like to welcome everybody to the Wednesday, May 13, 2026 meeting of the Fall River Planning Board. Pursuant to the open meeting by law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any media. Attendees are therefore advised that such recordings are or transmissions are being made, whether perceived or unproceived by those present, and are deemed

acknowledged and permissible. The city charter section 9-18 mandates that all municipal member bodies develop and adopt rules or policy for public input. We have adopted such a policy which in short provides for citizen input on planning board specific matters at the end of the meeting.

There's a signup sheet that it's located in the back of the room. I'm going to do a roll call. We have with us Craig Salvador from For Government TV, Dan Agar, city engineer.

Chris Lebec is not with us. And we have Felicia Parker, assistant planner.

Number one on the agenda under old business, uh, roadway reconstruction, Spring Street, section 66-185, city ordinance concerning the roadway reconstruction plan and profile of Spring Street. This petition was tabled at the April 13, 2026 meeting at the request of the board. Say, so we've had correspondence with the consulting engineer, which is Bill Smith from Teran. He's still working to

resolve some of the requested items that we had. We are scheduling a date to go do some test pits so that he can rely on real soil data for some calculations.

Um, so with that, uh, we did receive an email formally requesting that the matter be tabled, and that would be my recommendation that we provide them the time to be able to respond.

Representing the applicant here, uh, as Dan, the city engineer, pointed out, this property had been uh, subdivided approximately 3 years ago where they created three individual lots conforming to the town's zoning regulations. This plan is basically undoing that plan, getting rid of the three individual lots and putting it back to just one perimeter lot.

So, it's a pretty pretty straightforward application in front of the board here just removing those internal lot lines that are shown in blue on the plan and called out to be removed.

So, on that um as Scott stated, yes, it is a formality to merge them. um is a proposed building um for construction that's being currently reviewed and because it extends over the individual lot lines required so that no issue and setback requirements. So initially the developer had thought of developing the parcel a little bit differently owner is looking to merge it and build a larger warehouse building that all

That's the uh the big parcel that was cleared.

So again the intent of this plan is to reconfigure three existing parcels of land. They're currently conforming already as it is some minor lot line changes mostly along the rear of the front lots and and then dividing lots and going through site plan review in order to meet some building setbacks for the structures that they wanted to build. They needed to to modify the lines a little bit. Each of their

reconfigured parcels uh meets or exceeds their requirements for the BL local business zoning district. We reviewed the plan and submission and find it to be complete and I would recommend endorsement of the plan.

We received email correspondence uh earlier in the day today that attorney Seleno was requesting that that the plan be uh withdrawn and I told them that we would return the filing fee.

So not tabled was withdrawing withdrawn completely completely.

So there's no action on our end.

No action on your end. You just have to vote to allow it to be withdrawn without prejudice.

So you all know this as our lady band club over on Quarry Street. Um they are subdividing a portion of the land bottom right hand corner. So the let's call it southwester corner of the property. um having out a 10,000 square foot lot which is conforming to the zoning district um leaving the remaining club and parking facility on on the other piece. So both parcels meet the zoning requirements and with that I would

recommend endorsement of the plan.

Now that's where that's where they got the that the concession stand concessions. Yeah I think it's actually shown on the plan right?

Yeah sure.

And what is the purpose for the 13oot easement?

It's not a 13 foot easement. It has a 13 foot just additional access I'm assuming for utilities because there were better there better utilities um quick street. Yeah.

But their legal technical frontage for meeting zoning uh and area is on the quarry street side.

I like how they joged in the uh the band stamp on the property lines that was on the previous one that come out previously. Yeah.

And then Lebanon Street has all been built up a bunch of town houses, right?

I think what happens is that over time the the club has a need for revenue. So this is that's one way to do it.

One way to do it, I guess.

So you'll notice the file number on this is actually a 25 file number which means it was from the end of last year. So originally this plan came before you uh creating two buildable lots out of the Notre Dame cemetery. That plan was endorsed, never picked up, never recorded.

During the survey uh before the sale was to take place of these two parcels, they realized that there were minor encroachments from some of the abuing land users. So what they've done is you'll see creating parcel A and parcel B. Those parcels will be conveyed to the adjacent land owners to eliminate two encroachments that each of them had. One of them was a stone wall, another of them was patio on the other side.

I saw parcel A and B on the plan I was emailed. Yep.

You know, Yeah. See, I don't have it on my Yeah, but I saw that's the plan that you guys were doing the last time.

Yeah. So, so ultimately, they're still creating the two buildable parcels, one and two, which you saw on the on the previous plan. But on top of that, they they were lucky enough to have the additional frontage and area to be able to deal with these encroachments. And I don't know if they're gifting the parcels.
