I'm fairly certain that That's what your variant says. You're going to have to show it. And that's going to alleviate problems you may have because there might be over 20 cars in total on that property. Okay?

There is the parking lots that the Ogills once had as part of their licensing agreement with the establishment of O'Gill's has been sold off and now there is no parking whatsoever and it seems to be detrimental to the neighborhood. And here we are, we're going to take, which is a restaurant with a slash bar that once had parking. Somehow or another they were granted a change of use, a

I don't know what else to ask other than to deny the license for the entertainment because it's only going to make it worse for the neighborhood. The only problem is that, and we've had discussions, they don't have any.

That's fine. I'm not so concerned about, there has been two calls to my office in regards to noise complaints. I've, my girls in the office, the clerks, I tell them to call the police. If they tell us on Monday or Tuesday, they've got to wait until the weekend to call the police because that's when it's going to happen again. Now, if they don't call the police, I can't help

that. I'm just telling you, explaining that I have received two complaints. No, and I believe you because I have... Our office two different times have received complaints from people in the, what I'm going to say is, I'm guessing the neighborhood. But my concern here tonight is the fact that they're looking for an entertainment license with no parking whatsoever for that business. You mind? No, go right

ahead. I've got to ask you a question because I think you said it twice tonight, that these people are getting licenses from us without checking with you on zoning? That's correct. Is that something we're messing up on? I don't know. It's falling through the cracks. So his, I don't want to speak out of terms, but this particular, I said, somebody's got to close that loop. So

again, there was, let's talk about from day one with this establishment, because that's the one we're talking about. My understanding was the property, the owners were retiring.

They were selling the business and they were selling off all the real estate. The next thing I know, we were receiving permits to build in the parking lots of Ogill's. Ogill's is closing. They're closing the business. They're going to put apartments in where Ogill's was. That's what I know. Until I get two phone calls, my office receives two different phone calls at different times from people complaining about the

noise coming from Ogill's and the parking arrangements. So, okay, now I start asking questions. Well, O'Gills is still in business. Well, how did this happen?

So there's a crack somewhere that fell through in the change of ownership, and they never got to check with the licensing. So you're on top of that. I talked to Glenn. But here we are. We sold the parking lots off. But I called today over to planning. And I was told today that there are no, that first of all, O'Gills was opened, before they ever bought any of the parking lots.

That there are no zoning variances on record that ever conditions O'Gills, nothing to do with them. That's years ago you talked about. Yeah, that never condition O'Gills to have any parking. Never. So that's why they were allowed to file and there's no parking requirement. I don't know if it's right Glenn. And all due respect, I don't know, I called late this afternoon in anticipation of this because I

got a call about parking. I told you. I got a call about parking. And I said, well, it's a zoning issue. If the zoning, if there was ever a variance to open that up way back when, and they said you can have a restaurant conditioned upon having 40 parking spaces, 20 parking spaces, 10. If they don't have 10, then they can't open up because it's in violation of zoning. So...

What I'd like to do, in fairness to these gentlemen, is because you didn't even know this was on today, and all due respect to you. I did not. You did not. And I would like to, and all patience to you guys, I'm sorry, maybe take a one-month table of this to find out exactly what the situation is with the parking. As far as I'm concerned with the times they're asking, I was going to ask them

to go from at least from a period to go only to six to nine.

So they say, I know it's one hour less, let's make sure it's not a problem, and they don't get any complaints. I respectfully disagree, and I'm going to explain that to you. So obviously, I grew up in a family, and I'm very familiar with that area too. They were given, not these guys, but way back then, Ogilch was given a license to open a restaurant. Absolutely. And there wasn't any

consideration for parking because they were, There was no, you know, mandate that you have to have certain apartments. This fellow here, in this group, they came and they opened a restaurant. And there's no, there still isn't any condition for off-street parking because it's still a restaurant. I'm going to have to, I tend to agree with Mr. Hathaway that there's no room there for entertainment. Oh,

okay. There's absolutely no, so my motion is going to be to deny the application.

That's my motion. I feel that there's no room in that neighborhood to defend this.

He's got a business and what he originally asked for, now he's asked to expand.

So my job is to always be out there engaging, knowing who the owners are.

If I see a problem, I bring it to their attention. If they see something to be a problem and need me to bring it, escalate it to Glen or whatever department, that's a part of my job. And so, again, I'm always familiar with the owners. And there have been times where they're congregating between the liquor store and Ronald Renee's property so badly that I'll take a photo and I'll send it.

I'm like Ronald Renee. And he will look on his cameras, and they won't know he's inside. And he'll come in outside, and he'll tell them, you can't hang here at my property. He doesn't care what Mr. Patel doesn't say. But for his property, he's not having it. Mr. Rene is not having that. Mr. Patel on the other hand, what I didn't say because I didn't want to get into the weeds is I've gone into the business

to stop some of the behavior, to have conversations and everyone says this. I don't speak English. The workers are telling me. I'll say Okay, here's my business card, tell the owner to call me to this very hour, to this very minute. I've never received a phone call. In fact, I had a conversation with my supervisor, Mike Dion, and I said, Mike, this is really

becoming problematic. I saw this residing as a resident on Jenks Street, but as an employee for the city, and this is what my position is. This is a bad problem because now I'm really paying more close attention. And my supervisor suggested I write a friendly little, invite him in and kind of say to him, how can we work together to resolve this issue? Guess what? To this very

day, Mr. Patel has not responded. Well, if you could please come at the next, and I apologize if you sit here. I wish I would have thought myself I'm getting old because I did have that conversation. Because I spoke to Heather and Detective Monis, and I thought things were better. No, in fact, in my phone right now, if I were to pass my phone around, you'll see where they're

starting up, and there's this one short one. Oh, he's just blatant. And when he recognizes my vehicle, he now will go sit at the bank. So I even took pictures of him sitting at the bank because I'm working now to have a bus stop move so that the police will not have that Well, they said that we're waiting for the bus because that kind of puts the police in a bad position.

And then when the police, like I said, they drive off because they've got a call, soon as the bus comes, they don't get on. So I figured let me try to be a bit more proactive and work with the regional transportation company and have that bus stop moved. I'll tell you.

I was a police officer for over 31 years and I did quite a bit of my career in the Flint, the good times and the bad times. And it's the first time I've had the pleasure of your company. I don't know you. I don't know if you know me, but I don't know you. And you're very eloquent and I think you're an excellent advocate for the Flint. And if you're going to

be involved in the revitalization of the Flint, I think it's in good hands. My son is a Fall River police officer and it drives him nuts that I'm out there. Well, can you, I can catch your name at the beginning you said? Sadler.

Oh. My son is William Sadler, yes, the big guy, yes, yes. So he grew up in the front? I purchased that home in 2014 and the only reason I purchased that home is because it had a guest house in the back and my son wanted that guest house. I lived in Quincy. My son wanted me to purchase property that he could put his photography and DJ equipment and have a man cave.

In addition to, he didn't like living in apartments where he had to move because people were smoking marijuana or drinking or playing music. And at the time, I think he just had the two little girls. Now he has four. You have an excellent son too, an excellent police officer. So he asked me to, can't you buy a property? And I purchased that property, and I did so much so that I left

Quincy and moved to the property. That's nice meeting you. The Flint's in good hands.

Heather, I did have one question, though, about this, the Leonard's. Since that meeting, we had him here that day. Has Mr.

Patel made any contact with you at all as far as safety plans? He has, or hasn't? So I'm actually glad that you asked, because When I was brought to my attention that this was going on the agenda today, I had done some looking into it to see what has progressed or not progressed as far as the recommendations that were brought in front of Mr. Patel and his attorney at the time. And

from what I could see from the calls, it does seem as though he has been proactive from what I read from some of the reports that were being generated.

Our officers are still responding there, but at the request of Mr. Patel to deal with issues that are being had there. However, I will say that I did agree with you in saying that when I looked at it, it does show that there has been a progression. These calls have obviously been during the winter days and I know and we all know that as the weather gets warmer that could potentially change.

That was something that I had actually proposed as well when it was brought to my attention that it was going to be on the agenda. I mean things look great and they do look as though they're moving in the right direction. However, it is still a bit early to tell given that the problems will persist in the warmer weather. We'll wait until it's going to be tabled and we'll bring it up.

given the fact that she's so involved and has pitches and so forth and so on, I mean, we're going to have to, more than likely, without making a decision, I'm leaning towards obviously extending this and making sure we're on top of it because it just can't continue to happen because there is money being spent on Pleasant Street and revitalization is moving forward, so, you know. business open on Saturday and unfortunately, myself nor the mayor could be there, because I was doing a Flint Community Garden kickoff along with the rail trail extension completion and so I could not be at that business to really allow the public to see another business on Pleasant Street had opened.
